AGENDA ITEM:Consideration of approval of a resolution approving Request for Additional
Services No. 2 with Genus Landscape Architects for the Fox Creek Park
Phase 2 Project in the amount of $23,566.20.

SYNOPSIS INCLUDING PRO & CON: The Request for Additional Services is related to the
additional scope and time spent during the extended construction of Fox
Creek Park Phase II. The additional work included the upgrade to the Tuff
Coat surfacing at the splash pad. Genus Landscape Architects efforts during
this improvement was extensive and integral to the success of the final
product. The second part of the request relates to the prolonged construction
completion and closeout. The original closeout of the project was anticipated
to be June 15th 2019 with the actual closeout not happening until August 2020.
The extended completion date required Genus Landscape Architects
additional site visits, contractor coordination efforts, and multiple punch lists.
Outlined below are the total project costs for the completion of Fox Creek
Park Phase II.

APPROVING REQUEST FOR ADDITIONAL SERVICES NO. 2 WITH GENUS
LANDSCAPE ARCHITECTS FOR THE FOX CREEK PARK PHASE 2 PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on February 20, 2018, the Waukee City Council approved an Agreement for
Professional Consulting Services with Genus Landscape Architects related to the design
development and construction and bid administration for Fox Creek Park Phase 2 (Resolution
#18-075); AND,
WHEREAS, on November 5, 2018, the Waukee City Council approved a Request for
Additional Services No. 1 with Genus Landscape Architects for said project (Resolution #18-
451); AND,
WHEREAS, the City proposes an Additional Services Agreement No. 2 related to the additional
scope and time spent during the extended construction of said project.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Request for Additional Services No. 2 with Genus Landscape Architects for the Fox Creek Park
Phase 2 Project is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 17th day of August,
2020.

Dear Mr. Jermier,
As follow-up to prior discussions, this memo is presented to request fees
for additional scope and time spent during a protracted construction
duration for Fox Creek Park Phase II. The time incurred is organized into
two distinct timeframes and work efforts outlined below:
1. Upgrade spray pad surface:
During the summer of 2019 [ July 8 – August 1] the spray pad surface
was upgraded with a Tuff Coats surface. Oversight of contractor efforts
during this improvement was extensive and integral to the success of
the final product. Reimbursable expenses incurred have been
absorbed by the allowance within our original agreement.
2. Protracted construction schedule:
The original project contract was structured to close out on June 15,
2019. Nearly fourteen months later, the project is anticipated to close
out in August 2020. While we’ve tried to be judicious in determining
how our time is spent and which items could arguably fall under the
original contract parameters, the multitude of site visits, contractor
coordination efforts, rework and time spent tracking and creating
multiple punch lists has been significant. Because contract close out is
part of the original contract, we are not seeking compensation for time
related to coordination of project close out. The time outlined below is
a summary of hours that will be spent working with the City of Waukee
and Caliber Concrete to complete remaining work to reach project
completion.
