HomeMy WebLinkAbout2022-06-06 I01J_03 Hickman Rd and Bershire Pkwy-SE Waco Pl Intersection_Set PHAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: June 6, 2022 AGENDA ITEM:Consideration of approval of a resolution ordering construction of the U.S. (Hickman Road) & Berkshire Parkway/SE Waco Place intersection improvement project and fixing a date for hearing thereon and taking bids therefor FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The project includes all materials, equipment, transportation and labor necessary to lengthen PCC left turn lanes, reconstruct trail and sidewalk ramps, and construct a traffic signal at the intersection of E Hickman Rd and Berkshire Pkwy/SE Waco Pl. This project also includes lengthening/construction PCC left turn lanes and construction of a restrictive median at the E Hickman Rd & SE Brick Dr intersection. Project items include subgrade preparation and treatment, PCC turn lane extension and sidewalk/trail ramp paving, pavement markings, traffic signalization and traffic control. This project is part of the approved FY 2023-27 CIP with a total project budget of $750k. Project schedule is currently set to take bids on June 15, 2022 with report of bids to occur at the July 5, 2022 regular City Council meeting. Resolution PREPARED BY:Beth Richardson REVIEWED BY:Rudy Koester RK PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: I1J3 RESOLUTION 2022- RESOLUTION ORDERING CONSTRUCTION OF THE HICKMAN ROAD (US 6) & BERKSHIRE PKWY/SE WACO PL INTERSECTION PROJECT, AND RATIFYING, CONFIRMING AND APPROVING DEADLINE FOR SUBMISSION OF BIDS AND FIXING A DATE FOR HEARING THEREFOR WHEREAS, it is deemed advisable and necessary to construct certain public improvements described in general as the Hickman Road (US 6) & Berkshire Pkwy/SE Waco Pl Intersection Project; and WHEREAS, pursuant to an Intergovernmental Agreement between the Cities of Clive and Waukee, Iowa, it is deemed beneficial to jointly undertake a public improvement project involving improvements at the intersection of US 6 (Hickman Road) and Berkshire Parkway/SE Waco Place; and WHEREAS, the City of Clive will serve as the lead agency for the Project and will enter into the construction contract for the Project; and WHEREAS, the Cities of Clive and Waukee have agreed to divide the actual construction costs of the Project equally as shown in Exhibit B to the Intergovernmental Agreement; and WHEREAS, the City of Clive has caused to be prepared plans, specifications and form of contract, together with estimate of cost, which are now on file in the Office of the Waukee City Clerk for public inspection, for the construction of the public improvements; and WHEREAS, the plans, specifications and form of contract are deemed suitable for the making of the public improvements; and WHEREAS, final grades have been established by ordinance, consistent with the plans for all street improvements included in the proposed construction; and WHEREAS, before the plans, specifications, form of contract and estimate of cost may be adopted, and a contract for the construction of the public improvements is entered into, it is necessary, pursuant to Chapter 26, Code of Iowa, to hold a public hearing and to advertise for bids; and WHEREAS, on or about June 2, 2022, a Notice to Bidders was posted on a relevant contractor plan room service with statewide circulation and a relevant construction lead generating service with statewide circulation establishing 2:00 P.M. on June 15, 2022 as the deadline for submission of bids; and WHEREAS, on June 1, 2022, the City Clerk posted the Notice to Bidders on the City of Waukee’s website, which is an internet site sponsored by the City of Waukee. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WAUKEE, STATE OF IOWA: Section 1.That it is hereby determined that it is necessary and advisable to construct certain public improvements described in general as the Hickman Road (US 6) & Berkshire Pkwy/SE Waco Pl Intersection Project, in the manner set forth in the plans and specifications and form of contract, above referred to, the cost thereof to be paid in accordance with the provisions as set out in the posted Notice to Bidders and published Notice of Public Hearing; the public improvements being more generally described as follows: This project includes all materials, equipment, transportation and labor necessary to lengthen PCC left turn lanes, reconstruct trail and sidewalk ramps, and construct a traffic signal at the intersection. Project items include subgrade preparation and treatment, PCC turn lane extension and sidewalk/trail ramp paving, pavement markings, traffic signalization and traffic control. Specific project location along with the kind and approximate quantity of materials to be used shall be as set forth in the Plans and Specifications. Section 2.That the amount of the bid security to accompany each bid shall be in an amount which shall conform to the provisions of the notice to bidders approved as a part of the specifications. Section 3.That the actions of the City Clerk of the City of Clive in posting a Notice to Bidders once in a relevant contractor plan room service with statewide circulation and a relevant construction lead generating service with statewide circulation, are hereby ratified, confirmed, and approved. Section 4.That the actions of the City Clerk of the City of Waukee in posting the Notice to Bidders on an internet site sponsored by either the City or a statewide association that represents the City, , are hereby ratified, confirmed, and approved. Section 5. That the actions of the City of Clive in setting a date for the receipt of bids before 2:00 P.M. on June 15, 2022 are hereby ratified, confirmed, and approved. Section 6.That the City Council hereby delegates to the designated representative for the City of Clive, as determined by the City Council of the City of Clive, the duty of receiving, opening and tabulating bids for construction of the Project. Bids shall be received and opened as provided in the public notice and the results of the bids shall be considered at the meeting of this Council on July 5, 2022, at 5:30 P.M. Section 7.That the City Clerk be and is hereby directed to publish notice of hearing once in a legal newspaper, printed wholly in the English language, published at least once weekly and having general circulation in this City. Publication shall be not less than four clear days nor more than twenty days prior to the date hereinafter fixed as the date for a public hearing on the plans, specifications, form of contract and estimate of costs for the project, the hearing to be at 5:30 P.M. on July 5, 2022. Sealed bids for the work comprising each improvement as stated below must be filed before 2:00 p.m. on June 15, 2022 in the office of the City Clerk, Clive City Hall, 1900 NW 114th Street, Clive, Iowa 50325-7077 Time and Place Sealed Proposals Will be Opened and Considered. Sealed proposals will be opened and bids tabulated at 2:00 p.m. on June 15, 2022, in the Council Chambers of the Clive City Hall, 1900 NW 114th Street, Clive, Iowa, for consideration by the Clive City Council at its meeting at 6:00 p.m. on June 23, 2022. Bids will be presented for consideration by the Waukee City Council at its meeting at 5:30 p.m. in the Council Chambers of the Waukee City Hall, at 230 Hickman Road, Waukee, Iowa on July 5, 2022. The City of Clive and City of Waukee reserve the right to reject any and all bids. The City of Clive in accordance with Title VI of the Civil Rights Act of 1964, Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age, or disability in consideration for award. Time for Commencement and Completion of Work. Work on the improvements shall commence on or before the late start date of April 1, 2023. Work shall be fully completed on or before August 1, 2023. Liquidated damages for noncompliance with said completion provisions will be assessed at the rate of Five Hundred Dollars ($500.00) for each calendar day thereafter that the work remains incomplete. Bid Security. Each bidder shall accompany its bid with bid security as defined in Section 26.8 of the Iowa Code and as outlined in the Instruction to Bidders in an amount equal to Ten (10) percent of the total bid amount. Contract Documents. Copies of the contract documents are available from the Public Works Department, may be examined at the Public Works Facility, 2123 NW 111th Street, Clive, Iowa or received electronically by emailing Jim Hagelie (jhagelie@cityofclive.com). Public Hearing on Proposed Contract Documents and Estimated Costs for Improvement. A public hearing will be held by the Clive City Council on the proposed contract documents (plans, specifications and form of contract) and estimated cost for the improvements, as bid by the selected bidder, at its meeting at 6:00 pm on June 23, 2022, in said Council Chambers of the City Hall, 1900 NW 114th Street, Clive, Iowa. A public hearing will be held by the Waukee City Council on the proposed contract documents (plans, specifications and form of contract) and estimated cost for the improvements, as bid by the selected bidder, at its meeting at 5:30 pm on July 5, 2022, in said Council Chambers of the City Hall, 230 Hickman Road, Waukee, Iowa. Preference shall be given to domestic construction materials by the contractor, subcontractors, material, men and suppliers in performance of the contract and, further, by virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes. Resident Bidder Preference Law. Iowa Code 73A.21 outlines the reciprocal resident bidder and labor force preference statute. The Iowa Department of Labor (DOL) has adopted administrative rules to enforce this law. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected. Sales Tax. The bidder shall not include sales tax in the bid. The City of Clive will distribute tax exemption certificates and authorization letters to the Contractor and all Subcontractors who are identified. The Contractor and Subcontractors may make copies of the tax exemption certificates and provide a copy to each supplier providing construction materials. These tax exemption certificates and authorization letters are applicable only for this specific project under the Contract. General Nature of Public Improvement. This project includes all materials, equipment, transportation and labor necessary to lengthen PCC left turn lanes, reconstruct trail and sidewalk ramps, and construct a traffic signal at the intersection.
