AGENDA ITEM: Consideration of approval of a resolution approving a preliminary plat
for Maple Grove Place
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a preliminary
plat for a 17.25-acre residential development located north of Ashworth
Road and west of SE Waco Place. The plat includes 83 lots for a
detached villa style development. The streets within the development
will be privately owned and maintained. All utilities within the
development will be privately owned and maintained.
The developer will not be responsible for any improvements to SE Waco
Place at this time because the city recently completed an asphalt overlay
of SE Waco Place. A development agreement has been prepared that
addresses the obligations of the developer. Based on the agreement,
funds will be provided to the City when a final plat is filed.
The total required parkland for the proposed development is 1.21-acres.
The applicant proposes to install a portion of trail through the
development that will connect to the future Kettlestone Greenway trail
network.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on November 23,
2021, recommended approval subject to remaining staff comments:
Motion for Approval of a Preliminary Plat for Maple Grove Place
Planning Coordinator, Andy Kass, introduced the request for approval of a preliminary plat for a
detached townhome subdivision as submitted by the applicant, Maple Grove Place, LLC. The
subject property is generally located north of Ashworth Road and west of SE Waco Place,
containing approximately 17.25 acres. The subject property is located within the Kettlestone
corridor and was rezoning in 2016 to the K-MF Row House District. A Planned Development
Overlay was added to the zoning in 2018 to allow for a detached townhome product which is not
allowed in the standard K-MF zoning district.
Mr. Kass advised that the preliminary plat identifies a total of 83 lots that are intended to be
developed in one phase. Lots range in size from 4.950 square feet to 9,920 square feet that meet

or exceed the zoning bulk regulations for the K-MF/PD-1 district. All lots interior to the
development are accessed via private streets that will be owned and maintained by the
homeowners association. Sidewalks will be available on both sides of the internal streets and a
potential trail connection headed west has been shown for future access to City Greenbelt trails in
the area. Private utilities will service each lot and Stormwater detention will be provided within
Outlot X. The applicant has proposed a fee in lieu of parkland dedication.
At this time staff would recommend approval of the preliminary plat for Maple Grove Place
subject to remaining staff comments.
Commissioner Gerlitz questioned if the developer had done work in the city before. Mr.
Kass advised that the developer did not have any Waukee based projects, but that some
members of staff had worked with him years ago at a different municipality in the Des
Moines area.
Commissioner Gerlitz also questioned if the walking trail was conceptual at this time.
Mr. Kass advised that was correct, there were some properties between the subject land
and the existing trails to the west that City Staff would be looking to continue the trail
access through in the future.
Commissioner Hoifeldt questioned what the surrounding properties were zoned. Mr. Kass
advised that Kettlestone stacked high density was to the east, medium density zoning to
the south and commercial and medium density to the north.
Commissioner Streit questioned what the street future for SE Esker Ridge Drive would
be. Mr. Kass advised that it has the potential to T into SE Waco Place at this time.
Commissioner Streit questioned if there were future plans for development East of SE
Waco Place, technically in West Des Moines. Mr. Kass advised that there are a few
potential risks on the property which could be leading to the longevity of the “for sale”
status, related to utility extension, through-fares in the area, and the cost of extending
other infrastructure. Mr. Kass advised he would anticipate more residential development
in this area.
Commissioner Koshy questioned if there were variations with the Planned Development.
Mr. Kass advised that the planned development overlay only altered the width of the lots
and the ability to have a detached townhome product.
Commissioner Streit moved to approve the preliminary plat for Maple Grove Place, subject to
remaining staff comments. Commissioner Gerlitz seconded the motion. Ayes: Streit, Hoifeldt,
Koshy, Ward, and Gerlitz. Nays: none. Motion Carried.
STAFF REVIEW AND COMMENT: Staff’s position is that the proposed preliminary plat
meets the intent and the requirements of the Zoning Ordinance and the
Waukee Subdivision Ordinance.
RECOMMENDATION: Staff recommends approval of the Preliminary Plat for Maple Grove
Place.

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee Planning and Zoning Commission reviewed and recommended
approval of a Preliminary Plat for Maple Grove Place on November 23, 2021; AND,
WHEREAS, the Preliminary Plat for Maple Grove Place is in general conformance with section
§303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this the 7th day of February, 2022 that the Preliminary Plat for Maple Grove Place be approved.

HISTORY
The subject property is located within the Kettlestone corridor and was included within the master plan that was
completed in 2014. In 2016, the property was rezoned to the K-MF Row House district for a townhome development.
In 2018, the property was rezoned again to place a planned development overlay on the property to add flexibility to
the property. The purpose of the planned development overlay was to allow for the development of detached
townhomes on the subject property that would otherwise not be allowed by the standard zoning district.
PROJECT DESCRIPTION
LOTS
The preliminary plat identifies a total of 83 lots that are intended for detached townhome development. The lots will be
developed in one phase. The lots range in size from 4,950 square feet to 9,920 square feet. All proposed lots meet or
exceed the minimum lot width of 43-feet. Outlot X is 1.58-acres in area and will be utilized for stormwater detention
and owned by the homeowners association.
The bulk regulations for the K-MF Row House/PD-1 zoning district are included below in Table 1.

There are specific provisions included within the Planned Development that will apply once the property is developed.
Those provisions are as follows:
Each villa shall have a two-car attached garage.
25% stone, stucco, or brick on front facades.
Adjoining lots cannot share the same elevation.
Vinyl siding shall not be permitted.
STREETS AND TRAIL
All lots within the development will be accessed via private streets that will be owned and maintained by the
homeowners association. Sidewalks will be provided on both sides of the internal streets. A potential trail connection
from the neighborhood to the west has been shown to provide access to future City greenbelt trails to the west. In the
future, a 10-foot wide trail will be installed along the west side of SE Waco Place as part of a City of Waukee project.
UTILITIES
Private utilities will service each lot. As part of the improvements, the applicant will relocate an existing public sewer and
extend a water main along SE Waco Place. Stormwater detention will be provided within Outlot X.
EASEMENTS
All proposed easements have been indicated on the preliminary plat. Landscape buffer easements have been indicated
along all lots abutting SE Waco Place.
PARKLAND DEDICATION
Parkland dedication requirements will apply to the project because of its residential nature. The required amount of
parkland is 1.21-acres. The applicant has proposed to satisfy parkland with a fee in lieu of land dedication.
STAFF RECOMMENDATION
All proposed lots meet the minimum requirements of the Zoning Ordinance and Planned Development, the preliminary
plat is in general conformance with the Subdivision Ordinance, and the proposed land use of the property is consistent
with the Comprehensive Plan. Staff recommends approval of the preliminary plat for Maple Grove Place subject to
remaining staff comments.

A.POLLUTION PREVENTION AND EROSION PROTECTION
1. CODE COMPLIANCE: THE CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH

B.STORM WATER DISCHARGE PERMIT

FOR STORM WATER DISCHARGES ASSOCIATED WITH CONSTRUCTION ACTIVITIES
FROM THE IDNR, AS REQUIRED BY THE ENVIRONMENTAL PROTECTION AGENCY
(EPA). THE GENERAL CONTRACTOR AND ALL SUBCONTRACTORS ARE RESPONSIBLE
FOR COMPLIANCE WITH AND FULFILLMENT OF ALL REQUIREMENTS OF THE NPDES
GENERAL PERMIT NO. 2 AS SPECIFIED IN THE CONTRACT DOCUMENTS.
2.ALL DOCUMENTS RELATED TO THE STORM WATER DISCHARGE PERMIT, INCLUDING,
BUT NOT LIMITED TO, THE NOTICE OF INTENT, PROOF OF PUBLICATIONS,
DISCHARGE AUTHORIZATION LETTER, CURRENT SWPPP, SITE INSPECTION LOG, AND
OTHER ITEMS, SHALL BE KEPT ON SITE AT ALL TIMES AND MUST BE PRESENTED TO
ANY JURISDICTIONAL AGENCIES UPON REQUEST. FAILURE TO COMPLY WITH THE
NPDES PERMIT REQUIREMENTS IS A VIOLATION OF THE CLEAN WATER ACT AND THE
CODE OF IOWA.
3.A "NOTICE OF DISCONTINUATION" MUST BE FILED WITH THE IDNR UPON FINAL
STABILIZATION OF THE DISTURBED SITE AND REMOVAL OF ALL TEMPORARY
EROSION CONTROL MEASURES. ALL PLANS, INSPECTION REPORTS, AND OTHER
DOCUMENTS MUST BE RETAINED FOR A PERIOD OF THREE YEARS AFTER PROJECT
COMPLETION. THE CONTRACTOR SHALL RETAIN A RECORD COPY AND PROVIDE THE
ORIGINAL DOCUMENTS TO THE OWNER UPON PROJECT ACCEPTANCE AND/OR
SUBMITTAL OF THE NOTICE OF DISCONTINUATION.
C.POLLUTION PREVENTION PLAN
1. THE STORM WATER POLLUTION PREVENTION PLAN (SWPPP) IS A SEPARATE
DOCUMENT IN ADDITION TO THESE PLAN DRAWINGS. THE CONTRACTOR SHOULD
REFER TO THE SWPPP FOR ADDITIONAL REQUIREMENTS AND MODIFICATIONS TO
THE POLLUTION PREVENTION PLAN MADE DURING CONSTRUCTION.
2.THE SWPPP ILLUSTRATES GENERAL MEASURES AND BEST MANAGEMENT
PRACTICES (BMP) FOR COMPLIANCE WITH THE PROJECT'S NPDES PERMIT
COVERAGE. ALL BMP'S AND EROSION CONTROL MEASURES REQUIRED AS A
RESULT OF CONSTRUCTION ACTIVITIES ARE THE RESPONSIBILITY OF THE
CONTRACTOR TO IDENTIFY, NOTE AND IMPLEMENT. ADDITIONAL BMP'S FROM
THOSE SHOWN ON THE PLAN MAY BE REQUIRED.
3.THE SWPPP AND SITE MAP SHOULD BE EXPEDITIOUSLY REVISED TO REFLECT
CONSTRUCTION PROGRESS AND CHANGES AT THE PROJECT SITE.
4.THE CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH ALL REQUIREMENTS OF

AROUND SURFACE WATERS, DIRECT STORM WATER TO VEGETATED AREAS TO
INCREASE SEDIMENT REMOVAL AND MAXIMIZE STORM WATER INFILTRATION,
AND MINIMIZE SOIL COMPACTION.
b.INSTALL PERIMETER AND FINAL SEDIMENT CONTROL MEASURES SUCH AS SILT
BARRIERS, DITCH CHECKS, DIVERSION BERMS, OR SEDIMENTATION BASINS
DOWNSTREAM OF SOIL DISTURBING ACTIVITIES PRIOR TO SITE CLEARING AND
GRADING OPERATIONS.
c.PRESERVE EXISTING VEGETATION IN AREAS NOT NEEDED FOR CONSTRUCTION
AND LIMIT TO A MINIMUM THE TOTAL AREA DISTURBED BY CONSTRUCTION
OPERATIONS AT ANY TIME.
d.MAINTAIN ALL TEMPORARY AND PERMANENT EROSION CONTROL MEASURES IN
WORKING ORDER, INCLUDING CLEANING, REPAIRING, REPLACEMENT, AND
SEDIMENT REMOVAL THROUGHOUT THE PERMIT PERIOD. CLEAN OR REPLACE
SILT CONTROL DEVICES WHEN THE MEASURES HAVE LOST 50% OF THEIR

PERSONNEL ASSIGNED BY THE CONTRACTOR) EVERY SEVEN CALENDAR DAYS.
RECORD THE FINDINGS OF THESE INSPECTIONS AND ANY RESULTING ACTIONS IN
THE SWPPP WITH A COPY SUBMITTED WEEKLY TO THE OWNER OR ENGINEER
DURING CONSTRUCTION. REVISE THE SWPPP AND IMPLEMENT ANY
RECOMMENDED MEASURES WITHIN 7 DAYS.
f.PREVENT ACCUMULATION OF EARTH AND DEBRIS FROM CONSTRUCTION
ACTIVITIES ON ADJOINING PUBLIC OR PRIVATE PROPERTIES, INCLUDING
