November 2, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair.
Absent: Council Member Anna Bergman. (Council Member Bergman began participating
electronically at 5:33 p.m.)
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart
(electronically), Development Services Director Brad Deets (electronically), Public Works
Director/City Engineer Rudy Koester (electronically), Parks & Recreation Director Matt Jermier
(electronically), Human Resources Director Michelle Lindsay (electronically), Marketing &
Communications Director Summer Evans (electronically), IT Director Son Le (electronically),
City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically).
(D) Open Forum – Juli Jarecki, 540 NE Bowman Dr., stated that she received notice from the City
that two pot-bellied pigs she keeps violate the City ordinance. She noted that they are
registered as emotional support animals, she is a veteran, and the animals are clean. Code
Compliance Officer Paul Carpenter told her that she would need to reach out to the council
about the matter. (Council Member Bergman began participating electronically at 5:33 p.m.)
Council Member Lyon asked if the City informed her that she was in violation of City code; Ms.
Jarecki replied that she was asked by the City to provide the animals’ registration as emotional
support animals in response to a complaint from a neighbor. She was told by the City that
porcine animals are not allowed via ordinance. Development Services Director Deets confirmed
that the City ordinance does not allow pigs in residential zoning. City Attorney Brick noted that
the council could either enforce the ordinance as written or modify the ordinance to allow the
animals. Council Member Crone asked about their registration as emotional support animals;
Mr. Brick replied that federal law does not protect emotional support animals like it protects
service animals. After a brief discussion, the council agreed to discuss the matter at a future
work session.
(E) Agenda Approval – Council Member Sinclair moved to approve the agenda; seconded by
Council Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 – 0.
(F) Monthly Mayor’s Report – Mayor Clarke encouraged all to vote on Election Day, informed
residents about upcoming gas survey calls, and noted the success of the recent National
Prescription Drug Take-Back Day.
(G) Presentations: None
(H) Public Hearings:
1) On a proposed Amendment No. 10 to Waukee Unified Urban Renewal Plan – Mayor
Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
briefly reviewed the proposed amendment, noting that a large portion of the plan area would
expire next year and this may be the final amendment for the plan. A consultation hearing
was held on October 12 with no one attending. No comments were made by the public in
attendance.

2) On a proposed Amendment No. 4 to the Waukee Consolidated Urban Renewal Plan –
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
briefly reviewed the proposed amendment, including the addition and removal of certain
properties. Some of the properties being removed will be incorporated into a new plan area.
A consultation hearing was held on October 12 with no one attending. No comments were
made by the public in attendance.
3) On plans, specifications, form of contract and estimate of cost [SE Laurel Street
Extension at Alice’s Road Project] – Mayor Clarke opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied in the negative.
Public Works Director/City Engineer Koester reviewed the project, which includes roadway
paving and the extension of utilities. The City is partnering with the developer of the Waukee
Towne Center project to help with access to the development. The project is anticipated to
be completed in late spring 2021. No comments were made by the public in attendance.
4) On the vacation of temporary easements [Lot 2 of Cove at Kettlestone Plat 2] – Mayor
Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed the proposed easement vacation, stating that the easements do not include a
termination date as is typical. The buyer of the Elite Eye Care site requested that the
easements be formally vacated. No comments were made by the public in attendance.
5) On proposals for the purchase and removal of structures owned by the City of
Waukee [5 Bel Aire Drive, 10 Bel Aire Drive, 10 Northview Drive, 905 Ashworth Drive] –
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed a map of the structure locations and stated that no bids were received. The City
may be able to enter into a contract with an interested party for structure removal, with a
separate contract for filling in foundations and capping utilities. No comments were made by
the public in attendance.
(I) Public Hearing Action Items:
1) Amendment No. 10 to the Waukee Unified Urban Renewal Plan
A. Resolution: Consideration of approval of a resolution determining an area of the
City to be an economic development and blighted area, and that the rehabilitation,
conservation, redevelopment, development or a combination thereof, of such area
is necessary in the interest of the public health, safety or welfare of the residents
of the City; designating such area as appropriate for urban renewal projects; and
adopting the Amendment No. 10 to the Waukee Unified Urban Renewal Plan –
Council Member Sinclair moved to approve the resolution; seconded by Council Member
Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0. (Resolution #2020-406)
B. Ordinance: Consideration of approval of an ordinance for the division of revenues
under Section 403.19, Code of Iowa, for Amendment No. 10 to the Waukee Unified
Urban Renewal Plan [introduction; first reading]– Council Member Crone introduced
the ordinance and moved to approve the first reading in title only; seconded by Council
Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 – 0.
2) Amendment No. 4 to the Waukee Consolidated Urban Renewal Plan

B. Ordinance: Consideration of approval of an ordinance for the division of revenues
under Section 403.19, Code of Iowa, for the Waukee Consolidated Urban Renewal
Plan (2020 Ordinance Parcels) [introduction; first reading]– Council Member Crone
introduced the ordinance and moved to approve the first reading in title only; seconded
by Council Member Lyon. Development Services Director Deets explained that only
parcels with increased valuation from the prior year have been added to the plan. He
noted that the 20-year “clock” starts on those parcels once they are added to the
ordinance. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 – 0.
3) SE Laurel Street Extension at Alice’s Road Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Lyon moved
to approve the resolution; seconded by Council Member Crone. Results of vote: Ayes:
Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Sinclair moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester reviewed the bid tabulation and
recommended award to Corell Contractor of West Des Moines, IA. Corell Contractor is
under contract with the Waukee Towne Center developer for the construction of the
remainder of the SE Laurel St. extension. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-409)
4) Resolution: Consideration of approval of a resolution approving the vacation of
temporary easements [Lot 2 of Cove at Kettlestone Plat 2]– Council Member Crone
moved to approve the resolution; seconded by Council Member Sinclair. Results of vote:
Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

reviewed the agreement, noting that if approved there will be a future secondary action to

5) Resolution: Consideration of approval of a resolution approving FY2021 transfers –
Council Member Lyon moved to approve the resolution; seconded by Council Member
Sinclair. Finance Director Burkhart noted that at the October 20 council meeting, action was
tabled on issuance of a golf course revenue refunding note due to errors found in the note
documentation. Following subsequent discussions with bond counsel, City staff recommend
applying the additional funds as part of the General Obligation Local Options Sales Tax
Bond, Series 2020B, to pay off the golf course debt instead of issuing the refunding note.
The proposed resolution transfers the appropriate local option sales tax funds to the golf
course fund. Council Member Bottenberg stated that he would abstain from voting due to a
professional conflict of interest. Results of vote: Ayes: Bergman, Crone, Lyon, Sinclair.
Nays: None. Absentions: Bottenberg. Motion carried 4 – 0 – 1. (Resolution #2020-427)

*Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and
21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting
in person was impossible or impractical.
A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke
at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the
electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna
Bergman (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair. Absent: Council
Member R. Charles Bottenberg.

support, briefly reviewed the YMCA mission, and noted the need for scholarship funding. Results

E. Work Session:
1) Silverleaf Lane and Hamilton Ridge street alignments – Development Services Director Deets
presented three options for discussion: 1) Silverleaf Ln. extended from its current terminus to
Ashworth Rd.; 2) Silverleaf Ln. extended as a cul-de-sac with no Ashworth Rd. outlet; and 3) a
new cul-de-sac off Ashworth Rd. with no connection to Willow Pines. Mr. Deets reviewed the
positives and negatives to all three options. There was much discussion regarding fire code
provisions for sprinkler systems in new homes if Silverleaf Ln. is not extended to Ashworth Rd., as
well as general concerns with fire code compliance. The council agreed to discuss the matter
further at the Nov. 16 regular meeting.
2) FY2022 City Contributions to Non-Profit Organizations – City Administrator Moerman reviewed
the approval schedule.
3) FY2020-2021 Strategic Plan: Economic development strategy – City Administrator Moerman
discussed the next steps suggested for building an economic development team.
4) FY2020-2021 Strategic Plan: Affordable housing – Development Services Director Deets noted
recent discussions between City staff and certain developers about the possible acquisition by the
City of property for affordable housing development.
5) Emerald Ash Borer Management Plan Update – Parks & Recreation Director Jermier reviewed
the current plan and discussed the current City-owned tree stock and quality, procedures related to
trees in the public right-of-way, and response regarding privately-owned trees that may present a
hazard.
6) Animal control agreement – Police Lt. Scott Cunningham joined the meeting and presented on
animal-related calls for service and current response procedures. The Police Department

recommends entering into a contract with a vendor for certain animal control and kenneling
services.
7) Building and fire code ordinance updates – Building Official Rash and Fire Marshal Frederick
briefly reviewed some of the proposed building and fire code ordinance updates, as well as the
ordinance adoption schedule.
8) Stormwater ordinance updates – Public Works Director/City Engineer Koester reviewed recent
stormwater initiatives and discussed updates to the standard specifications and post construction
stormwater management ordinance.
9) Agenda Management Module demonstration – IT Director Le demonstrated the general process
with the new module.
10) Central Iowa Water Trails Initiative update – City Administrator Moerman discussed the next
steps with the Initiative group.
11) Rezoning notification process – Development Services Director Deets reviewed the process
and recommended a change to the number of days for mailing of notices to surrounding property
owners.
