HomeMy WebLinkAbout2022-10-03 J05 Special Speed Zones Ordinance_INTRO, 1ST READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 3, 2022 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 63, Speed Regulations, by amending Section 63.03, Special Speed Zones [introduction; first reading] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: City of Waukee and City of Clive staff have agreed to update the posted speed limit on 142nd Street from 40 MPH to 35 MPH. This update is the result of recent traffic data collected along the corridor and to promote pedestrian safety as Clive had completed pedestrian crossing improvements along the corridor. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: RECOMMENDATION: Approve the introduction and first reading of the ordinance in title only. AN ORDINANCE TO AMEND CHAPTER 63, SPEED REGULATIONS, CITY OF WAUKEE, IOWA, BY AMENDING SECTION 63.03, SPECIAL SPEED ZONES, AS SPECIFIED BELOW WHEREAS, the City of Waukee has determined that amendments to certain public streets should be added to the special speed zones ordinance. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 63, Waukee Municipal Code, Section 63.03, Special Speed Zones, subsection 6. Special 40 MPH Speed Zones, subsection A. is hereby removed and the following paragraph is added to Section 63.03, subsection 5. Special 35 MPH Speed Zones as follows: §63.03(5) Special 35 MPH Speed Zones Q. 142nd Street, from the northern City limits to a point 45 feet south of the middle of the intersection of 142nd Street and SE Place D’Avray, also the south limits. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
