February 5, 2018
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Peard
at 5:34 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor William F. Peard; Council Members R.
Charles Bottenberg, Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent: Council Member Anna
Bergman. (Council Member Hughes left at 6:08 p.m.)
Also present: City Administrator Tim Moerman, Finance Director Linda Burkhart, Development
Services Director Brad Deets, Public Works Director John Gibson, Community and Economic
Development Director Dan Dutcher, Parks and Recreation Director Matt Jermier, Marketing and
Communications Director Summer Evans, Police Chief John Quinn, City Clerk Rebecca D. Schuett,
City Attorney Steve Brick.
(D) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon. Nays: None. Absent:
Bergman. Motion carried 4 – 0 – 1.
(E) Closed Session:Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in
matters that are presently in litigation or where litigation is imminent where its disclosure
would be likely to prejudice or disadvantage the position of the governmental body in that
litigation – Council Member Hughes moved to close the regular session and enter closed session
pursuant to Iowa Code §21.5(1)(c); seconded by Council Member Clarke. Results of vote: Ayes:
Bottenberg, Clarke, Hughes, Lyon. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1.
Council entered closed session at 5:36 p.m.

Council entered regular session at 6:01 p.m.
(F) Open Forum – Council Member Hughes asked why gas utility bills were so high this month; Public
Works Director Gibson noted that gas use doubled for most users due to cold temperatures.
(G) Mayor’s Report – The Waukee Community School District bond referendum vote, Iowa League of
Cities Legislative Day, and Alice’s Road Corridor Phase 5 public informational meeting are all
scheduled for 02/06. 02/16 is the deadline for submittal of nominations for Waukee 2017 Citizen of
the Year. All City offices are closed 02/19 in observance of Presidents’ Day.
(H) Presentations: None
(I) Public Hearings:
1) On a proposed Amendment No. 1 to the Waukee Central Urban Renewal Plan in the City of
Waukee, State of Iowa – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the proposed amendment, which addresses certain street
improvements as part of the Deery Brothers development. No additional properties or projects
have been added. No comments were made by the public present. (Council Member Hughes
left at 6:08 p.m.)
2) On a proposal to enter into a Development Agreement with Deery, Deery & Deery, LLC and
Fred Rose, L.C. – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the proposed development agreement, which addresses
improvements associated with 10th St. City staff anticipates the need to realign Ashworth Dr. in
the future. No comments were made by the public present.
3) On plans, specifications, form of contract, and estimate of cost [Northwest Area Trunk
Sewer Extension Project Phase 4] – Mayor Peard opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative. Public

Works Director Gibson briefly reviewed the project, which will provide service for the Apple
project. No comments were made by the public present.
4) On plans, specifications, form of contract, and estimate of cost [Northwest Area Water
Main Extension Project Phase 1] – Mayor Peard opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative. Public
Works Director Gibson briefly reviewed the project, which will provide service for the Apple
project. An additional water line is planned for redundancy and City staff are in negotiations on a
third line to connect with Des Moines Water Works. No comments were made by the public
present.
(J) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution determining an area of the City to be
an economic development area, and that the rehabilitation, conservation, redevelopment,
development or a combination thereof, of such area is necessary in the interest of the
public health, safety or welfare of the residents of the City; designating such area as
appropriate for urban renewal projects; and adopting the Amendment No. 1 to the Waukee
Central Urban Renewal Plan – Council Member Lyon moved to approve the resolution;
seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays:
None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-039)
2) Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and among the City of Waukee, Deery, Deery &
Deery, LLC, and Fred Rose, L.C. – Council Member Clarke moved to approve the resolution;
seconded by Council Member Lyon. Council Member Bottenberg asked if the proposed
agreement was consistent with other previously-approved agreements; Development Services
Director Deets replied that the agreement structure was similar. Results of vote: Ayes:
Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2.

3) Northwest Area Trunk Sewer Extension Project Phase 4
A. Resolution: Consideration of approval of a resolution approving plans, specifications,
form of contract, and estimate of cost – Council Member Bottenberg moved to approve
the resolution; seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg,
Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg.
Public Works Director Gibson reviewed the bid tabulation, recommending award to J&K
Contracting of Ames, IA, in the amount of $1,919,226.00. Council Member Lyon amended
the motion to award contract to J&K Contracting of Ames, IA, in the amount of
$1,919,226.00; Council Member Bottenberg amended the second. Council Member Clarke
asked if there were any concerns regarding the bid being so much below the engineer’s
estimate; Mr. Gibson replied in the negative. Results of vote: Ayes: Bottenberg, Clarke,
Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-
042)

A. Resolution: Consideration of approval of a resolution approving plans, specifications,
form of contract, and estimate of cost – Council Member Clarke moved to approve the
resolution; seconded by Council Member Lyon. Results of vote: Ayes: Bottenberg, Clarke,
Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-
043)
B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Bottenberg moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director Gibson reviewed the bid tabulation, recommending award to
Vanderpool Construction of Indianola, IA, in the amount of $691,525.00. Council Member
Bottenberg amended the motion to award contract to Vanderpool Construction of Indianola,
IA, in the amount of $691,525.00; Council Member Lyon amended the second. Results of
vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion
carried 3 – 0 – 2. (Resolution #18-044)

3) Mayor’s Appointment and Resolution:Consideration of approval of a resolution approving
the mayor’s appointment of a citizen member to the Community and Economic
Development Advisory Council for a term to end January 31, 2021 – Mayor Peard appointed
Jill Cameron to the Community and Economic Development Advisory Council. Council Member
Clarke moved to approve the resolution; seconded by Council Member Bottenberg. Results of

4) Ordinance: Consideration of approval of an ordinance to amend Chapter 222 of the
Municipal Code of the City of Waukee, Iowa, by amending Section 222.3 related to the
International Residential Code, Section 222.5 related to the International Building Code,
and Section 222.13 related to the National Electrical Code [introduction; first reading] –
Council Member Bottenberg introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Lyon. Development Services Director Deets briefly
reviewed the proposed amendments, which in specific circumstances will allow the valuation of
building permits to be based on a predetermined minimum valuation. The proposed amendment
to the National Electrical Code (NEC) section is based on that code as adopted by the State of
Iowa. Council Member Lyon asked if the State had adopted the NEC with any unusual changes;
Mr. Deets replied he was not aware of any such changes, noting that the City is mandated by the
State to adopt the same electrical code. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays:
None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2.
5) Resolution: Consideration of approval of a resolution approving site plan for 700
Interstate Parkway – Council Member Lyon moved to approve the resolution; seconded by
Council Member Clarke. Development Services Director Deets briefly reviewed the site plan,
including building elevations. The buildings are proposed as flex space. Council Member Clarke
asked what uses would be permitted in such flex space; Mr. Deets replied that permitted uses
would be the same as allowed in M-1 zoning districts. Council Member Clarke wondered if there
was a demand for this type of space; Council Member Lyon replied that there is a need. Results
of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion

6) Resolution: Consideration of approval of a resolution approving site plan for Craig Dental
Center Addition [15 S. Warrior Lane] – Council Member Clarke moved to approve the
resolution; seconded by Council Member Lyon. Development Services Director Deets reviewed
the site plan, noting that elevations for the addition will be consistent with the existing building.
Council Member Bottenberg noted that there is currently a pothole in the parking lot access; Mr.
Deets agreed to bring it to the attention of the property owner. Results of vote: Ayes: Bottenberg,

7) Resolution: Consideration of approval of a resolution approving preliminary plat for
Stratford Crossing – Council Member Lyon moved to approve the resolution; seconded by
Council Member Bottenberg. Development Services Director Deets briefly reviewed the plat,
which is zoned primarily for single family residential development with smaller areas for higher
density residential and commercial. The existing Raccoon River Valley Trail abuts the subject
property and City staff is working with the developer on access to that trail. Council Member
Clarke asked about price ranges proposed for the single family residential lots; Mr. Deets replied
that he was not certain, but that prices would likely be comparable to those in Spring Crest, which
is being developed by the same property developer. Results of vote: Ayes: Bottenberg, Clarke,

Plat 2 – Council Member Clarke moved to approve the resolution; seconded by Council Member
Lyon. Development Services Director Deets briefly reviewed the plat, noting that the retention
pond would be maintained by a homeowners association. Plat 2 is the last plat that will be
considered by the council prior to the extension and realignment of 10th St. to the north. Council
Member Clarke asked if 10th St. was being extended with expectations of future widening; Mr.

to the west instead of heading directly south; Mr. Deets replied that the alignment was in

10) Resolution: Consideration of approval of a resolution approving Amendment No. 1 to the
Agreement for Professional Consulting Services with Bolton & Menk, Inc. [Sugar Creek
Municipal Golf Course Irrigation Well] – Council Member Bottenberg moved to approve the
resolution; seconded by Council Member Clarke. Parks and Recreation Director Jermier
reviewed the agreement amendment, noting that the cost could be reduced if the U.S. Army
Corps of Engineers and the Iowa Department of Natural Resources determine that only a flood

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Pro Tem
Bottenberg at 5:32 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Council Members Anna Bergman, R. Charles
Bottenberg, Shelly Hughes, Larry R. Lyon. Absent: Mayor William F. Peard, Council Member Courtney
Clarke.

E. Work Session:
1) Gateway, Wayfinding & Community Identity Signage update – Emily Naylor, Nate Hardisty,
and Mike Lansing of Shive-Hattery presented signage design concepts.
2) Fox Creek Park Phase 2 update – Parks and Recreation Director Jermier reviewed proposed
Phase 2 amenities, including a splash pad that is planned to be open in 2019. Brett Douglas with
Genus Landscape Architects presented two possible splash pad systems (recirculating and flow-
thru) and discussed the positives and negatives of both systems. The council favored the
recirculating system.
3) In-city hunting regulations – Development Services Director Deets reviewed the current
regulations related to in-city hunting, then proposed the establishment of an urban reserve hunting
boundary which would be evaluated annually.
4) Capital Improvement Program for Fiscal Years 2019-2023 – City Administrator Moerman and
Finance Director Burkhart discussed revisions to the Capital Improvement Program. The council
also briefly discussed proposed FY2019 budget contributions to non-profit entities.
5) Youth sports complex update – Parks and Recreation Director Jermier briefly reviewed the
timeline for development of the complex and discussed Waukee Betterment Foundation
fundraising for the all-inclusive ballfield, playground, and fishing pier.
6) Urban renewal plan amendments – Development Services Director Deets reviewed proposed
amendments to the Waukee West and Waukee Unified urban renewal plans.
7) IT update – IT Director Le updated the council on the firewall, network refresh, and other projects.
8) ADA compliance program transition plan and sidewalk program – Assistant Public Works
Director of Engineer Koester discussed the need for an ADA compliance program transition plan
and the steps the City must follow for compliance.
9) Xenia Rural Water connection – Public Works Director Gibson reviewed current connections and
water capacity needs, recommending construction of an additional pump station near Hickman
Rd./T Ave.
10) Retail marketing campaign review – Marketing and Communications Director Evans presented
marketing goals and initiatives.
11) Marketing and Communications Specialist position – Marketing and Communications Director
Evans reviewed the proposed job description for the position.

12) Comprehensive Plan update – Development Services Director Deets discussed the current
status of the comprehensive plan and the next steps.
13) Solar energy use – Development Services Director Deets reminded the council of a Fridley
Theatres request to install a solar panel accessory structure along the southern property line,
adjacent to NE Venture Dr. City staff continues to have concerns regarding size, location,
aesthetics, impact on neighboring properties, and precedent. City Administrator Moerman added
that the City has already agreed to substantial development incentives with Fridley Theatres and
the amount of power to be gained from the solar panel accessory structure is negligible. Council
Member Lyon stated that he could support a certain style of structure as long as architectural
elements are incorporated. Council Member Bergman echoed City staff concerns regarding
potential impact on neighboring properties. Russ Vannorsdel with Fridley Theatres addressed the
council, stated that his company wants to be a good neighbor and also wants an attractive
structure. He agreed that the structure would set a precedent, but opined that some future
developers will also want to incorporate solar energy in their projects. Council Member Bottenberg
spoke in favor of a less obtrusive solar panel structure and believes there is a way to allow their
use but in an aesthetically pleasing manner. He added that the City needs a policy on solar
energy use, agreeing with Mr. Vannorsdel that there may be future interest in their use for
commercial projects. Council Member Hughes suggested looking into solar panel use in
residential neighborhoods, as well. The council directed City staff to draft a policy for aesthetically
pleasing solar panel structures.
14) Snow ordinance revisions – City Clerk Schuett briefly reviewed the proposed revisions, which
will give the authority to enact snow emergencies to the public works director.
15) Economic Development direction – Community and Economic Development Director Dutcher
reviewed the City’s business incentive package program, including a special projects fund.
16) Waukee Municipal Code general overview – Council Member Bergman encouraged the council
to become familiar with the City code in order to have better ownership. The council discussed a
possible monthly review of certain chapters or sections of the code during work sessions.
E. Comments – Council Member Lyon suggested a joint meeting with the Waukee Community School
District school board.
