AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1
(Agricultural District) to R-1 (Single-Family Residential District)
[Hamilton Ridge Plat 12]
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of
approximately 6.76-acres of property from A-1 to R-1. The property is
located west of Ute Avenue/R-22 and south of Ashworth Road.
The applicant received greater than 50% consent from property owners
within 250-feet of each area proposed to be rezoned. A rezoning sign
was placed on the property and notices were mailed to adjoining property
owners. Staff has not received any correspondence regarding the request.
The concept plan provided shows 7 single-family residential lots to be
developed and two outlots for a total acreage of 6.76-acres. Outlot ‘Y’ is
intended for stormwater detention and Outlot ‘Z’ is intended for
landscape buffer plantings.
Access to the planned lots will be provided with a cul-de-sac off of
Ashworth Road. Parkland dedication requirements are being met with the
overall Hamilton Ridge development.
The subject property is classified as Medium Density Residential in the
Comprehensive Plan. Although the proposed rezoning to R-1, Single-
Family Residential, is not consistent with the Comprehensive Plan, staff
is comfortable with the proposal as it is consistent with the adjacent
properties.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the rezoning request on April 26, 2022, and
recommended approval:
Senior Planner, Melissa DeBoer, presented an outline of the project, as shown in the staff report.
Ms. DeBoer stated the applicant was requesting a rezoning of approximately 6.76-acres from A-1
Agricultural to R-1 Single-Family Residential to accommodate seven (7) single-family lots.

Ms. DeBoer stated that this parcel was originally proposed to be rezoned to R-4 Row Dwelling
and Townhome Residential in 2020 with the overall Hamilton Ridge rezoning project. The
applicant withdrew the application prior to Council hearings.
Ms. DeBoer stated that consent was submitted from 51.16% of property owners within 250-feet
of the property. Notifications were mailed on April 15, 2022 and a sign was placed on the
property prior to the April 18, 2022 deadline.
Ms. DeBoer provided an overview of the concept plan, noting that seven (7) single-family lots
were proposed with two (2) outlots – one outlot for stormwater detention and one outlot for
landscape buffer plantings. A 25-foot landscape buffer will be required along the north side of the
property to screen the properties from Ashworth Road.
Ms. DeBoer stated that while this project isn’t consistent with the Comprehensive Plan, staff is
comfortable with the application as it is consistent with adjacent properties and does recommend
approval of the rezoning request for Hamilton Ridge Plat 12.
No members of the public spoke to this application and the Commissioners had no questions.
Motion was made by Angie Tessau to approve the rezoning. The motion was seconded by Frank
Hoifeldt. On voice vote: All ayes: Motion carries 4-0
STAFF REVIEW AND COMMENT: Staff would recommend approval of the proposed
rezoning request.
RECOMMENDATION: Hold the Public Hearing.

BACKGROUND
The subject property is located west of Ute Avenue/R-22 and south of Ashworth Road. The property is 6.76-acres in
area and is currently vacant land. Originally, this property was proposed to be rezoned to R-4 (Row Dwelling &
Townhome Residential District) with the overall Hamilton Ridge rezoning back in September of 2020. The R-4 zoning
was consistent with what is shown in the Comprehensive Plan. The applicant withdrew the application to rezone this
property with the overall rezoning prior to the City Council hearing. Since then, the applicant has revised their concept
plan for the subject property and is proposing to rezone it to R-1 for single-family residential development.
The applicant has submitted consent from 51.16% of property owners within 250-feet of the property to be rezoned.

COMPREHENSIVE PLAN
The Imagine Waukee 2040: Comprehensive Plan identifies the subject property as Medium Density Residential. Medium
Density Residential is defined as townhome and row home products that are 4 to 12 units per acre in density.
Although the proposed rezoning to R-1, Single-Family Residential, is not consistent with the Comprehensive Plan, staff is
comfortable with the proposal as it is consistent with the adjacent properties.
STAFF RECOMMENDATION
Staff recommends approval of the rezoning for Hamilton Ridge Plat 12.
