FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: City staff recommend approval of the agreement. RECOMMENDATION: Approve the resolution. Polling Place Agreement PREPARED BY:Becky Schuett REVIEWED BY: I1G2 THE CITY OF WAUKEE, IOWA RESOLUTION 2022- ACCEPTING POLLING PLACE AGREEMENT BETWEEN THE DALLAS COUNTY COMMISSIONER OF ELECTIONS AND THE CITY OF WAUKEE [WAUKEE PRECINCT 10] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the Dallas County Commissioner of Elections requests the use of Waukee City Hall, 230 W. Hickman Road, as the polling place for the Waukee 10 Precinct; AND, WHEREAS, the Dallas County Commissioner of Elections has provided a Polling Place Agreement related to the use of Waukee City Hall as the polling place for Waukee Precinct 10, with the boundaries of said precinct described in the City of Waukee Code of Ordinances, Chapter 6, City Elections, Section 6.07, Voting Precincts; AND, WHEREAS, said Agreement will remain in effect for two (2) years; NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 21st day of March, 2022, that it hereby accepts the Polling Place Agreement between the Dallas County Commissioner of Elections and the City of Waukee [Waukee 10 Precinct]. ____________________________ Courtney Clarke, Mayor Attest: ___________________________________ Rebecca D. Lyon Ben Sinclair POLLING PLACE AGREEMENT Waukee City Hall___________ Waukee 10 ________________________ Polling Place Precinct Name 230 W Hickman Rd _____________ ____Waukee_____________ 50263 ___________ Address City Zip This agreement is entered into between the Dallas County Commissioner of Elections, hereafter referred to as Commissioner, and Waukee City Hall hereafter referred to as Proprietor, for the purpose of allowing the Commissioner to use space in the Proprietor’s location as a polling place for Primary and General elections and such times as required for city, school, and special elections (polling place to be notified of yearly election schedules as they become available). This contract will remain in effect for two (2) years. For the use of such space as a polling place, Commissioner agrees to pay $200. Payment for the polling place will be made within 30 days after the election. Proprietor agrees that the doors to the building shall be opened one hour prior to the opening of the polls (per notification from the Commissioner or Precinct Chairperson). The Proprietor agrees that they will close the building doors after the election board has finished with the business of voting and storing of any or all supplies (or to allow the Precinct Chairperson to lock the building doors). The election board shall have control of the locking and unlocking of the polling place doors during the open hours of the polls. During the hours of the use of the building as a polling place, the Proprietor agrees to adequately heat and light the building and to furnish any needed janitorial service. Proprietor does hereby release, forever discharge, covenant not to sue, and hold harmless Dallas County and its employees and agents from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Proprietor’s own intentional or negligent acts or property defects during the time the Commissioner’s use of space. The parties agree the voting equipment to be delivered on the Sunday or Monday (as agreed to by Proprietor & Commissioner) prior to the scheduled election, and be picked up at the specified day after the election has been completed. The Proprietor will be contacted by Commissioner to arrange for access to the building and necessary keys.
