Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor William F. Peard; Council Members R. Charles Bottenberg, Courtney Clarke, Shelly Hughes, Larry R. Lyon. Absent: Council Member Anna Bergman. (Council Member Hughes left at 6:08 p.m.) Also present: City Administrator Tim Moerman, Finance Director Linda Burkhart, Development Services Director Brad Deets, Public Works Director John Gibson, Community and Economic Development Director Dan Dutcher, Parks and Recreation Director Matt Jermier, Marketing and Communications Director Summer Evans, Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1. (E) Closed Session:Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation – Council Member Hughes moved to close the regular session and enter closed session pursuant to Iowa Code §21.5(1)(c); seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Hughes, Lyon. Nays: None. Absent: Bergman. Motion carried 4 – 0 – 1. Council entered closed session at 5:36 p.m. CLOSED SESSION Council entered regular session at 6:01 p.m. (F) Open Forum – Council Member Hughes asked why gas utility bills were so high this month; Public Works Director Gibson noted that gas use doubled for most users due to cold temperatures. (G) Mayor’s Report – The Waukee Community School District bond referendum vote, Iowa League of Cities Legislative Day, and Alice’s Road Corridor Phase 5 public informational meeting are all scheduled for 02/06. 02/16 is the deadline for submittal of nominations for Waukee 2017 Citizen of the Year. All City offices are closed 02/19 in observance of Presidents’ Day. (H) Presentations: None (I) Public Hearings: 1) On a proposed Amendment No. 1 to the Waukee Central Urban Renewal Plan in the City of Waukee, State of Iowa – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the proposed amendment, which addresses certain street improvements as part of the Deery Brothers development. No additional properties or projects have been added. No comments were made by the public present. (Council Member Hughes left at 6:08 p.m.) 2) On a proposal to enter into a Development Agreement with Deery, Deery & Deery, LLC and Fred Rose, L.C. – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the proposed development agreement, which addresses improvements associated with 10th St. City staff anticipates the need to realign Ashworth Dr. in the future. No comments were made by the public present. 3) On plans, specifications, form of contract, and estimate of cost [Northwest Area Trunk Sewer Extension Project Phase 4] – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public J1B 2 Works Director Gibson briefly reviewed the project, which will provide service for the Apple project. No comments were made by the public present. 4) On plans, specifications, form of contract, and estimate of cost [Northwest Area Water Main Extension Project Phase 1] – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director Gibson briefly reviewed the project, which will provide service for the Apple project. An additional water line is planned for redundancy and City staff are in negotiations on a third line to connect with Des Moines Water Works. No comments were made by the public present. (J) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution determining an area of the City to be an economic development area, and that the rehabilitation, conservation, redevelopment, development or a combination thereof, of such area is necessary in the interest of the public health, safety or welfare of the residents of the City; designating such area as appropriate for urban renewal projects; and adopting the Amendment No. 1 to the Waukee Central Urban Renewal Plan – Council Member Lyon moved to approve the resolution; seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-039) 2) Resolution: Consideration of approval of a resolution approving and authorizing execution of a Development Agreement by and among the City of Waukee, Deery, Deery & Deery, LLC, and Fred Rose, L.C. – Council Member Clarke moved to approve the resolution; seconded by Council Member Lyon. Council Member Bottenberg asked if the proposed agreement was consistent with other previously-approved agreements; Development Services Director Deets replied that the agreement structure was similar. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-040) 3) Northwest Area Trunk Sewer Extension Project Phase 4 A. Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract, and estimate of cost – Council Member Bottenberg moved to approve the resolution; seconded by Council Member Clarke. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18-041) B. Resolution: Consideration of approval of a resolution awarding contract – Council Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg. Public Works Director Gibson reviewed the bid tabulation, recommending award to J&K Contracting of Ames, IA, in the amount of $1,919,226.00. Council Member Lyon amended the motion to award contract to J&K Contracting of Ames, IA, in the amount of $1,919,226.00; Council Member Bottenberg amended the second. Council Member Clarke asked if there were any concerns regarding the bid being so much below the engineer’s estimate; Mr. Gibson replied in the negative. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. (Resolution #18- 042) 4) Northwest Area Water Main Extension Project Phase 1 A. Resolution: Consideration of approval of a resolution awarding contract – Council Member Bottenberg moved to approve the resolution; seconded by Council Member Lyon. Public Works Director Gibson reviewed the bid tabulation, recommending award to Vanderpool Construction of Indianola, IA, in the amount of $691,525.00. Council Member Bottenberg amended the motion to award contract to Vanderpool Construction of Indianola, IA, in the amount of $691,525.00; Council Member Lyon amended the second. Results of vote: Ayes: Bottenberg, Clarke, Lyon. Nays: None. Absent: Bergman, Hughes. Motion carried 3 – 0 – 2. Work Session: 1) Gateway, Wayfinding & Community Identity Signage update – Emily Naylor, Nate Hardisty, and Mike Lansing of Shive-Hattery presented signage design concepts. 2) Fox Creek Park Phase 2 update – Parks and Recreation Director Jermier reviewed proposed Phase 2 amenities, including a splash pad that is planned to be open in 2019. Brett Douglas with Genus Landscape Architects presented two possible splash pad systems (recirculating and flow- thru) and discussed the positives and negatives of both systems. The council favored the recirculating system. 3) In-city hunting regulations – Development Services Director Deets reviewed the current regulations related to in-city hunting, then proposed the establishment of an urban reserve hunting boundary which would be evaluated annually. 4) Capital Improvement Program for Fiscal Years 2019-2023 – City Administrator Moerman and Finance Director Burkhart discussed revisions to the Capital Improvement Program. The council also briefly discussed proposed FY2019 budget contributions to non-profit entities. 5) Youth sports complex update – Parks and Recreation Director Jermier briefly reviewed the timeline for development of the complex and discussed Waukee Betterment Foundation fundraising for the all-inclusive ballfield, playground, and fishing pier. 6) Urban renewal plan amendments – Development Services Director Deets reviewed proposed amendments to the Waukee West and Waukee Unified urban renewal plans. 7) IT update – IT Director Le updated the council on the firewall, network refresh, and other projects. 8) ADA compliance program transition plan and sidewalk program – Assistant Public Works Director of Engineer Koester discussed the need for an ADA compliance program transition plan and the steps the City must follow for compliance. 9) Xenia Rural Water connection – Public Works Director Gibson reviewed current connections and water capacity needs, recommending construction of an additional pump station near Hickman Rd./T Ave. 10) Retail marketing campaign review – Marketing and Communications Director Evans presented marketing goals and initiatives. 11) Marketing and Communications Specialist position – Marketing and Communications Director Evans reviewed the proposed job description for the position. 2 12) Comprehensive Plan update – Development Services Director Deets discussed the current status of the comprehensive plan and the next steps. 13) Solar energy use – Development Services Director Deets reminded the council of a Fridley Theatres request to install a solar panel accessory structure along the southern property line, adjacent to NE Venture Dr. City staff continues to have concerns regarding size, location, aesthetics, impact on neighboring properties, and precedent. City Administrator Moerman added that the City has already agreed to substantial development incentives with Fridley Theatres and the amount of power to be gained from the solar panel accessory structure is negligible. Council Member Lyon stated that he could support a certain style of structure as long as architectural elements are incorporated. Council Member Bergman echoed City staff concerns regarding potential impact on neighboring properties. Russ Vannorsdel with Fridley Theatres addressed the council, stated that his company wants to be a good neighbor and also wants an attractive structure. He agreed that the structure would set a precedent, but opined that some future developers will also want to incorporate solar energy in their projects. Council Member Bottenberg spoke in favor of a less obtrusive solar panel structure and believes there is a way to allow their use but in an aesthetically pleasing manner. He added that the City needs a policy on solar energy use, agreeing with Mr. Vannorsdel that there may be future interest in their use for commercial projects. Council Member Hughes suggested looking into solar panel use in residential neighborhoods, as well. The council directed City staff to draft a policy for aesthetically pleasing solar panel structures. 14) Snow ordinance revisions – City Clerk Schuett briefly reviewed the proposed revisions, which will give the authority to enact snow emergencies to the public works director. 15) Economic Development direction – Community and Economic Development Director Dutcher reviewed the City’s business incentive package program, including a special projects fund. 16) Waukee Municipal Code general overview – Council Member Bergman encouraged the council to become familiar with the City code in order to have better ownership. The council discussed a possible monthly review of certain chapters or sections of the code during work sessions. E.
