Developer’s Agreement [Temple Holding, LP]
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: The original Developer’s Agreement was recorded in the
Dallas County Recorder’s office on June 3, 2019. According to paragraph 2 of the original agreement,
Temple Holding, LP (referred to as “Temple” in the remainder of this synopsis) is required to
construct a portion of NW Douglas Parkway and a portion of the 12” water main along NW Douglas
Parkway. The City is preparing to begin the bid letting process for the City’s portion of the NW
Douglas Parkway prior to Temple undertaking the construction of their portion of NW Douglas
Parkway as required by the agreement. Due to the timing of the City’s project, the Supplemental
Developer’s Agreement is to provide for the mechanisms and procedures to facilitate the completion
and repayment of Temple’s obligation of the original agreement through the undertaking of the work
as part of the City’s project. The City will include the Temple Improvements as part of the competitive
bid process and Temple will pay the City for their portion of the improvements should both parties
mutually agree to complete Temple’s Improvements as part of the City’s NW Douglas Pkwy
Improvements project.

RESOLUTION 2020-
APPROVING SUPPLEMENTAL DEVELOPER’S AGREEMENT
[TEMPLE HOLDINGS, LP]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, On May 20, 2019, the Waukee City Council approved a Developer’s Agreement, Warranty
Deed and Easements with Temple Holdings, LP, related to the construction of the NW Douglas Parkway
Extension Project (Resolution #19-187); AND
WHEREAS, a Supplemental Developer’s Agreement between Temple Holdings, LP, and the City of
Waukee is proposed in order to provide for the mechanisms and procedures to facilitate the completion
and repayment of Temple Holdings, LP, obligations of the original agreement through the undertaking of
certain work as part of the City’s project.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Supplemental Developer’s Agreement [Temple Holdings, LP] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 21st day of
September, 2020.
