September 8, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R.
Lyon (electronically), Ben Sinclair. Absent: None.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart
(electronically), Development Services Director Brad Deets (electronically), Public Works
Director/City Engineer Rudy Koester (electronically), Parks & Recreation Director Matt Jermier
(electronically), Human Resources Director Michelle Lindsay, Marketing & Communications
Director Summer Evans (electronically), IT Director Son Le (electronically), Fire Chief Clint
Robinson (electronically), Deputy Fire Chief Tomme Tysdal (electronically), Police Chief John

Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 – 0.
(F) Monthly Mayor’s Report – Mayor Clarke reported on her attendance at the Fleet Farm grand
opening, noted the Sept. 10 Waukee Area Chamber of Commerce economic development
virtual bus tour, stated the Waukee Leadership Institute still has openings for this year’s class,
and asked all to respond to the 2020 Census.
(G) Presentations:
1) Westcom Strategic Plan update – Presentation made by Westcom Chief Darin Riney and
Clive City Manager Matt McQuillen, both participating electronically.
(H) Public Hearings:
1) On the annexation of consenting property by the City of Waukee, Iowa [Castle
Productions, LLC Property] – Mayor Clarke opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative.
Development Services Director Deets reviewed the voluntary annexation application, noting
that there are several parcels on the west side of N. Warrior Ln., including the subject
property, that were never annexed in the past. No comments were made by the public in
attendance.
2) On the annexation of consenting property by the City of Waukee, Iowa [Crawford
Property] – Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the voluntary annexation application. No comments were
made by the public in attendance.
(I) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving the annexation of
consenting property by the City of Waukee, Iowa [Castle Productions, LLC Property]–
Council Member Crone moved to approve the resolution; seconded by Council Member
Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0. (Resolution #2020-323)

2) Resolution: Consideration of approval of a resolution approving a pre-annexation
agreement [Crawford Property]– Council Member Crone moved to approve the resolution;
seconded by Council Member Sinclair. Development Services Director Deets briefly
reviewed the proposed agreement. Results of vote: Ayes: Bergman, Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-324)
3) Resolution: Consideration of approval of a resolution approving the annexation of
consenting property by the City of Waukee, Iowa [Crawford Property]– Council
Member Lyon moved to approve the resolution; seconded by Council Member Crone.
Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion

2) Ordinance:Consideration of approval of an ordinance to amend Chapter 103.4(A),
Waukee Municipal Code, establishing penalties for violations of Waukee Municipal
Code [second, third (final) readings] – Council Member Lyon moved to approve the
second reading of the ordinance in title only and waive the third reading; seconded by
Council Member Crone. City Attorney Brick noted that the proposed ordinance would bring
City code in compliance with State code. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Ordinance #2968)
3) Ordinance: Consideration of approval of an ordinance amending Waukee Municipal
Code Chapter 108.5, Powers and Duties of Mayor, by adding thereto Subsection O
clarifying the mayor’s powers during a time of emergency or public danger, and
repealing Waukee Municipal Code Chapter 607 (Option A) [introduction; first, second,
third (final) readings] – Council Member Sinclair introduced the ordinance, moved to
approve the first reading in title only, waive the second and third readings, and place the
ordinance on final passage; seconded by Council Member Bottenberg. City Attorney Brick
stated that following approval of the first reading, several material changes were made
regarding enforcement efforts and penalties for violation of a mayoral proclamation. Mayor

Clarke asked for clarification on a municipal infraction and a simple misdemeanor; City
Attorney Brick reviewed the differences between the two violations. Council Member
Bergman asked if an unpaid violation could show up as a property lien; Mr. Brick replied in
the affirmative. Council Member Bergman stated it was worth considering that such an
unpaid citation would show on a future title search. Mayor Clarke acknowledged Council
Member Bergman’s concern, but noted that a fine classified as a municipal infraction would
be much less than one cited as a simple misdemeanor. Council Member Bergman
responded that any unpaid citation, civil or criminal, would still show up as a property lien.
Council Member Bottenberg stated that if such a violation is limited to a civil or criminal
infraction, he would rather use a civil violation, as criminal infractions would appear on a
background search. While he desires compliance with a mayoral proclamation, he does not
want noncompliance to impact individual lives for many years. Council Members Lyon and
Sinclair both agreed with Council Member Bottenberg that a civil infraction was preferable to
a criminal violation. Mayor Clarke clarified that if the proposed ordinance is approved, the
following ordinance (Agenda Item #J4) must fail due to lack of a motion. Results of vote:
Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

reviewed the proposed ordinance, which would incorporate Iowa Department of Natural
Resources regulations in order to protect and prevent contamination of the ASR water
source. Council Member Sinclair asked if the ordinance impacted residents within the well
protection perimeter; Mr. Koester replied that it did not impact day-to-day use but did limit
lawn herbicide applications. He added that those property owners possibly impacted were
notified in advance of the proposed ordinance. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.
6) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1B and R-3/PD-
1 to R-3/PD-1, a property known as Bricktowne at Prairie Crossing [second reading] –
Council Member Crone moved to approve the second reading of the ordinance in title only;
seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

11) Resolution: Consideration of approval of a resolution approving site plan for Waukee
Event Center [195 NW 10th Street] – Council Member Sinclair moved to approve the
resolution; seconded by Council Member Lyon. Development Services Director Deets
reviewed the site plan, including access points, possible facility uses, onsite stormwater
detention, parking and building exterior elevations. Council Member Bottenberg recalled that
the property currently has severe drainage problems and asked if staff have any concerns
that site improvements may negatively impact surrounding properties; Mr. Deets replied in
the negative, explaining that the applicant has submitted a stormwater management plan
and staff is confident that site improvements will address existing drainage issues without
negatively effecting neighboring properties. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-338)
12) Resolution: Consideration of approval of a resolution awarding contract [Triumph
Park Project] – Council Member Crone moved to approve the resolution; seconded by
Council Member Sinclair. Parks & Recreation Director Jermier reviewed the bid tabulation,
including all bid alternates and possible deducts. He recommended awarding contract to
Larson Construction of Independence, IA, without Bid Alternate No. 3 and with no deducts.
Council Member Crone asked if staff was familiar with the contractor; Mr. Jermier noted that
Larson is the general contractor on the current Northwest High School project. Council
Member Lyon expressed concern with artificial turf use in some areas, citing maintenance
and replacement issues; Mr. Jermier replied that the artificial turf was more aesthetically
pleasing and would make for more comfortable ground seating. Council Member Sinclair
asked if the fishing pier (Bid Alternate No. 3) would be constructed as a separate project in
the future; Mr. Jermier responded that staff would continue discussions with Waukee
Foundation, Inc., on the matter but that the Foundation does not currently have funding in
place for the pier. City staff may also explore ways to reduce the construction costs of the
pier. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.

21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting
in person was impossible or impractical.
A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke
at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the
electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.

1) Home Builders Association of Greater Des Moines apprenticeship program – Dan Knoup,
participating electronically, presented on the skilled trades initiative program.
2) Waukee Area Christian Services presentation – Melissa Stimple and Heather Van Leeuwen,
both participating electronically, presented on the services and advocacy provided by their
organization.
3) Waukee Betterment Foundation fundraising update – Jim Miller and Todd McDonald, both
participating electronically, presented on fundraising efforts to date for specific Triumph Park
amenities.
4) FY2020-2021 Strategic Plan: Economic development strategy – City Administrator Moerman
lead the council through questions intended to better define their vision for City economic
development.
5) FY2020-2021 Strategic Plan: Affordable housing – Development Services Director Deets
guided the council through questions to help craft a preliminary affordable housing strategy.
6) Tax Increment Finance and Urban Renewal Plan updates review – Development Services
Director Deets reviewed proposed urban renewal plan updates and LMI and TIF revenue funds
projected to be generated by those districts.
7) University Avenue Extension Project, SE L.A. Grant Parkway to 10th Street – Public Works
Director/City Engineer Koester briefly reviewed anticipated project phases.
8) Triumph Park construction administration – Parks & Recreation Director Jermier discussed an
additional professional services agreement amendment.
9) FY2022 City Contributions to Non-Profit Organizations – Mayor Clarke recommended certain
changes to the submittal and review process. Following some discussion, City staff was directed
to implement the discussed changes for future council consideration.
10) YMCA – City Administrator Moerman stated that City legal counsel was drafting a funding
agreement.
