(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Peard
at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor William F. Peard; Council Members Anna
Bergman, R. Charles Bottenberg, Courtney Clarke, Larry R. Lyon. Absent: Council Member Shelly
Hughes.
Also present: City Administrator Tim Moerman, Development Services Director Brad Deets, Finance
Director Linda Burkhart, Public Works Director John Gibson, Community and Economic Development
Director Dan Dutcher, Human Resource Director Patty Holden, Parks and Recreation Director Matt
Jermier, Marketing and Communications Director Summer Evans, Police Chief John Quinn, City
Clerk Rebecca D. Schuett, City Attorney Steve Brick.
(D) Open Forum – Robert Greenway, 121 Elm St., De Soto, asked the council to support a proposal for
the Dallas County Board of Supervisors to use local option sales tax funds to help finance the county
jail facility currently under construction.
(E) Agenda Approval – Council Member Bergman moved to approve the agenda; seconded by Council
Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Lyon. Nays: None. Absent:
Hughes. Motion carried 4 – 0 – 1.
(F) Mayor’s Report – Mayor Peard congratulated Waukee Police Department 2017 Officer of the Year
Susan Kies and Des Moines Business Record “Forty Under 40” inductee Council Member
Bottenberg. He announced Erna Morain as Waukee 2017 Citizen of the Year.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and changing certain property therein from A-1 to M-1, a property to be known as
Stratford Crossing Plat 4 – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the rezoning application, noting that initial access to the site
would be from 10th St. with a future Hickman Rd. connection. The council had discussed at a
recent work session some concerns regarding exterior materials and outdoor storage screening,
which Mr. Deets stated would be addressed during the site plan approval process. Nick Halfhill
with Landmark Development, property developer, introduced himself to the council in the event of
questions. No comments were made by the public present.
2) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
incorporating regulations for solar energy systems – Mayor Peard opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets reviewed the proposed ordinance, which is
based on a Capital Crossroads model ordinance. He noted different solar energy systems
addressed in the proposed ordinance, including ground mounted systems. Mayor Peard asked if
there were concerns with aesthetics; Mr. Deets replied in the affirmative, but that the use
restrictions in the ordinance would likely limit the use of visible solar structures. Council Member
Clarke asked if all solar energy systems would require council approval; Mr. Deets clarified that
only ground mounted systems would require such approval. No comments were made by the
public present.
3) On the adoption of a proposed Amendment No. 8 to the Waukee Unified Urban Renewal
Plan – Mayor Peard opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed the amendment, noting that certain properties being removed from the current plan
would be incorporated into the Waukee West Urban Renewal Plan. No comments were made by
the public present.

4) On the adoption of a proposed Amendment No. 1 to the Waukee West Urban Renewal Plan
– Mayor Peard opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets
reviewed the amendment, including a summary of those public improvement projects to be
funded through the tax increment financing generated by the district. No comments were made
by the public present.
5) On the issuance of not to exceed $4,500,000 General Obligation Bonds (ECP-2) – Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Clerk Schuett replied in the negative. Finance Director Burkhart presented information
related to all of the general obligation bonds being considered at this time by the council,
including the bond sale schedule. She then reviewed the projects to be funded by the proposed
bonds. No comments were made by the public present.
6) On the issuance of not to exceed $700,000 General Obligation Bonds (GCP-3) – Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Clerk Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be
funded by the proposed bonds. No comments were made by the public present.
7) On the issuance of not to exceed $700,000 General Obligation Bonds (GCP-4) – Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Clerk Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be
funded by the proposed bonds. No comments were made by the public present.
8) On the issuance of not to exceed $700,000 General Obligation Bonds (GCP-5) – Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Clerk Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be
funded by the proposed bonds. No comments were made by the public present.
9) On the issuance of not to exceed $200,000 General Obligation Bonds (GCP-6) – Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Clerk Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be
funded by the proposed bonds. No comments were made by the public present.
10) On the issuance of not to exceed $13,200,000 General Obligation Urban Renewal Bonds
(ECP/UR-1) – Mayor Peard opened the public hearing and asked if any written correspondence
had been received; City Clerk Schuett replied in the negative. Finance Director Burkhart
reviewed the projects to be funded by the proposed bonds. No comments were made by the
public present.
11) On the issuance of not to exceed $4,000,000 Water Revenue Bonds – Mayor Peard opened
the public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be funded by
the proposed bonds. No comments were made by the public present.
12) On the issuance of not to exceed $4,000,000 Sewer Revenue Bonds – Mayor Peard opened
the public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Finance Director Burkhart reviewed the projects to be funded by
the proposed bonds. No comments were made by the public present.
13) On plans, specifications, form of contract, and estimate of cost [NE Alice’s Road Joint
Utility Trench Project] – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Public Works
Director Gibson reviewed the project plans. No comments were made by the public present.

1) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from
A-1 to M-1, a property to be known as Stratford Crossing Plat 4 [introduction; first reading]
– Council Member Lyon introduced the ordinance and moved to approve the first reading in title
only; seconded by Council Member Bergman. Results of vote: Ayes: Bergman, Bottenberg,
Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by incorporating regulations for solar energy systems
[introduction; first reading]– Council Member Bottenberg introduced the ordinance and moved
to approve the first reading in title only; seconded by Council Member Clarke. Council Member
Bottenberg voiced his confusion on whether the ground structure proposed by Fridley Theatres
would be considered as one structure or more; Development Services Director Deets replied that

the ordinance language would be clarified prior to the second reading. Results of vote: Ayes:
Bergman, Bottenberg, Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1.
3) Resolution: Consideration of approval of a resolution determining an area of the City to be
an economic development area, and that the rehabilitation, conservation, redevelopment,
development or a combination thereof, of such area is necessary in the interest of the
public health, safety or welfare of the residents of the City; designating such area as
appropriate for urban renewal projects; and adopting the Amendment No. 8 to the Waukee
Unified Urban Renewal Plan – Council Member Bergman moved to approve the resolution;
seconded by Council Member Clarke. Results of vote: Ayes: Bergman, Bottenberg, Clarke,
Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1. (Resolution #18-126)
4) Ordinance: Consideration of approval of an ordinance for the division of revenues under
Iowa Code Section 403.19 for Amendment No. 8 to the Waukee Unified Urban Renewal
Plan [introduction; first reading]– Council Member Bergman introduced the ordinance and
moved to approve the first reading in title only; seconded by Council Member Lyon.
Development Services Director Deets noted that the proposed ordinance would release certain
properties from the district. Results of vote: Ayes: Bergman, Bottenberg, Clarke, Lyon. Nays:
None. Absent: Hughes. Motion carried 4 – 0 – 1.

14) NE Alice’s Road Joint Utility Trench Project
A. Resolution: Consideration of approval of a resolution approving plans, specifications,
form of contract, and estimate of cost – Council Member Bergman moved to approve the
resolution; seconded by Council Member Clarke. Results of vote: Ayes: Bergman,
Bottenberg, Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Bergman.
Public Works Director Gibson noted that only one bid was received, adding that staff did not
recommend rebidding the project, as it was unlikely that additional or better bids would be
received. He then recommended awarding the contract to Van Maanen Electric, Inc., of
Newton, IA, in the amount of $171,911.95. Results of vote: Ayes: Bergman, Bottenberg,
Clarke, Lyon. Nays: None. Absent: Hughes. Motion carried 4 – 0 – 1. The contract was
awarded to Van Maanen Electric, Inc., of Newton, IA. (Resolution #18-137)
C. Resolution: Consideration of approval of a resolution approving contract, bond –
Council Member Lyon moved to approve the resolution; seconded by Council Member
