SYNOPSIS INCLUDING PRO & CON:This project includes all materials, equipment,
transportation and labor necessary to lengthen PCC left turn lanes, reconstruct trail and sidewalk
ramps, and construct a traffic signal at the intersection. Project also includes
lengthening/construction of PCC left turn lanes and construction of a restrictive median at the
Hickman Road & SE Brick Dr intersection. Project items include subgrade preparation and
treatment, PCC turn lane extension and sidewalk/trail ramp paving, pavement markings, traffic
signalization, and traffic control.
This project is included in the approved FY 2023-2027 Capital Improvements Plan with a total
project budget of $750K. This project has also received a $400K U-STEP grant from the Iowa
DOT for construction expense reimbursements up to the $400K dollar amount. The U-STEP
grant program has a 55/45 State/Local funding split requirement. All work on the project shall be
completed by August 1, 2023.

NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING
CITY OF CLIVE AND CITY OF WAUKEE
HICKMAN ROAD (US 6) & BERKSHIRE PKWY/SE WACO PL INTERSECTION PROJECT
Time and Place for Filing Sealed Proposals. Sealed bids for the work comprising each improvement as
stated below must be filed before 2:00 p.m. on July 20, 2022 in the office of the City Clerk, Clive City Hall,
1900 NW 114th Street, Clive, Iowa 50325-7077
Time and Place Sealed Proposals Will be Opened and Considered. Sealed proposals will be opened and
bids tabulated at 2:00 p.m. on July 20, 2022, in the Council Chambers of the Clive City Hall, 1900 NW
114th Street, Clive, Iowa, for consideration by the Clive City Council at its meeting at 6:00 p.m. on July 28,
2022. Bids will be presented for consideration by the Waukee City Council at its meeting at 5:30 p.m. in the
Council Chambers of the Waukee City Hall, at 230 Hickman Road, Waukee, Iowa on August 1, 2022. The
City of Clive and City of Waukee reserve the right to reject any and all bids.
The City of Clive in accordance with Title VI of the Civil Rights Act of 1964, Stat. 252, 42 U.S.C. 2000d to
2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the
Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Department of Transportation
issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract
entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to
submit bids in response to this invitation and will not be discriminated against on the grounds of race, color,
national origin, sex, age, or disability in consideration for award.
Time for Commencement and Completion of Work. Work on the improvements shall commence on or
before the late start date of April 1, 2023. Work shall be fully completed on or before August 1, 2023.
Liquidated damages for noncompliance with said completion provisions will be assessed at the rate of
Five Hundred Dollars ($500.00) for each calendar day thereafter that the work remains incomplete.
Bid Security. Each bidder shall accompany its bid with bid security as defined in Section 26.8 of the
Iowa Code and as outlined in the Instruction to Bidders in an amount equal to Ten (10) percent of the total
bid amount.
Contract Documents. Copies of the contract documents are available from the Public Works
Department, may be examined at the Public Works Facility, 2123 NW 111th Street, Clive, Iowa or received
electronically by emailing Jim Hagelie (jhagelie@cityofclive.com). Copies shall be available at no cost.

Public Hearing on Proposed Contract Documents and Estimated Costs for Improvement. A public
hearing will be held by the Clive City Council on the proposed contract documents (plans, specifications
and form of contract) and estimated cost for the improvements, as bid by the selected bidder, at its meeting
at 6:00 pm on July 28, 2022, in said Council Chambers of the City Hall, 1900 NW 114th Street, Clive, Iowa.
A public hearing will be held by the Waukee City Council on the proposed contract documents (plans,
specifications and form of contract) and estimated cost for the improvements, as bid by the selected bidder,
at its meeting at 5:30 pm on August 1, 2022, in said Council Chambers of the City Hall, 230 Hickman Road,
Waukee, Iowa.
Preference of Products and Labor. Preference shall be given to domestic construction materials by the
contractor, subcontractors, material, men and suppliers in performance of the contract and, further, by virtue
of statutory authority, preference will be given to products and provisions grown and coal produced within
the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes.
Resident Bidder Preference Law. Iowa Code 73A.21 outlines the reciprocal resident bidder and labor
force preference statute. The Iowa Department of Labor (DOL) has adopted administrative rules to enforce
this law. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being
deemed nonresponsive and rejected.
Sales Tax. The bidder shall not include sales tax in the bid. The City of Clive will distribute tax
exemption certificates and authorization letters to the Contractor and all Subcontractors who are identified.
The Contractor and Subcontractors may make copies of the tax exemption certificates and provide a copy to
each supplier providing construction materials. These tax exemption certificates and authorization letters are
applicable only for this specific project under the Contract.

traffic signal at the intersection. Project also includes lengthening/construction PCC left turn lanes and
construction of a restrictive median at the Hickman Road & SE Brick Dr intersection. Project items include
subgrade preparation and treatment, PCC turn lane extension and sidewalk/trail ramp paving, pavement
markings, traffic signalization and traffic control. Specific project location along with the kind and
approximate quantity of materials to be used shall be as set forth in the Plans and Specifications.
This notice is given by authority of the Cities of Clive and Waukee.
