Painted Woods West Plat 4
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a final plat
for a 15.05-acre single family residential subdivision. The property is
located north of Indian Ridge Drive west of R-22/Ute Ave. The final plat
identifies the creation of 28 single family lots. All lots meet or exceed the
minimum requirements of the R-2 zoning district.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on October 26,
2021, recommended approval subject to remaining staff comments:
Approval of a Final Plat for Painted Woods West Plat 4
Planning Coordinator, Andy Kass, introduced the request for approval of a final plat for a
residential subdivision as submitted by the applicant, Painted Woods Development, LLC. The
subject property is generally located west of R-22/Ute Ave and north of Interstate 80, containing
approximately 15.05 acres. This is the final phase of the Painted Woods West development.
Mr. Kass advised that the final plat identifies a total of 28 lots zoned R-2 (One & Two Family
Residential) and ranging in size from 10,921 square feet to 37,216 square feet in area. Public
utilities have been extended throughout the plat and storm water detention is provided for in the
existing detention ponds that exist to the south and east within the first two phases of the
development. The ponds are owned and maintained by the Homeowner’s Association. Parkland
dedication was satisfied with Plat 3 of the development.
At this time staff would recommend approval of the final plat subject to remaining staff
comments, completion of any outstanding public improvements, and review of the legal
documents.
Commissioner Hoifeldt questioned if there was anything planned to the west. Mr. Kass
advised that Kimberly Development has purchased that property, however there have not
been any submittals for projects at this time.

Commissioner Hoifeldt questioned if the commercial piece in the SE corner will continue
the current road access. Mr. Kass advised that when the property to the south is
developed then the road will be extended further to the west. There are no commercial
projects for this parcel at this time.
Commissioner Hoifeldt questioned if Staff was comfortable with the single access point.
Mr. Kass advised that secondary access is planned with future development.
Commissioner Broderick questioned if this development would have a signaled
intersection off of Ute Avenue. Mr. Kass advised that he was unsure if one could be
installed. The DOT would need to be consulted in this area due to proximity to the
Highway. However, the R-22/Ute Ave corridor will need to be addressed in the future. At
the moment it is part of the 10 year plan, however the Capital Improvements Project list
is revised every year and with the increase in development in the area, it is possible that
the area can see improvements earlier.
Commissioner Streit questioned if there was a flood plain on any of the lots of the
development. Mr. Kass advised that there is a creek nearby however, none of the lots are
effected by a flood plain.
Commissioner Streit moved to approve a final plat for Painted Woods West Plat 4 subject to any
remaining staff comments, review of the legal documents, and completion of public
improvements. Commissioner Hoifeldt seconded the motion. Ayes: Streit, Hoifeldt, Ward, and
Broderick. Nays: none. Motion Carried.
STAFF REVIEW AND COMMENT: Staff’s position is that the proposed final plat meets the
intent and the requirements of the Zoning Ordinance and the Waukee
Subdivision Ordinance.
RECOMMENDATION: Staff recommends approval of the Final Plat for Painted Woods West
Plat 4.

APPROVING THE FINAL PLAT FOR PAINTED WOODS WEST PLAT 4
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, PAINTED WOODS DEVELOPMENT, LC, has requested final plat approval of Painted
Woods West Plat 4 (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on October 26, 2021, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Painted Woods West Plat 4 and the documents relating thereto will
comply with section §176 – Subdivision Regulations of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
6th day of June, 2022, that the Final Plat for Painted Woods West Plat 4 be and the same is hereby
accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:
1. Warranty Deed (Lot K)
2. Snow Storage Easement;
3. Water Main Easement;
4. Storm Sewer Easement;
5. Overland Flowage Easement;
6. Public Utility Easement;
7. Sanitary Sewer Easement;
8. Public Access and Recreational Trail Easement; and
9. Public Storm Water Detention Easement

HISTORY
This plat is the third phase of the Painted Woods West development. Over the course of the first three phases a total
of 148 single family lots have been platted. The preliminary plat identified a total of 179 single family residential lots. This
is the final phase of the Painted Woods West development.
PROJECT DESCRIPTION
LOTS
The final plat identifies a total of 28 lots for single family residential development. The lots are zoned R-2 (One & Two
Family Residential) and are subject to the bulk regulations included in Table 1 below. The lots range in size from 10,921
square feet to 37,216 square feet in area. All lots meet or exceed the minimum width of 65-feet. All lots meet the
minimum 110-feet depth requirement.

STREETS AND TRAIL
As part of the public improvements the developer is in the process of constructing extensions of Fieldstone Drive and
Hemlock Lane. Five-foot-wide sidewalks will be constructed as part of each lot development.

UTILITIES
Utilities have been extended throughout the plat. Each lot will be served by public water, sanitary sewer, and storm
sewer. Storm water detention is provided for in existing detention ponds that were constructed to the south and east
with the first two phases of the development. These ponds are owned and maintained by the homeowner’s association.
PARKLAND
Parkland dedication was satisfied previously in Painted Woods West Plat 3.
STAFF RECOMMENDATION
The final plat is in conformance with the Zoning Ordinance, Subdivision Ordinance, and Comprehensive Plan. All lots
meet or exceed the minimum bulk regulations. The required public improvements are currently under construction, and
the required parkland is being dedicated to the City by the developer. Staff recommends approval of the final plat for
Painted Woods West Plat 4 subject to remaining staff comments, review of the legal documents, and completion of
public improvements.
