Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Council Members R. Charles Bottenberg, Chris Crone, Larry R. Lyon (electronically), Anna Bergman Pierce, Ben Sinclair (electronically). Absent: Mayor Courtney Clarke. Also in attendance: City Administrator Brad Deets (electronically), Assistant City Administrator Nick Osborne (electronically), Finance Director Linda Burkhart, Public Works Director/City Engineer Rudy Koester, Community Development Director Andy Kass, Human Resources Director Michelle Lindsay, Director of Economic Development Jennifer Brown, IT Director Son Le (electronically), Police Chief John Quinn, Police Officer Corby Robbins, City Clerk Rebecca D. Schuett, City Attorney Patrick Burk. (D) Open Forum – Rich Martin, 413 NE Brookridge Cir., spoke on behalf of his homeowners association as president. He stated that the builder was not very forthcoming about HOA maintenance responsibilities, noting that they are not part of the City’s street sweeping, main flushing, sewer camera or snow removal services. Mr. Martin asked the City to reevaluate the snow removal, adding that the HOA can push the snow to the end of the cul-de-sac if the City is amenable to removing the pile. Council Member Bottenberg stated that it was likely a private street but that the council would look into the matter; Council Member Pierce added that the documents approved when establishing the HOA should be reviewed. (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Pierce. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. (F) Presentations: None (G) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-4, R-3 and R-4 to K-RR and K-MF-Stacked High/PD-1, a property to be known as Kettlestone Central North – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office but referenced a letter in opposition to the rezoning that was included in the packet documentation. Community Development Director Kass briefly reviewed the rezoning application for approximately 99 acres. The applicant received 50% consent from adjacent property owners. Mr. Kass added that the City received a letter from a West Des Moines resident opposing the rezoning; the letter was included in the packet documentation. Mr. Kass reviewed the different zoning districts proposed and their allowable uses, noting that the area proposed for multi-family development was already zoned for such a use. He shared a concept development plan, adding that specific uses must go through the site plan approval process. The concept plan includes indoor sport courts, in addition to multi-family development. The planned development overlay allows for the development of 26 residential units per acre instead of the standard 24 units per acre. The proposed K-MF-Stacked High underlying zoning allows for buildings up to 5 stories but the developer has stated they plan to construct buildings no higher than 3 stories. Mr. Kass reviewed the landscape buffering requirements, public improvements and street extensions. Council Member Crone asked if the multi-family district could be limited to a 3-story maximum; Mr. Kass replied that such a restriction could be included as part of the planned development overlay if the developer was amenable to the change. Erin Ollendike with Civil Design Advantage (CDA), addressed the council on behalf J1B 2 of the developer, stating that she was in attendance to answer any questions. Council Member Sinclair asked if the council could consider building height limitations during the site plan approval process; Mr. Kass replied that it would give the developer clearer direction to include such restrictions in the planned development overlay. Council Member Pierce agreed that those conversation should happen at this point in development. Council Member Bottenberg added that the allowable maximum density would naturally limit the number of stories for a multi-family development but he saw no reason not to include such limits in the planned development overlay. No comments were made by the public in attendance. 2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-4, R-4 and A-1 to K-RC, K-MU and K-MF-Stacked Med, a property to be known as Kettlestone Central South – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass briefly reviewed the rezoning application for an approximately 60-acre parcel. The applicant received 65% consent from adjacent property owners. Mr. Kass reviewed the different zoning districts proposed and their allowable uses. A concept development plan shows commercial, mixed use and townhome development. He reviewed the landscape buffer requirements, public improvements and street extensions. Nick Jensen with applicant Caliber Iowa introduced himself to the council in the event of questions. No comments were made by the public in attendance. 3) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R-2/PD-1, R-3 and R-4, a property to be known as The South 60 – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass briefly reviewed the rezoning application for 65 acres. He noted that the applicant was unable to obtain the minimum 50% consent from adjacent property owners, as two larger property owners (Apple and Redwood) chose to remain neutral in the matter, and two other property owners (City of Waukee and Dallas County) are ineligible to consent to the application. Mr. Kass reviewed a concept development plan, noting that the planned development overlay allowed for smaller single family lots that would be no less than 7,200 square feet. The developer has indicated that the multi-family development would be owner-occupied. Parkland dedication includes a 4-acre parcel and trail connections. The proposal is consistent with the Northwest Neighborhood Master Plan. Council Member Sinclair asked if the townhomes would be rentals; Mr. Kass replied that they would be owner-occupied. Council Member Crone expressed concern that the City appears to relax a lot of standards through planned development overlays; Council Member Bottenberg replied that the council’s strategic plan included encouraging the development of more affordable, smaller lots. Mr. Kass stated that the Northwest Neighborhood Master Plan encouraged “life cycle” housing options, noting that the proposed 7,200-square-foot lots were larger than has been requested as part of other planned development overlays. Council Member Lyon asked if the council was even allowed to approve a rezoning application without the minimum 50% consent from adjacent property owners; Mr. Kass replied in the affirmative, reiterating that four of the larger adjacent property owners either were ineligible to consent or chose to remain neutral. City Administrator Deets, participating electronically, briefly reviewed the rezoning approval process, including provisions that a petition against a rezoning application from at least 20% adjacent property owners would require a 4/5 vote by council to approve the rezoning. Council Member Sinclair requested a future work session discussion on lot size reductions. Jennifer Ellison with applicant Jerry’s Homes addressed the council, stating that they believe their proposal meets the development goals of the Northwest Neighborhood Master Plan. Mayor Pro Tem Bottenberg asked for public comment: 1) Matt Templeman, 27166 S Ave., stated that while his property was not within City limits, he was concerned with how the proposed development might contradict Dallas County plans to maintain high-value agricultural land. He asked about the City’s vision for maintaining open spaces that keep 3 quality of life, then questioned if there was a traffic plan for the area in light of the limited egress from the proposed development. He also expressed concern that smaller lot sizes may lead to long-term property decline. Council Member Bottenberg explained that the Northwest Neighborhood Master Plan included a large pond, trails and smaller parks to provide “quality of life” amenities in the area. Mr. Kass briefly reviewed development plans for the overall area, including property acquisitions by the City to develop drainage retention at the Walnut Creek headwaters and strategic trail connections. Council Member Pierce agreed that traffic was a concern but that T Ave. improvements are planned. She added that the City and Dallas County work together but that both entities have different priorities. Council Member Crone stated that it was important to the council to support greenspace development and sustainability. Ms. Ellison addressed the council a second time to clarify that some of the multi-family units would be rentals and not owner-occupied, but that the market would dictate those numbers. 4) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from R-3 to R-2, a property known as Fox Creek Meadows – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass briefly reviewed the rezoning application for 2.4 acres of two-family attached development. The applicant received 50% consent from adjacent property owners. Jared Murray with Civil Design Advantage (CDA), participating electronically, addressed the council in the event of any questions. No comments were made by the public in attendance.
