HomeMy WebLinkAbout2020-08-31-D05 Lolowau Property Purchase Agr CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: August 31, 2020 AGENDA ITEM: Consideration of approval of a resolution approving Offer to Purchase Real Estate for certain property located in the City of Waukee (LOLOWAU Property) FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: City Staff has negotiated a purchase agreement for an approximately .59 acre parcel of property located along SE Parkview Crossing Drive and adjacent to the large detention pond that serves the Kettlestone area. The purpose of the property acquisition is to allow for the extension of a trail and expansion of the trail amenities associated with the Kettlestone Greenbelt Improvement Project. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $144,000 COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: . The City Attorney has prepared the purchase agreement and it has been signed by the property owner and is attached for your review. Per the purchase agreement, the City will be providing a credit towards a previous agreement that the City negotiated with the property owner related to the extension of Westown Parkway in 2017. There will be no cash payout by the City for the acquisition of this property. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Proposed Resolution II. Proposed Purchase Agreement PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: AGENDA ITEM: D5 THE CITY OF WAUKEE, IOWA RESOLUTION 2020- RESOLUTION APPROVING PURCHASE AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF WAUKEE IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND WHEREAS, the City desires to enter into a Purchase Agreement (hereinafter referred to as the “Agreement”) and said Agreement has been accepted by the Seller, Lolowau LLC, for certain property legally described on attached Exhibit “A”; AND WHEREAS, the City Council of the City of Waukee deems it to be in the best interest of the City to purchase the property; AND WHEREAS, the proposed Agreement between Lolowau LLC and the City of Waukee is attached as Exhibit “B.” NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee that the Residential Purchase Agreement attached hereto as Exhibit B is approved. BE IT FURTHER RESOLVED that City Staff is directed to proceed in accordance with the Agreement. Upon the determination of the City Attorney that the conditions of the offer have been satisfied and title delivered staff is authorized and directed to proceed with closing.
