AGENDA ITEM:Consideration approval of a resolution ratifying, confirming, and
approving the change in date for public hearing on plans, specifications,
form of contract and estimate of cost [Transite Water Main Replacement
Phase 1 Project]

SYNOPSIS INCLUDING PRO & CON: Due to the rescheduling of the 07/01/2019 City
Council regular meeting to 07/08/2019, bond counsel recommends a
resolution ratifying the change of public hearing date for the Transite
Water Main Replacement Phase 1 Project.

STAFF REVIEW AND COMMENT: Bond counsel has provided a resolution ratifying the
revisions related to the hearing date.
RECOMMENDATION: Approve the resolution.

RESOLUTION RATIFYING, CONFIRMING, AND APPROVING THE
CHANGE IN DATE FOR PUBLIC HEARING ON PLANS, SPECIFICATIONS,
FORM OF CONTRACT AND ESTIMATE OF COSTS FOR THE TRANSITE
WATER MAIN REPLACEMENT - PHASE 1
WHEREAS, on June 3, 2019, the Council adopted a Resolution ordering construction of
the Transite Water Main Replacement - Phase 1; and
WHEREAS, pursuant to said Resolution, the City Clerk was directed to publish notice of
public hearing not less than four clear days nor more than twenty days prior to July 1, 2019, the
date fixed as the date for a public hearing on the plans, specifications, form of contract and estimate
of costs for the project; and
WHEREAS, due to the lack of a quorum for the July 1 Council meeting, the meeting was
rescheduled to July 8, 2019.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, IOWA:
Section 1. That the actions of the Clerk in changing the time and date for the public hearing
on the plans, specifications, form of contract and estimate of costs to July 8, 2019 is hereby ratified,
confirmed, and approved.
Section 2. That the actions of the City Clerk in publishing a revised Notice of Public
Hearing in a legal newspaper, printed wholly in the English language, published at least once
weekly and having general circulation in this City, not less than four clear days nor more than
twenty days prior to the date hereinafter fixed as the date for a public hearing on the plans,
specifications, form of contract and estimate of costs for the project, the hearing to be held at 5:30
P.M. on July 8, 2019, is hereby ratified, affirmed, and confirmed.
Section 3. That the actions of the City Clerk in posting a revised notice to bidders once in
a relevant contractor plan room service with statewide circulation and a relevant construction lead
generating service with statewide circulation and on an internet site sponsored by either the City
or a statewide association that represents the City, with the revised date for a public hearing on the
plans, specifications, form of contract and estimate of costs for the project, the hearing to be held
at 5:30 P.M. on July 8, 2019, is hereby ratified, affirmed, and confirmed.
