HomeMy WebLinkAbout2020-11-02-J01W Castle Property Rezoning_Set PH CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 2, 2020 AGENDA ITEM: Consideration of approval of a motion setting December 7, 2020, as the date of public hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from A-1 (Agricultural District) to R-1 (Single Family Residential District) [Castle Property] FORMAT: Consent SYNOPSIS INCLUDING PRO & CON: Castle Productions, LLC, owner of the property, has requested rezoning of approximately 10 acres of property from A-1 Agricultural District to R-1 Single Family Residential District. The property is located at south of Meredith Drive and west of N. Warrior Lane. In order to set a public hearing to discuss a rezoning, the applicant is required to receive written consent from 50% of the surrounding property within a 250 foot radius of the property. Alternatively, the City Council can set a public hearing date on behalf of the applicant. The applicant has indicated that they have been unsuccessful in receiving the 50% consent from surrounding property owners. The applicant has indicated that consent from 36% of property owners within 250-feet have consented to the request. Two sides of the property abut properties not located within the city limits. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the City Council setting the public hearing date for December 7, 2020 to discuss this matter further. Council action to set the public hearing date does not indicate support for the project. Rather, it represents the Council’s willingness to allow the public hearing process to continue. RECOMMENDATION: Approve the motion. ATTACHMENTS: I.
