(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W.
Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Council Members Anna Bergman (via
telephone), R. Charles Bottenberg, Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent:
Mayor William F. Peard.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public
Works Director/City Engineer Rudy Koester, Development Services Director Brad Deets,
Community and Economic Development Director Dan Dutcher, Marketing and Communications
Director Summer Evans, Parks and Recreation Director Matt Jermier, Police Chief John Quinn,
City Clerk Rebecca D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Clarke. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays:
None. Motion carried 5 – 0.
(F) Mayor’s Report – None.
(G) Presentations:
1) Introduction of Chief of Westcom Darin Riney by Clive City Manager Matt McQuillen –
City Manager McQuillen introduced Chief Riney to the council.
(H) Public Hearings:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-4 and PD-1, a property to be known as The
Commons at Greenway Park – Mayor Pro Tem Bottenberg opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets reviewed the rezoning application, noting
the extention of Venture Dr. to access the development. The roads within the development
will be privately maintained. The townhome development will include one-, two- and three-
bedroom units, with a mixture of units for sale and for rent. Plans include attached and
detached garages, while some units will have no garages. Parkland dedication includes a
recreational trail connection with the greater trailway system. The planned development
overlay would allow for shallower building setbacks and one-bedroom units with a smaller
square footage than required. In exchange, the developer will use no vinyl siding on exterior
elevations. Council Member Clarke asked about the number of units without garages; Laith
Herrboldt with Signature Companies replied that he did not have an exact number, but noted
that all “for sale” units would have garages. He then briefly discussed some development
amenities and stated that a homeowners association would be established to handle any
issues. Council Member Hughes asked if covenants would apply to both owner- and renter-
occupied units; Mr. Herrboldt replied in the affirmative. Council Member Clarke wondered if
there was a market for units without garages; Mr. Herrboldt explained that his company was
attempting to include more affordable housing options within the development, adding that
people interested in the smaller units might not see a need for a garage. Council Member
Lyon asked if there was a similar development in the Des Moines area; Mr. Herrboldt replied
that he did not believe so. Council Member Lyon expressed concern over the lack of
garages for all units and asked if the Planning and Zoning Commission shared that concern;
Mr. Deets answered that the commissioners did not express any specific concerns with the
number of garages. Council Member Lyon asked for the percentage of units without
garages; Joel Jackson with Bishop Engineering replied that approximately 20% of the units

would have no garage. Council Member Bergman cited studies that people looking for
affordable housing options are driving less, so she has no concern with the number of
garages proposed. No comments were made by the public in attendance.
2) On plans, specifications, form of contract, and estimate of cost [Westown Meadows
Park Improvement Project] – Mayor Pro Tem Bottenberg opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Parks and Recreation Director Jermier briefly reviewed the project, stating that
construction was scheduled to be complete in October 2019. No comments were made by
the public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-4 and PD-
1, a property to be known as The Commons at Greenway Park [introduction; first
reading] – Council Member Hughes introduced the ordinance and moved to approve the
first reading in title only; seconded by Council Member Clarke. Results of vote: Ayes:
Bergman, Bottenberg, Clarke, Hughes. Nays: Lyon. Motion carried 4 – 1.
2) Westown Meadows Park Improvement Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract, and estimate of cost – Council Member Hughes
moved to approve the resolution; seconded by Council Member Clarke. Results of vote:
Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Hughes.
Parks and Recreation Director Jermier requested that the award be deferred to the 04/01
regular council meeting, explaining that while the bids received were favorable, staff
needed additional time to review possible project alternates. Council Member Lyon
amended the motion to defer awarding contract to the 04/01 regular council meeting;
Council Member Hughes amended the second. Results of vote: Ayes: Bergman,
Bottenberg, Clarke, Hughes, Lyon. Nays: None. Motion to defer carried 5 – 0.
(J) Action Items:
1) Consent Agenda: Council Member Lyon moved to approve the Consent Agenda; seconded
by Council Member Hughes. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Hughes,

Municipal Code, by repealing the existing rates for water and enacting new rates as
specified [introduction; first reading] – Council Member Lyon introduced the ordinance
and moved to approve the first reading in title only; seconded by Council Member Clarke.
Public Works Director/City Engineer Koester reviewed all three rate ordinances, noting
increases to water and sewer rates, but a decrease in solid waste rates, equating to an
overall $2.35/month utility bill increase. Council Member Lyon asked how many homes in
Waukee have an irrigation meter; Mr. Koester replied that he would look into the matter.
Results of vote: Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays: None. Motion
carried 5 – 0.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 204, Waukee
Municipal Code, by repealing the existing rates for sewer and enacting new rates as

5) Ordinance: Consideration of approval of an ordinance to amend Chapter 210, Waukee
Municipal Code, by repealing the current chapter and enacting in lieu thereof
provisions for the regulating and licensing of peddlers and solicitors [second, third
(final) readings] – Council Member Lyon moved to approve the second reading of the
ordinance in title only, waive the third reading, and place the ordinance on final passage;
seconded by Council Member Clarke. City Clerk Schuett requested that the third reading be
waived so that the ordinance would be in effect as of 04/01. Council Member Bergman
asked if political canvassing would require a permit; Ms. Schuett replied in the negative.

6) Resolution: Consideration of approval of a resolution approving revised preliminary

briefly reviewed the plat revisions, which include reconfigured lot lines and relocated utilities.

7) Resolution: Consideration of approval of a resolution approving revised construction

8) Resolution: Consideration of approval of a resolution approving preliminary plat for
The Landing at Kettlestone – Council Member Lyon moved to approve the resolution;
seconded by Council Member Hughes. Development Services Director Deets reviewed the
plat, noting the combination of townhome and multi-family development, as well as single
family lots with a smaller area than traditional R-2 zoning. There have been many
stormwater management issues in the area, especially along existing properties to the south.
The applicant and City staff have developed a plan to address and improve area stormwater
flow. Mr. Deets noted that the plans would not resolve all issues in the area, as parcels to
the east must be developed in order to fully address stormwater issues. Council Member
Lyon stated that all his questions regarding stormwater issues in the area were answered
during the presentation. Council Member Hughes asked if the area covenants would
address issues like street parking and trash receptacle screening; Mr. Deets replied that
covenants are not submitted for review until the final platting process. Council Member
Clarke commended all who worked to alleviate stormwater issues in the area. Results of
vote: Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays: None. Motion carried 5 – 0.

9) Resolution: Consideration of approval of a resolution approving preliminary plat for
James Pointe – Council Member Hughes moved to approve the resolution; seconded by
Council Member Lyon. Development Services Director Deets reviewed the plat, including a
street connection off Hickman Rd. and recreational trail connections. A regional pond is
planned to serve the commercial and multi-family lots in the development. Results of vote:
Ayes: Bergman, Bottenberg, Clarke, Hughes, Lyon. Nays: None. Motion carried 5 – 0.

10) Resolution: Consideration of approval of a resolution approving site plan for Aldi
[1030 E Hickman Road] – Council Member Lyon moved to approve the resolution;
seconded by Council Member Hughes. Development Services Director Deets reviewed the
site plan and elevations. He noted ingress/egress locations and plans for underground
stormwater detention. Council Member Bottenberg noted that the site has the minimum
amount of open space; Mr. Deets replied that open space for the overall development is also
considered, but agreed that the Aldi site has limited opportunities for future building
expansion. Council Member Clarke asked about long-term plans for traffic flow in the area;

Mr. Deets reviewed current flow and future street extensions to the south. Council Member
Lyon asked about the impact of the future widening of Hickman Rd. by the Iowa Department
of Transportation (IDOT); Mr. Deets answered that Hickman Rd. would be widened to both
the north and south, but that the IDOT’s priority for the project was nearest the interstate.

WORK SESSION MEETING
March 18, 2019
A. Call to Order – The work session meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 6:46 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Council Members Anna Bergman (via telephone), R.
Charles Bottenberg, Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent: Mayor William F. Peard.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public Works
Director/City Engineer Rudy Koester, Development Services Director Brad Deets, Community and
Economic Development Director Dan Dutcher, Marketing and Communications Director Summer
Evans, Parks and Recreation Director Matt Jermier, Police Chief John Quinn, City Clerk Rebecca D.
Schuett.

D. Work Session:
1) Transportation services – Brooke Ramsey with HIRTA reviewed recent changes with the
organization’s transportation services and planned improvements to the ride scheduling system.
2) Massage therapy business licensing – Police Chief Quinn reviewed the proposed ordinance.
3) Waukee Municipal Code recodification – Development Services Director Deets highlighted some
proposed revisions to the zoning code, including short-term rentals, private street development
standards, residential elevations standards and mini-storage elevation standards. There was much
discussion on whether to address short-term rentals in the ordinance. The council agreed to
discuss the matter further at the April work session meeting.
4) City Hall Renovation Project update – Development Services Director Deets reviewed project
staging and the construction schedule.
5) Procedure for cancellation of council meetings – City Administrator Moerman asked that the
discussion be postponed due to the mayor’s absence.
