AGENDA ITEM: Consideration of approval of a resolution accepting Public Roadway and
utility Easement [Sugar Creek Homeowners Association]
FORMAT: Consent Agenda
SYNOPSIS INCLUDING PRO & CON: Sugar Creek Estates, located south of Ashworth Road, was
annexed into the City of Waukee several years ago as an existing rural
subdivision. A homeowner’s association was originally established with the
development which among other things was responsible for the ownership and
maintenance of the street that serves the residents within the subdivision.
While the City has been maintaining the street for a number of years, it was
discovered that the ownership of the street was still owned by the association.
The City Attorney has coordinated with the owners within Sugar Creek
Estates and has prepared the Public Roadway and utility Easement which has
been approved and executed by the Sugar Creek Homeowner’s Assocation.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2022-
APPROVING PUBLIC ROADWAY AND UTILITY EASEMENT
[SUGAR CREEK HOMEOWNERS ASSOCIATION]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee is a duly organized municipality within Dallas County; AND,
WHEREAS, Sugar Creek Estates subdivision has previously been annexed into the City of
Waukee which included a private street and utility corridor; AND,
WHEREAS, as a part of the annexation process, the City of Waukee agreed to take over regular
and long term maintenance of the private street and utility corridor known as Sugar Creek Lane.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa,
that the Public Roadway and Utility Easement is hereby approved which defines the City of
Waukee’s responsibilities associated with Sugar Creek Lane.

January, 2022.
