AGENDA ITEM: Consideration of approval of a resolution approving the vacation and disposal
of a street or alley pursuant to Iowa Code Sections 354.23 and 364.7 (2022)
[Outlot Y of Clayton Estates Plat 2]

SYNOPSIS INCLUDING PRO & CON: Outlot Y of Clayton Estates Plat 2 was previously platted
and dedicated to the city in 2018. The property is no longer necessary for
street right-of-way because the alignment of 10th Street has shifted further to
the west.
Prairie Village of Iowa, LLC, the developer of the Prairie Village
neighborhood to the west of Outlot Y, submitted an offer to the city to
purchase the property and combine it into their development. The purchase
offer provided is $25,730.00. The offer was based on the per acres basis that
Prairie Village of Iowa, LLC, paid for the adjoining property that they are
developing. In addition to the purchase price, Prairie Village of Iowa, LLC,
will extend Gray Avenue, extend applicable utilities, extend sidewalks, and
dedicate any necessary right-of-way or easement at no cost to the City of
Waukee as part of the agreement.
Notice of the public hearing and purchase offer was sent on March 10, 2022,
to eight (8) adjoining property owners. The letter also provided adjoining
property owners the opportunity to submit an offer greater than $25,730.00. In
addition, the letter notified adjoining owners of their responsibilities as it
would relate to the construction of Gray Avenue, sidewalks, utilities, and
dedication of right-of-way and easements should they submit an offer. No
additional purchase offers have been received from any of the adjoining
property owners.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the vacation and disposal
of Outlot Y of Clayton Estates Plat 2.
RECOMMENDATION: Approve the resolution

APPROVING THE VACATION AND DISPOSAL OF PUBLIC PROPERTY PURSUANT TO
IOWA CODE SECTIONS 354.23 AND 364.7 (2022) [OUTLOT Y, CLAYTON ESTATES PLAT
2]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has previously acquired the public property for purposes of a future street
extension; AND,
WHEREAS, it has been determined that the public property described on attached Exhibit A is of no
benefit to the public and may be vacated, conveyed, and/or otherwise disposed of subject to state code;
AND,
WHEREAS, the City of Waukee established a minimum value of $25,730.00 for the property; AND,
WHEREAS, Prairie Village of Iowa, LLC has submitted an offer to purchase the Oproperty in the
amount of $25,730.00.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 4th day
of April, 2022, that it hereby approves the vacation of Outlot Y of Clayton Estates Plat 2 described on
attached Exhibit A and approves the sale of the property to Prairie Village of Iowa, LLC, in the amount
of $25,730.00.
