FORMAT:Consent Agenda SYNOPSIS INCLUDING PRO & CON: This amendment to the original agreement for professional services for the Dog Park Project is for Design development of the restroom facility, associated utilities, and an additional 12 parking stalls (Phase 2 in master plan). The agreement will include developing construction documents, and construction administration of the Waukee Dog Park. This project will be utilized not only as a dog park but also a trailhead due to the close proximity to the Heart of Warrior Trail. In September 2017 bids were rejected for phase I. On Tuesday November 7th the Local Option Sales Tax passed and it was determined that it would be advantages for the City of Waukee to combine phase I and Phase II. Total CIP project cost for Phase I and Phase II is budgeted at $750,000. The time of completion of the scope of services under this Agreement shall be as follows: •Design Development: February 2018 •Construction Documents: February – March 2019 •Bidding Phase: April 2018 •Construction: May 2018 – Spring 2019 •Substantial Completion: Spring 2019 •Close Out Conference: June 2019 •Final Completion: June 2019 FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Not-to-Exceed $17,100. COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: The City Attorney has reviewed the agreement and finds it satisfactory. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Master Plan PREPARED BY: Matt Jermier REVIEWED BY: J1H PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 18- APPROVING AMENDMENT TO AN AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES WITH CONFLUENCE [WAUKEE DOG PARK PROJECT] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, on May 15, 2017, the Waukee City Council approved an Agreement for Professional Consulting Services with Confluence related to the Waukee Dog Park Project (Resolution #17-245); AND, WHEREAS, Confluence has provided the City with an Amendment to an Agreement for Professional Consulting Services with Confluence [Waukee Dog Park Project]; AND, WHEREAS, the City Attorney has reviewed the Supplemental Agreement and finds it satisfactory; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Amendment to an Agreement for Professional Consulting Services with Confluence [Waukee Dog Park Project] is hereby approved. Lyon AMENDMENT TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES CLIENT: City of Waukee DATE: February 5, 2018 CLIENT CONTACT: Matt Jermier PROJECT #: 16140-01 PROJECT NAME: Waukee Dog Park LOCATION: Waukee, Iowa BASIC SCOPE OF SERVICES: The parties seek to amend the Agreement for Professional Consulting Services dated May 17, 2017(Agreement) by and between the City of Waukee and Confluence. The Parties hereby amend the Agreement as follows: 1)Paragraph 1 of the Agreement is amended to add the following to the Scope of Services: A.Current Understanding-The Project will additionally include one building, 2 restrooms, 80 sf of storage, with dog wash stations indoors and outdoors. It is expected that the additional structures will be constructed of durable materials such as precast concrete or burnished concrete masonry. B. Qualifications to the Project Understanding above: 1. The aforementioned information was available at the writing of our proposal. 2. A construction budget is expected to be $60,000 +/-. 3. A building program document was not available at the time of this proposal. 4. Construction Documents will be prepared in 2018. 5. Attachments that serve as the basis of the amendment: a. Floor Plan Sketch dated 01.08.2018 b. Site Plan provided by Confluence. C. Proposed Scope of Work / Deliverables: 1. Building Program Document: Confluence will meet with the Owner / Owner Representative to determine the program requirements for the structures listed above. This will also identify the desired materials and finishes for these structures. 2. Schematic Design: Confluence will produce conceptual drawings for Owner review and approval. 3. Design Development: Confluence will coordinate with MEP designers and our structural engineer to coordinate our design with other systems being provided in these structures. Confluence provide a final DD drawing to the Owner for review and approval. 4. Construction Documents and Specifications: Confluence will provide stamped Construction Documents and Specifications, or the approved Design Development deliverables required for permits, bidding. and construction for all components including but not limited to engineering, electrical, mechanical, foundation and structural work. 5. Deliverables: At the conclusion of our services for this project, we will provide the following deliverables: a. Architecture: Floor Plan, Ceiling Plan, Roof Plan, Building Elevations, Building Sections, Door Schedule, Room Finish Schedule, Construction Details, 3 part Specifications provided to CONFLUENCE to include in their Project Manual; b. Electrical Engineering services, plans and specifications for the Project; c, mechanical engineering services, plans and specifications; d. Structural, Foundation Plan, Framing Plan, Construction Details, Structural Calcs, 3 part Specifications provided to CONFLUENCE to include in their Project Manual. e. All Necessary stamped construction and engineering documents, plans and specifications. 6. Construction Support: Shop Drawing Review, 2 Site Visits & Field Observations during construction. 7. Confluence is working with Ethos Planning and Design(Architects); Saul Engineering (Engineering); Bluestone Engineering (MEP); and Civil Design Advantage (Civil Engineering) as sub consultants and has assured the City that they have in place adequate insurance in at least the minimum insurance levels required by the Agreement. Confluence acknowledges that they are responsible as contractor for the Project and the completion of the scope of work. They will assure that any and all sub consultants are familiar with the terms of the Agreement and shall be responsible for any and all fees, costs and expenses incurred to any sub consultants engaged by Confluence, including the foregoing. Further, Confluence represents and warrants that the foregoing sub consultants are licensed professionals in their respective fields and are in good standing and will assure that they are providing professional services in a manner consistent with the standard of care in their industries. 2)Paragraph 3 of the agreement is amended to add the following additional compensation: The additional compensation for the additional scope of work provided in this amendment shall be performed on an hourly basis in accordance with the attached schedule of fees but in no event exceed the following: a. Architecture and Structural $9,500.00 b. Mechanical / Electrical Eng. $6,000.00 c. Civil Engineering $ 600.00 d. Confluence Adjustments $1,000.00 Total $17,100.00 3)There are no other amendments to the Agreement and the remaining terms and conditions of the Agreement remain in full force and effect with the foregoing additions.
