AGENDA ITEM: Consideration of approval of a resolution approving easement associated
with Lots 33, 34, & 35 of Painted Woods West Plat 2
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City Council previously approved a final plat for
Painted Woods West Plat 2. Since the approval of the plat, a need for
additional easement area for an overland flowage swale within a portion
of the plat is required. The owner of the lots has agreed to provide the
additional easement area.

RESOLUTION 2020-
APPROVING OVERLAND FLOWAGE EASEMENT ASSOCIATED WITH LOTS
33, 34, & 35 OF PAINTED WOODS WEST PLAT 2 [KIMBERLY DEVELOPMENT
CORP.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City Council has previously approved the final plat for Painted Woods West
Plat 2 (Resolution #16-397); AND,
WHEREAS, it is necessary to acquire an Overland Flowage Easement across a portion of Lots
33, 34, and 35 of Painted Woods West Plat 2.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
17th day of August 2020, that it hereby approves the public overland easement associated with
Lots 33, 34, and 35 in Painted Woods West Plat 2 as recorded in Book 2016, Page 17185, of the
Dallas County Recorder’s Office.
