September 6, 2022
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent:
None.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Finance Director Linda Burkhart, Human Resources Director Michelle Lindsay, Public Works
Director/City Engineer Rudy Koester, Community Development Director Andy Kass, Director of
Economic Development Jennifer Brown, Director of Marketing & Communications Heather
Behrens, Police Chief John Quinn, Police Sgt. Brandon Pettit, City Clerk Rebecca D. Schuett,
City Attorney Steve Brick.

(E) Agenda Approval – Council Member Bottenberg moved to approve the agenda; seconded by
Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.
Nays: None. Motion carried 5 – 0.
(F) Monthly Mayor’s Report – Mayor Clarke will take part in the Sept. 8 Waukee Area Chamber of
Commerce Economic Development Bus Tour and the Sept. 11 renaming ceremony for the
Danny White Waukee VFW Post #11517. Registration is now open for programs listed in the
Fall/Winter Parks & Recreation guide.

(H) Public Hearings:
1) On a State Revolving Fund (SRF) Environmental Information Document for the City of
Waukee NE Outfall Sewer Project – Mayor Clarke opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied that none had
been received in the clerk’s office. Public Works Director/City Engineer Koester noted that
the public hearing was required as part of the SRF funding process. The NE Outfall Sewer
Project runs through Waukee, Clive and Urbandale and includes the decommissioning of Lift
Station No. 7 via gravity sewer that will connect with the WRA Grimes Connector Sewer
currently under construction. No comments were made by the public in attendance.
2) On a proposal to enter into a Development Agreement with TIC Properties, LLC –
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied that none had been received in the clerk’s office.
Director of Economic Development Brown reviewed the incentives and reimbursements
specified in the agreement for the construction of a multi-specialty medical clinic and surgery
center. No comments were made by the public in attendance.
3) On plans, specifications, form of contract and estimate of cost [Waukee City Hall
Security Upgrades Project] – Mayor Clarke opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied that none had been
received in the clerk’s office. City Administrator Deets briefly reviewed the project. No
comments were made by the public in attendance.
(I) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and between the City of Waukee and TIC
Properties, LLC – Council Member Lyon moved to approve the resolution; seconded by
Council Member Sinclair. Director of Economic Development Brown noted that the
agreement was consistent with the City’s development incentives policy. Results of vote:

2) Waukee City Hall Security Upgrades Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Lyon. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Crone.
City Administrator Deets reviewed the bid tabulation, recommending award to low bidder
Bergstrom Construction, Inc., of Des Moines, IA, in the amount of $194,000.00. Council
Member Lyon asked about possible inconveniences to City Hall staff during project
construction; Mr. Deets reviewed possible impacts and how they might be mitigated.
Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion
carried 5 – 0. Contract awarded to Bergstrom Construction, Inc., of Des Moines, IA.

2) Ordinance: Consideration of approval of an ordinance amending Chapter 75, Waukee
Municipal Code, regarding the use of all-terrain vehicles and off-road utility vehicles
within the city [introduction; first reading]– Council Member Crone introduced the
ordinance and moved to approve the first reading in title only; seconded by Council Member
Pierce. City Attorney Brick noted that recent state legislation regarding the operation of off-
road and all-terrain vehicles requires clarification within Waukee Municipal Code, which
currently does not allow the operation of such vehicles on City streets. The proposed
ordinance clarifies that prohibition. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce,

3) Ordinance: Consideration of approval of an ordinance amending Code of Ordinances
of the City of Waukee, Iowa, by amending provisions within Chapter 104, Regulation
of Industrial Wastewater, Commercial Wastewater and Hauled Waste [second, third
(final) readings] – Council Member Sinclair moved to approve the second reading of the
ordinance in title only, waive the third reading and place the ordinance on final passage;
seconded by Council Member Crone. Public Works Director/City Engineer Koester
recommended waiving the third reading, as there have been no public comments on the

Fee Schedule, Revision No. 2 – Council Member Crone moved to approve the resolution;

that the fee schedule revision added administrative fees and penalties noted in the

reviewed the proposed site plan for an addition to the NW side of the building. He noted an
outdoor courtyard between the existing building and proposed addition, then discussed

7) Resolution: Consideration of approval of a resolution approving final plat for Autumn

8) IA Waukee NW 2nd/Waukee Crossing Plat 5
A. Resolution: Consideration of approval of a resolution approving preliminary plat –
Council Member Sinclair moved to approve the resolution; seconded by Council Member
Lyon. Community Development Director Kass reviewed the preliminary plat, final plat
and site plan. The plats include three lots, with one lot currently proposed for
development of a 4-story apartment building with one- and two-bedroom units, as well as
a limited number of studio apartments. The site includes a clubhouse, maintenance
building and internal courtyard. Mr. Kass reviewed site ingress/egress, parking and
separate garage units, landscape buffering and exterior building elevations. Council
Member Sinclair noted garage doors on the main building and asked if there were
attached garages; Mr. Kass replied in the affirmative. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2022-

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Clarke
at 5:36 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles
Bottenberg, Anna Bergman Pierce, Ben Sinclair. Absent: Council Members Chris Crone, Larry R.
Lyon.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Finance
Director Linda Burkhart, Community Development Director Andy Kass, Director of Economic
Development Jennifer Brown, Parks & Recreation Director Matt Jermier, City Clerk Rebecca D.

E. Work Session:
1) FY2022-2023 Strategic Plan: Economic development quarterly report – Director of Economic
Development Brown reviewed the department’s progress with goals such as business retention
and expansion, marketing and promotion, market studies and partnerships. She also discussed
economic development challenges and upcoming activities.
2) Tax Increment Finance and Urban Renewal Plan updates review – Director of Economic
Development Brown and City Administrator Deets briefly reviewed the proposed updates and
amendments.
3) RAGBRAI 2023 interest – Parks & Recreation Director Jermier reviewed the RAGBRAI
application process and requirements. After some discussion, the council directed City staff to
apply for consideration as a 2023 route city.
4) Bird Scooter update – Parks & Recreation Director Jermier noted that the scooters are not
currently operating in Waukee due to Bird Scooter staffing/personnel issues but might return
before the end of the current season. After much discussion, the council agreed to re-evaluate the
program in the late fall.
5) University Avenue sidewalk snow removal policy – City Administrator Deets reviewed the
matter with council and proposed a policy to remove snow for impacted owners when the National
Weather Service indicates any snowfall greater than 2 inches. If less snow accumulates, the
property owners shall be responsible for removal.
6) Upcoming fiscal year contributions to City partners – City Clerk Schuett briefly reviewed the
contributions policy and timeline, as well as those contributions approved in the last few budget
cycles.

G. Comments – Parks & Recreation Director Jermier updated the council on Triumph Park ball field
conditions following weekend rains.
