AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1
(Agricultural District) and R-1 / PD-1 (Single-Family Residential /
Planned Development Overlay) to R-1 (Single-Family Residential
District) [Broderick Holdings Property]

SYNOPSIS INCLUDING PRO & CON: The subject property is located south of SE University
Avenue and east of S Warrior Lane and contains approximately 2.61-acres. The property is
currently zoned A-1 (Agricultural) and R-1 / PD-1 (Single-Family Residential)(Planned
Development Overlay) and the applicant wishes to rezone the property to standard R-1 (Single-
Family Residential District) for the purposes of constructing a single-family residence.
The applicant has submitted consent from 59.10% of property owners within 250-feet of the
property to be rezoned. Notification to adjacent property owners was mailed on March 10, 2022.
The rezoning signs were placed on the property by the March 21, 2022 deadline. Staff has
received no correspondence related to this request.
The subject property is classified as Low-Density Residential in the Imagine Waukee 2040
Comprehensive Plan. The property is currently undeveloped with plans for a single-family
residence upon approval of the rezoning request.
The proposed rezoning to R-1 is generally more compatible with the applicant’s request. In the
A-1 District, 5-acres is required for single-family residences. In the R-1 District, only 10,000
square feet is required. At 2.61-acres, the lot is not sized appropriately for a single-family
residence. Rezoning to R-1 reduces the bulk regulations and allows the owner to construct a
dwelling more easily.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the rezoning request on March 29, 2022, and recommended
approval:

Commissioner Broderick recuses himself from this item due to a conflict of interest.
City Planner Bill Mettee introduced the request for rezoning of a single-family lot
as submitted by the applicant, Broderick Holdings, LLC. The subject property is
generally located south of SE University Avenue and east of South Warrior Lane,
containing approximately 2.61 acres. The intent is for the property to be used as a single-
family residence. The Applicant has submitted consent of 59.10% from adjacent property
owners and notification to adjacent property owners was mailed on March 10th, 2022. A
sign notifying the traveling public was placed by March, 21st, 2022. The request is in
general conformance with the comprehensive plan and with the surrounding forms of
housing.
Staff recommends approval of the rezoning request.
Commissioner Gerlitz moved to approve the rezoning related to a change from A-1
(Agricultural District) and R-1 (Single Family Residential District)/ PD-1 (Planned
Development Overlay) to R-1 (Single Family Residential District) [Broderick Holdings
Property]. Commissioner Hoifeldt seconded the motion. Ayes: Gerlitz, Hoifeldt, Streit,
Inman, Koshy, and Tessau. Nays: none. Motion Carried.
STAFF REVIEW AND COMMENT: Staff would recommend approval of the proposed
rezoning request
RECOMMENDATION: Hold the Public Hearing.

BACKGROUND & PROJECT DESCRIPTION
The subject property is located on the east side of South Warrior Lane between SE Booth Avenue and SE University
Avenue. The property is currently zoned A-1 (Agricultural) and R-1 / PD-1 (Single-Family Residential / Planned
Development Overlay). The applicant wishes to construct a single-family residence and has proposed rezoning the entire
parcel to R-1 (Single-Family Residential). The parcel is 2.61-acres in size and approximately 113,696-square feet. The
size of the lot is in conformance with the proposed use.
Specifically, the minimum requirements for lots within the existing and proposed zoning districts are as follows:

The applicant has submitted the necessary consent (59.10%) to the rezoning. Notification to adjacent property owners
was mailed on March 10, 2022. To date, staff has not received any correspondence either for or against the proposed
rezoning. A sign notifying the traveling public was required to be placed on site no later than March 21, 2022.

COMPREHENSIVE PLAN
Low Density Residential: This land use typology captures the traditional forms of single-family housing found in
Waukee. Typical lot sizes range from 8,000-square feet to 0.50-acres with an average density of 2 to 4-units per acre.
The subject property is slightly larger than the typical Low-Density Residential area and will offer a density of
approximately 1-unit per two acres.

AN ORDINANCE TO AMEND CHAPTER 169, ZONING ORDINANCE, CITY OF
WAUKEE, IOWA BY AMENDING THE ZONING FROM A-1 (AGRICULTURAL
DISTRICT) AND R-1 / PD-1 (SINGLE-FAMILY RESIDENTIAL / PLANNED
DEVELOPMENT OVERLAY) TO R-1 (SINGLE-FAMILY RESIDENTIAL DISTRICT)
FOR CERTAIN PROPERTY [BRODERICK HOLDINGS LLC PROPERTY]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 160.02 of Chapter 169, Waukee Municipal Code, Zoning
Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the
following real estate (Property) from A-1 (Agricultural District) and R-1 / PD-1 (Single-Family
Residential / Planned Development Overlay) to R-1 (Single-Family Residential District),
legally described as follows:
PARCEL 19-1 IN A PART OF GOVERNMENT LOTS 1 AND 2, SECTION 5, TOWNSHIP 78
NORTH, RANGE 26 WEST OF THE 5th P.M., WAUKEE, DALLAS COUNTY, IOWA AS
SHOWN ON THE PLAT OF SURVEY FILED IN BOOK 2019 AT PAGE 763 IN THE
OFFICE OF THE DALLAS COUNTY, IOWA, RECORDER.
THE PROPERTY IS SUBJECT TO ANY AND ALL EASEMENTS OF RECORD.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance
shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
