AGENDA ITEM: Consideration of approval of a resolution approving Public Overland Flowage
Easement [R.M. Madden Construction, Inc.]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The builder of Lots 1 and 2 of Drew’s Addition Plat 1
located north of SE University Avenue has provided an Overland Flowage
Easement to the City. The purpose of the easement is to allow for the offsite
drainage from the east to continue across Lots 1 and 2 of Drew’s Addition Plat
1 to an existing drainage area on the west wide of the plat.

STAFF REVIEW AND COMMENT: Staff would recommend approval.
RECOMMENDATION: Approve the resolution

RESOLUTION 18-
APPROVING OVERLAND FLOWAGE EASEMENT [R.M. MADDEN
CONSTRUCTION, INC.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, a final plat has been approved for Drew’s Addition Plat 1; AND,
WHEREAS, it is necessary to acquire an overland flowage easement from the property owner
for purposes of draining surface water through the properties to an existing drainage area.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
20th day of February, 2018, that it hereby approves the overland flowage easement across
property owned by R.M. Madden Construction, Inc.
