Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent: None. Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Finance Director Linda Burkhart, Human Resources Director Michelle Lindsay, Public Works Director/City Engineer Rudy Koester, Community Development Director Andy Kass, Director of Economic Development Jennifer Brown, Director of Marketing & Communications Heather Behrens (electronically), IT Director Son Le, Police Lt. Jeremy Long, Police Officer Nick Gilcrist, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. (F) Monthly Mayor’s Report – Mayor Clarke stated that she and council members attended the Jul. 19 All-City Staff Year-End Celebration luncheon to thank staff for their hard work during the past year; Aug. 2 is Public Safety Day; there is still time to register for the Aug. 6 Battle of the ‘Burbs run. (G) Presentations: 1) Denman & Company on upcoming FY2022 audit – Presentation made by David Ellis with Denman & Company as required by GASB regulations. Auditor Joe Sparks was also in attendance. (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1/PD-1 and C-1A/PD-1 to C-1/PD-1, a parcel to be known as Waukee Towne Center – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass presented on the rezoning application for an approximately 48-acre parcel. The applicant received approximately 54% consent from adjacent property owners. Mr. Kass presented a development concept plan for a 300,000-square-foot retail shopping center with outlots along the Alice’s Road Corridor. A large pond will address stormwater management. The pond area will include recreational trail, an amphitheater and play areas. Mr. Kass noted a landscape buffer requirement between the subject parcel and adjacent residential areas. He discussed site ingress and egress, including possible access at the stoplight to the north of the property at Hickman Rd. The planned development overlay addresses off-site signage. The proposal fits with the Comprehensive Development Plan designation of the property for community commercial development. No comments were made by the public in attendance. 2) On the intent to commence a public improvement project known as West Area Trunk Sewer Extension Phase 2 Project – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Public Works Director/City Engineer Koester briefly reviewed the project, noting that the construction contract has previously been awarded. There are certain property owners with whom the City continues to negotiate in good faith, but in order to proceed with the project as scheduled, City staff recommends authorizing the use of eminent domain if necessary. No comments were made by the public in attendance. I1B 2 3) On plans, specifications, form of contract and estimate of cost [U.S. 6 (Hickman Road) & Berkshire Parkway/SE Waco Place Intersection Improvements Project] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Public Works Director/City Engineer Koester briefly reviewed the project, which includes traffic signalization at the subject intersection, as well as certain improvements to the Hickman Rd./SE Brick Dr. intersection. It is a joint project, with the City of Clive acting as lead agency. A $400,000 U-STEP grant was awarded toward the project to help offset costs. The project is scheduled for completion in August 2023; the City of Clive has already awarded the construction contract for the project. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1/PD-1 and C- 1A/PD-1 to C-1/PD-1, a parcel to be known as Waukee Towne Center [introduction; first reading] – Council Member Crone introduced the ordinance in title only and moved to approve the first reading in title only; seconded by Council Member Pierce. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. 2) Resolution: Consideration of approval of a resolution approving and authorizing a public improvement project to construct the West Area Trunk Sewer Extension Phase 2 Project, funding of final site-specific design, final route/site selection, to acquire land for the project by purchase and, if necessary, to authorize the use and acquisition of property by eminent domain – Council Member Lyon moved to approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2022-322) 2) U.S. 6 (Hickman Road) & Berkshire Parkway/SE Waco Place Intersection Improvements Project A. Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost – Council Member Lyon moved to approve the resolution; seconded by Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2022-323) B. Resolution: Consideration of approval of a resolution consenting to the City of Clive’s making award of construction contract – Council Member Crone moved to approve the resolution; seconded by Council Member Sinclair. Public Works Director/City Engineer Koester reviewed the bid tabulation, noting that the low bid was greater than the engineer’s estimate. The U-STEP grant funding and CIP budgeting will help with the overage costs. Mr. Koester recommended consenting to award of contract to Minturn, Inc., of Brooklyn, IA, in the amount of $1,398,084.95. Council Member Bottenberg asked how the project costs would be split between Waukee and Clive; Mr. Koester reviewed the percentages. Mayor Clarke voiced her support for the project moving forward, citing the current difficulty in crossing Hickman Rd. at the subject intersections. Council Member Lyon asked which municipality would program the traffic signal; Mr. Koester responded that it was Clive’s responsibility to do so. Council Member Sinclair wondered if Clive’s adaptive traffic signal system would synchronize with Waukee’s signals; Mr. Koester replied in the negative, noting that such signals are programmed to update timing based on individual traffic patterns. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. The contract was awarded to Minturn, Inc., of Brooklyn, IA.
