AGENDA ITEM: Consideration of approval of an ordinance to amend Chapter 401, Property
Maintenance, by amending grass and weed provisions [introduction; first
reading]
FORMAT: Ordinance
SYNOPSIS INCLUDING PRO & CON: At the December 9, 2019 City Council Work Session, the
current ordinance related to property maintenance of grass and weeds was
discussed. The Council directed staff to revise the current ordinance to
prohibit grass and weeds on developed properties taller than eight inches and
on undeveloped properties to be no greater than ten inches. The proposed
ordinance also removes the wording “on the average” which is included in the
current ordinance.

ORDINANCE NO.
AN ORDINANCE TO AMEND CHAPTER 401, PROPERTY MAINTENANCE, BY
REMOVING AND REPLACING SECTION 401.4B(1) RELATED TO MAINTENANCE
OF PREMISES
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1. Chapter 401 Property Maintenance, is hereby amended by removing and
replacing Section 401.4B(1) with the following:
1. Grass, weeds or brush allowed to grow to a height greater than eight (8) inches on
developed properties and ten (10) inches on undeveloped properties, or any accumulation of dead
weeds or grass that are exposed to public view, on any non-farm property which is not within the
jurisdiction of the County Weed Commissioner. This provision shall not apply to prairies,
wetlands, or similar areas of naturalized perennial vegetation which are certified by an
Enforcement Officer to not constitute a nuisance.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law.
