AGENDA ITEM:Consideration of approval of a resolution approving Amendment No. 1 to
Agreement for Professional Consulting Services with Bolton & Menk, Inc.
[Sugar Creek Park] in the amount of $8,700.00
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The Request for Additional Services is due to the original
scope anticipating that the MEP design for the building would be completed
by the pre-manufactured building vendor. As Bolton & Menk moved through
the design, the vendor did not provide anything in regards to MEP. Bolton &
Menk’s extra services included design required for the structure, permitting
support, construction submittal review and other construction support as
needed. Sugar Creek Park is anticipated to be completed by June 1st, 2022.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $8,700.00

RESOLUTION 2022-
APPROVING AMENDMENT NO. 1 TO AGREEMENT FOR PROFESSIONAL
CONSULTING SERVICES WITH BOLTON & MENK, INC. [SUGAR CREEK PARK]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City requires professional services related to design, bidding and construction
services for the Sugar Creek Park Project; AND,
WHEREAS, on May 17, 2021, the Waukee City Council approved an Agreement for Professional
Consulting Services with Bolton & Menk, Inc., for the Sugar Creek Park Project (Resolution #2021-
168); AND,
WHEREAS, an Amendment No. 1 is proposed for extra services for the MEP design for the park
building structure, permitting support, construction submittal review and other construction support as
needed.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amendment No. 1 to Agreement for Professional Consulting Services with Bolton & Menk, Inc.
[Sugar Creek Park Project] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 22nd day of February,
2022.

AMENDMENT No. 1
TO THE AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES
SUGAR CREEK PARK
This AMENDMENT made and entered into this day of , 2021, by and between the CITY OF
WAUKEE, a municipal corporation, hereinafter referred to as “City”, and Bolton & Menk, Inc., (Fed. I.D.
#41-0832249), a professional corporation incorporated and licensed under the laws of the State of Iowa,
party of the second part, hereinafter referred to as “Consultant” as follows, hereby amends the original
Agreement dated May 3, 2021:
1. SCOPE OF SERVICES
Services as described in the Agreement, Attachment 1, Scope of Services are amended as follows:
Add to Task 2 – CONSTRUCTION PHASE SERVICES
• MEP design and construction services for the restroom structure.
2. SCHEDULE
The schedule as described in the Agreement, Attachment 2 Project Schedule are amended as
follows:
• No change to the schedule
3. COMPENSATION
In consideration of the additional professional services provided, the City agrees to pay the
Consultant the additional fee to increase the original fee NOT-TO-EXCEED, including any authorized
reimbursable expenses, pursuant to the Schedule of Fees set forth in The Agreement, Attachment 3.

This AMENDMENT is subject to all provisions of the original agreement. This AMENDMENT together
