The September 17th, 2020 Board of Adjustment meeting was called to order at 5:38 P.M. by Chairman Garcia. Roll Call. The following Board Members were present: Breckenridge (arrives at 5:45pm), Garcia, Bisgard, and Drees. Board member Meyers was absent. City Staff in attendance: Andy Kass, and Kathryn Purvis. Agenda Approval. Board Member Drees made a motion, seconded by Board Member Bisgard, to approve the agenda for September 24th, 2020. Ayes: Garcia, Bisgard, and Drees. Nays: None. Motion carried. Approve the August 20th, 2020 Board of Adjustment Minutes. Board Member Drees made a motion, seconded by Board Member Bisgard, to approve the Board of Adjustment meeting minutes for August 20th, 2020. Ayes: Garcia, Bisgard, and Drees. Nays: None. Motion carried. Application for 820 3rd Street (Lot 93, Corene Acres Plat 2)- Variance from 165.07(4) B of the Waukee Municipal Code to allow a deck larger than 50 square feet to be located in the front yard. Senior City Planner, Andy Kass, introduced the request for a variance as submitted by the applicant and homeowner, Michael Pagel. The Variance, if approved, would allow the construction of a deck approximately 126 square feet in size within the front yard of the property. The subject property is generally located south of Northview Drive and west of 3rd Street. A notice of the proposed variance request was mailed to surrounding property owners within a 310 foot radius and to date no correspondence has been shared with staff for or against the request. Mr. Kass advised that the applicants have stated that there are other properties within the area that have decks larger than the deck being requested, and that the current walkway and front porch are deteriorating. The requested deck would provide security and safety as it includes railings. The updates would benefit the façade of the home which adds to the neighborhood instead of devaluing it. Mr. Kass advised that City Staff does not make recommendations in the case of a variance, but offered a few notes for the Board to keep in mind. The ordinance in question is recently adopted in 2019, meaning any deck prior to that was not affected by the restrictions. Mr. Kass also advised that the applicants could have a rear deck over 50 square feet. Board member Drees questioned the size of the largest deck that had received a variance. Mr. Kass advised that the largest so far was around 180 square feet. Board member Drees questioned on the material of the deck. The applicant, Michael Pagel, advised it is a composite decking material. Board member Drees moved to approve the variance for 820 3rd Street ( Lot 93, Corene Acres Plat 2)- variance from 165.07(4)B of the Waukee Municipal Code to allow a deck larger than 50 square feet to be located in the front yard. The motion was seconded by Board member Bisgard. Ayes: Breckenridge, Garcia, Bisgard, and Drees. Nays: None. Motion carried. New Business Senior City Planner, Andy Kass, advised that, staff is going to review the ordinance regarding front decks, and see if there is a way to increase the maximum allowed size. Adjournment Board member Breckenridge moved to adjourn the meeting. The motion was seconded by board member Bisgard. Ayes: Breckenridge, Garcia, Bisgard, and Drees. Nays: None. Motion carried.
