AGENDA ITEM: Consideration of approval of a resolution approving a Public Sidewalk
Easement [Lot 2 of Westgate Business Park Plat 3]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: During construction of the Pro-Line Building located at
the southwest corner of SE Alice’s Road and SE Frontier Avenue, the
sidewalk along SE Frontier Avenue was inadvertently constructed outside of
the right of way. In order to avoid removing and reconstructing the sidewalk,
the owner has agreed to a public sidewalk easement.

RESOLUTION 19-
APPROVING PUBLIC SIDEWALK EASEMENT ON LOT 2 OF WESTGATE
BUSINESS PARK PLAT 3 [PRO-LINE DEVELOPMENT, L.L.C.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on October 15, 2007, the Waukee City Council approved a final plat for Westgate
Business Park Plat 3 (Resolution #07-219); AND,
WHEREAS, it is necessary to acquire a sidewalk easement across Lot 2 of Westgate Business
Park Plat 3.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
8th day of July 2019, that it hereby approves the public sidewalk easement in Westgate Business
Park Plat 3.
