HomeMy WebLinkAbout2020-10-05-J01B 09212020_minutesWAUKEE CITY COUNCIL MINUTES September 21, 2020 *Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting in person was impossible or impractical. (A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8. (B) Pledge of Allegiance (temporarily suspended) (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Development Services Director Brad Deets (electronically), Public Works Director/City Engineer Rudy Koester (electronically), Finance Director Linda Burkhart (electronically), Parks & Recreation Director Matt Jermier (electronically), Marketing & Communications Director Summer Evans (electronically), IT Director Son Le (electronically), Human Resources Director Michelle Lindsay (electronically), Fire Chief Clint Robinson (electronically), City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically). (D) Open Forum – Jan Blazanin, 600 NW Little Walnut Creek Dr. (participating electronically), voiced her concerns with the speed limit on N. Warrior Ln., specifically on the gravel portion. She stated that drivers are exceeding the speed limit and driving recklessly, then requested the council consider lowering the speed limit on the gravel portion to 35 mph. At the request of Mayor Clarke, Public Works Director/City Engineer Koester reviewed the process to amend speed limits, including a traffic study requirement. The council directed City staff to proceed with the traffic study. (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Presentations: None (G) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R-4, and R-2/PD-1, a property to be known as Hamilton Ridge – Mayor Clarke opened the public hearing, noting that following publication, but prior to the public hearing, the applicant requested that the R-4 district be removed from the request. She asked if any written correspondence had been received; City Clerk Schuett replied that none was received in the clerk’s office but that correspondence sent to the Development Services Department was included in the meeting packet. Development Services Director Deets reviewed the application, reiterating that the applicant has withdrawn consideration of a portion of R-4 zoning along Ashworth Rd. The proposed PD-1 overlay would allow the development of smaller single family lots. Mr. Deets reviewed a development concept plan submitted by the applicant, which shows that lots further to the west would be smaller. He added that the PD-1 overlay also addressed the scattering of lot sizes planned for the development. Mr. Deets then reviewed existing and future infrastructure in the area, as well as plans for Ashworth Rd. paving and an improved Ashworth Rd./Ute Ave. intersection. The Development Services Department received a significant amount of correspondence objecting to the rezoning. As the number of objections received by City staff represents 20% or more of the property located within the notification area, the proposed ordinance requires a 4/5 affirmative vote of council for approval. At the J1B 2 Planning & Zoning Commission meeting, there was much discussion regarding the now- withdrawn R-4 zoning district, the extension of Silverleaf Ln., environmental impacts, grading and drainage. Erin Ollendike with Civil Design Advantage (participating electronically), representing Landmark Development, introduced herself if there were any questions. Mayor Clarke asked for public comment: 1) Cody Kilgore, 32059 Ute Pl. (participating electronically), thanked those council members who looked further into the issue. He stated that while he preferred the land remain undeveloped, he would rather a far less dense R-1 district be approved with a wide buffer area for natural habitat in the creek bottom. He added that this matter has spotlighted the rezoning process and asked the council to consider ways to encourage greater neighbor approval when such requests are submitted. 2) John Dvorak, 635 Silverleaf Ln. (participating electronically), voiced his appreciation to the council for listening to neighbor concerns. He stated that he selected his home due to executive lot sizes and a rural feel, adding that he was trying to avoid living in a higher density area. He expressed his disappointment that any parks planned in the area were not nearby. He noted that he had send a letter earlier to the council outlining his concerns, adding that he believed there would be less objections from neighbors if R-1 zoning was proposed. He said that he worried that approving the rezoning would give the developer the ability to modify the concept plan. Mayor Clarke reviewed the various steps in the rezoning and platting process, stating that there were many opportunities for council input along the way. She emphasized that the action before the council at the moment was for rezoning, which is a separate matter from platting. Mr. Deets noted that the concept plan presented tonight would go into greater detail during the platting process, adding that the preliminary plat needs to be consistent with the concept plan but that there may be some adjustments. Mayor Clarke encouraged the neighbors to continue communicating with the City during the full development process. 3) Jennifer Miller, 32059 Ute Pl. (participating electronically), stated that she was encouraged by the involvement and mobilization of the neighbors on this matter. She noted that there is a hog confinement facility in the area, voicing her belief that is it ill-conceived of the City to allow for development so near an existing facility. She wanted her concerns on record in case future litigation should arise due to the location of development near a hog confinement and the health hazards with living near such a facility. 4) Taylor Lamb, 30601 Ashworth Rd. (participating electronically), stated that when she purchased her home, she knew there would be future development in the area but she voiced her objection to both the R-4 and R-2 zoning districts. She noted that a significant part of the applicant’s justification for the proposal was that it was in alignment with the City’s comprehensive development plan but that there were many aspects of the proposal that did not comply with that City plan, especially related to open and green spaces. She concluded that Waukee falls below the national average for parks and natural spaces and that the developer seemed to be trying very hard to convince the community that the proposal fits the needs of the area. 5) Kimberly Pierson, 32047 Ute Ave. (participating electronically), echoed much of what others had already said, adding that she supported preserving the land as much as possible. She noted that she is proud to live in Waukee and that maintaining the community and not stacking it with homes keeps it a great place to live. 6) Mike Lang, 3100 Caterine Ct. (participating electronically), noted that his home is currently under construction. He expressed his concern with R-2 zoning when so many lots would be developed like R-1 zoning, suggesting that the property be rezoning for the type of housing it represents so there are no future surprises. He asked the council to turn down the matter as proposed. [After the public hearing was closed, two additional comments on the matter were posted in the Zoom Q&A function: 7) Brita Hansen (no address given), stated that she would love to preserve the land and keep Silverleaf Ln. as a slow road. 8) Jordan McCann (no address given), stated there were many people against the rezoning and that a year of delay (in reference to a comment by City Attorney Brick regarding the City’s rezoning ordinance regulations) seemed like plenty of time to put together a good and reasonable plan.] 2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-4 and R-2/PD-1, a property to be known as 3 Prairie Rose – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the application, adding that the property includes the area for the future extension of Douglas Pkwy. The applicant has provided a development concept plan for the subject property, as well as property to the west. In the future, Douglas Pkwy./N. Warrior Ln. will be a major intersection. No comments were made by the public in attendance. 3) On plans, specifications, form of contract and estimate of cost [Warrior Lane Joint Utility Trench Project] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director/City Engineer Koester presented on the project, planned construction schedule and total construction costs. No comments were made by the public in attendance. (H) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2 and R- 2/PD-1, a property to be known as Hamilton Ridge [introduction; first reading]– Council Member Sinclair introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Crone. Mayor Clarke reiterated that the zoning request was under consideration, not platting. Council Member Sinclair asked why the entire parcel was not proposed as R-1 zoning, wondering if it was due to site or market factors. Erin Ollendike with Civil Design Advantage (participating electronically), representing Landmark Development, referenced a map showing the full property purchase by the developer. She noted that 16 acres would remain undeveloped, with most of that given to the City as parkland. By not developing those acres, higher density is needed in the developable area. She added that the larger lots were planned along Silverleaf Ln. Mayor Clarke stated that she was thrilled to see that such a large portion would remain undeveloped, then asked about buffering between houses and plans for Silverleaf Ln. Ms. Ollendike clarified that the developer wanted to save as many trees as possible and that there would be no grading in the flood plain other than what was needed for utility access. Regarding a Silverleaf Ln. extension, it was always discussed with City staff that the street was planned as a connection to Ashworth Rd. Development Services Director Deets noted that street connectivity is an important consideration in planning, adding that there were some staff concerns in the long term related to emergency access to the area, otherwise. Mr. Deets reviewed the concept for the Silverleaf Ln. extension, noting that the developer intends to maintain as much of the drainage area as possible. Most new lots on a Silverleaf Ln. extension would abut the drainageway. Ms. Ollendike added that due to the topography, the developer was limited in how streets can connect to Ashworth Rd. Council Member Bottenberg noted that he shared concerns regarding the topography, saying it would be nice to keep as much undisturbed as possible. He also expressed concerns with plans to extend Silverleaf Ln., believing that drivers would use that street as a cut-through as soon as a traffic signal is installed at Ashworth Rd./Ute Ave. While the platting is a separate issue, he stated that he would like to see a different alignment. In response to neighborhood concerns with possible changes of plans for development following rezoning, Council Member Bottenberg stated that the council keeps very true to what is presented in a concept plan, but that he was personally willing to hold the developer to that plan. Council Member Lyon stated that the neighbors brought up some legitimate concerns that he hoped could be addressed at this time. Mayor Clarke asked Council Member Lyon if he was amenable to possibly separating R-2 and R-1 zoning districts; Council Member Lyon replied that he would be amenable to all the subject property zoned as R-1. Council Member Crone agreed with Council Member Lyon in the preference of the entire area as R-1 zoning, adding that she was glad that the R-4 portion was removed. Mayor Clarke cited an email from a neighbor with concerns that there was no environmental review process. She clarified that there is such a process, which Public Works Director/City Engineer Koester briefly reviewed. Mayor Clarke asked about the location of the hog confinement and about requirements for the 4 distancing of development from that facility; Mr. Deets pointed out the hog confinement location on the map, noting that at the time of its permitting by the state, a minimum distance of 1,875 feet was required from nearby development. Any future expansions to the hog confinement would have to maintain that same distance. City Attorney Brick reminded the council of the City ordinance which would prohibit any other rezoning applications for this property for one year if the current proposal is denied. Mayor Clarke recommended tabling consideration of the matter to give the council more time for review. Council Member Bergman stated that she agreed with Council Members Lyon and Crone, noting that she had reviewed the site and information provided and that due to the topography and neighborhood concerns, she could not support R-2 zoning. She added that the matter could be tabled, but that her opinion would not change. Council Member Sinclair amended the motion to table the matter until the Oct. 5 regular meeting; Council Member Lyon amended the second. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion to table carried 5 – 0. 2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-4 and R- 2/PD-1, a property to be known as Prairie Rose [introduction; first reading] – Council Member Crone introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Sinclair. Council Member Sinclair asked for clarification on where the large pond would drain; Development Services Director Deets reviewed the drainage. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. 3) Warrior Lane Joint Utility Trench Project A. Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost – Council Member Lyon moved to approve the resolution; seconded by Council Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-344) B. Resolution: Consideration of approval of a resolution awarding contract – Council Member Crone moved to approve the resolution; seconded by Council Member Sinclair. Public Works Director/City Engineer Koester reviewed the bid tabulation, noting that the low bid was well under the engineer’s estimate. City staff is familiar with the work of the low bidder and recommends award to TD&I Cable Maintenance, Inc., of Lakeland, MN. Council Member Crone asked if the bidder understood the scope of the project; Mr. Koester replied in the affirmative. Council Member Lyon asked why the project map showed the conduit jutting out at one point along the line; Mr. Koester replied that the alignment was needed to avoid a possible conflict with the location and construction of future box culverts. In order to work together as elected officials, she requested a discussion at the next work session on how such a proclamation may look in the future. Council Member Lyon noted that it was within the mayor’s powers to enact such a proclamation, adding his believe that Waukee’s elected officials serve the community well and in harmony, even with differing opinions. Council Member Crone also asked for a discussion on the matter at the next work session. (K) Closed Session: Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation – Council Member Crone moved to close the regular session and enter closed session pursuant to Code of Iowa §21.5(1)(c);seconded by Council Member Sinclair.
