HomeMy WebLinkAbout2020-08-24-D02 SE Kettlestone Blvd Development Agr AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: August 24, 2020 AGENDA ITEM: Consideration of approval of a resolution approving Developer’s Agreement, Warranty Deed and Easements for SE Kettlestone Boulevard Extension Project FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The City Council has recently approved construction drawings for an extension of SE Kettlestone Boulevard west of Grand Prairie Parkway. The City’s policy is that the developer is responsible for a 31 foot wide street and any turn lanes that are required. In order to align the extension of Kettlestone Boulevard west of Grand Prairie Parkway with the extension to the east, additional lanes need to be constructed initially beyond the obligations of the developer. The proposed development agreement, warranty deed and easements for construction identify the responsibilities for both the developers and the City. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Not to exceed $360,000. The City annually budgets for lane additions that are beyond the responsibility of the developer in the annual Capital Improvements Plan budget. Proposed Development Agreement PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: D2 THE CITY OF WAUKEE, IOWA RESOLUTION 2020- APPROVING DEVELOPER’S AGREEMENT, WARRANTY DEED, AND EASEMENTS FOR SE KETTLESTONE BOULEVARD EXTENSION PROJECT [OAKLEAF PROPERTIES, L.C., AP GPP, L.C., KNAPP PROPERTIES, L.C.] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City has been in discussion with specific property owners regarding the conveyance of certain property interests necessary for construction of the SE Kettlestone Boulevard Extension Project; AND WHEREAS, the discussions have resulted in agreements and easements that the City Staff believes are in the best interest of the City to approve. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the Developer’s Agreement, Warranty Deed, and Temporary Public Facilities and Use Easement for SE Kettlestone Boulevard Extension Project [Oakleaf Properties, L.C., AP GPP, L.C., Knapp Properties, L.C.] are hereby approved. BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to effectuate the closing on behalf of the City, and that the City Clerk shall cause the originals of the Agreement, Deeds and Easement(s) to be recorded upon the properties by submitting the original to the Dallas County Recorder with the appropriate recording fees.
