AGENDA ITEM: Consideration of approval of a resolution approving structure removal and
transfer agreement [5 Bel Aire Drive, 10 Bel Aire Drive, 10 Northview Drive,
905 Ashworth Drive]
FORMAT: Motion
SYNOPSIS INCLUDING PRO & CON: The City accepted public bids and held a public hearing
for several structures that need to be removed for the reconstruction of the 5
way intersection as well as structures that need to be removed for a future
improvement along Ashworth Drive. Unfortunately, no bids were received
for the removal of the various structures.
Following the public hearing, the City was approached by Bear Construction
Services, LLC about acquiring and removing the house/garage at 10 Bel Aire,
the house/garage at 5 Bel Aire, the house at 10 Northview and a garage/shed
at 905 Ashworth Drive. Staff has worked with the City Attorney in preparing
an agreement whereby Bear Construction Services will remove the houses and
structures by December 31, 2020. The City will then be responsible for
abandonment of the utilities to serve these lots as well as the removal of and
the filling in of the foundations.
This will represent a significant savings to the City as the City will not have to
pay for the demolition and dumping fees associated with the structures.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: Staff believes the proposed agreement is a better alternative
to the City demolishing the structures and will result in significant savings to
the City.
RECOMMENDATION: Approve the resolution

RESOLUTION 2020-
APPROVING THE STRUCTURE REMOVAL AND TRANSFER AGREEMENT [5 BEL
AIRE DRIVE, 10 BEL AIRE DRIVE, 10 NORTHVIEW DRIVE, 905 ASHWORTH
DRIVE]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City owns several properties which were acquired for the purpose of
accommodating certain public improvement projects which include street widening; intersection
reconfiguration/modification; utility relocation/improvement; drainage infrastructure; and
grading improvements; AND,
WHEREAS, the properties have situated and affixed on them certain structures including
residential homes, garages and sheds which must be removed to accommodate the public
improvement projects; AND
WHEREAS, the City, as part of the projects, will incur the costs of demolition, removal and
disposal at the City’s designated landfill; AND
WHEREAS, the City desires to reduce the cost of the projects, reduce the disposal of the waste
associated with the demolition and the environmental impacts associated with such disposal
while mitigating to the extent possible the amount of material resulting from the demolition;
AND
WHEREAS, the City had previously undertaken efforts to mitigate the impacts by offering the
structures for removal to the highest bidder and published notice and developed a process for the
receipt and consideration of bids, however no bids were received; AND
WHEREAS, Bear Construction has expressed an interest in removing the structures from the
Properties, and preserving the structures on other property of its choosing, at its sole cost and
expense; AND
WHEREAS, the City and Bear Construction have reached an agreement for the removal of the
structures as referenced within the agreement.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 20th day of November, 2020 that the Structure Removal and Transfer Agreement related to 5
Bel Aire Drive, 10 Bel Aire Drive, 10 Northview Drive and 905 Ashworth Drive by approved.
