October 3, 2022
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg, Chris Crone, Larry R. Lyon (electronically), Anna Bergman Pierce
(electronically), Ben Sinclair. Absent: None.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Community Development Director Andy Kass, Finance Director Linda Burkhart, Parks &
Recreation Director Matt Jermier, Public Works Director/City Engineer Rudy Koester, Director of
Community Development Jennifer Brown, Human Resources Director Michelle Lindsay, Director
of Marketing & Communications Heather Behrens, Police Chief John Quinn, Police Sgt. Brandon
Pettit, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.
(D) Open Forum – Robert Greenway, 1901 Locust St. in Granger, stated that many Dallas County
city councils have not reduced tax levies and that he was getting additional assessment
information from the county assessor. Mayor Clarke noted that Waukee has reduced the tax
levy.
(E) Agenda Approval – Council Member Bottenberg moved to approve the agenda; seconded by
Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.
Nays: None. Motion carried 5 – 0.
(F) Monthly Mayor’s Report – Mayor Clarke noted an Oct. 20 open house reception for police
chief candidates. She then reviewed upcoming Halloween events, such as the Oct. 23 Public
Safety Open House and the Oct. 30 Beggars’ Night. LIHEAP applications are now being
accepted for eligible households.

(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to R-2, R-2/PD-1, R-3, R-4 and C-1, a property to be
known as Remington Pointe – Mayor Clarke opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied that none had been
received in the clerk’s office. Community Development Director Kass reviewed the
application for approximately 76.5 acres. The applicant received consent from property
owners of approximately 50% of the surrounding property. Mr. Kass reviewed the separate
proposed zoning districts, noting that the planned development overlay would allow 23
smaller lots in exchange for certain landscaping and architectural requirements. He
discussed street extensions, including improvements to University Ave. The application is
consistent with the City’s Comprehensive Development Plan. Erin Ollendike with Civil
Design Advantage (CDA), addressed the council on behalf of the applicant in the event of
questions. No comments were made by the public in attendance.
2) On plans, specifications, form of contract and estimate of cost [NW Douglas Parkway
Traffic Signals Project, NW 10th Street and N Warrior Lane] – Mayor Clarke opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk’s office. Public Works Director/City
Engineer Koester reviewed the project, stating that it was part of the approved Capital
Improvement Plan. The project has an August 2023 completion date. Council Member
Bottenberg stated that he was glad to see plans to add a traffic signal at NW Douglas
Pkwy./NW 10th St. as there have been many near-accidents at this intersection. No
comments were made by the public in attendance.

3) On plans, specifications, form of contract and estimate of cost [Kettlestone Area
Traffic Signals Project] – Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk’s office. Public Works Director/City Engineer Koester reviewed the project for
traffic signal installation at Ashworth Rd./SE Parkview Crossing Dr. and Grand Prairie
Pkwy./SE Tallgrass Ln. intersections. The project has an August 2023 completion date.
Council Member Sinclair asked if the completion date aligned with plans to open the event
center in that area; Mr. Koester replied in the affirmative. No comments were made by the
public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-2, R-
2/PD-1, R-3, R-4 and C-1, a property to be known as Remington Pointe [introduction;
first reading] – Council Member Crone introduced the ordinance and moved to approve the
first reading in title only; seconded by Council Member Sinclair. Council Member Bottenberg
noted a question about annexation that was noted in the Planning & Zoning Commission
meeting minutes; Mr. Kass reviewed the City borders in that area, adding that the property
owner who asked the question at the Planning & Zoning Commission meeting is not
currently within city limits. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.
Nays: None. Motion carried 5 – 0.
2) NW Douglas Parkway Traffic Signals Project, NW 10th Street and N Warrior Lane
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Sinclair. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Sinclair moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending
awarding contract to low bidder Iowa Signal, Inc., of Grimes, IA, in the amount of
$692,856.59. Council Member Bottenberg questioned why one bid was so much higher
than the others; Mr. Koester speculated that the high bid might include higher
mobilization costs due to the bidder location. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2022-395)
3) Kettlestone Area Traffic Signals Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Bottenberg. Results of
vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Sinclair moved to approve the resolution; seconded by Council Member Crone.
Public Works Director/City Engineer Koester reviewed the bid tabulation, recommending
awarding contract to Iowa Signal, Inc., of Grimes, IA, in the amount of $682,054.74.
Mayor Clarke asked how long it takes for new signals to be integrated into the overall
system; Mr. Koester replied that it was instantaneous. Results of vote: Ayes: Bottenberg,
Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2022-
397)

Kass reviewed the plan, including site ingress/egress, parking, open space and exterior
building elevations. Council Member Bottenberg asked if this site would have limited hours
of operations similar to other car washes in the community; Mr. Kass replied that he
anticipated they would have limited hours, adding that the City noise ordinance could also
affect hours of operation. Council Member Sinclair asked how the queuing space compared
with the Mister Carwash across from Menards [in Clive]; Mr. Kass reviewed the proposed

queuing lanes, stating that the queueing space requirements as proposed are met. Council
Member Sinclair asked if there were any concerns with extra traffic leading to additional

WORK SESSION MEETING
October 10, 2022
A. Call to Order – The work session meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Chris
Crone, Larry R. Lyon, Anna Bergman Pierce, Ben Sinclair. Absent: Council Member R. Charles
Bottenberg.

D. Work Session:
1) City partners presentation: Bravo Greater Des Moines – Bravo Executive Director Sally Dix
presented on Bravo’s history, regional and cultural priorities, community investments and impact.
2) Downtown Assessment Study Report – Jim Engle and Jim Thompson with the Iowa Economic
Development Authority’s Downtown Resource Center reviewed the assessment, including survey
results, challenges and themes, and recommendations.
3) FY2022-2023 Strategic Plan: Economic Development Incentives Policy/Framework
discussion – Director of Economic Development Brown discussed current and proposed incentive
policies to help establish clear developer expectations.
4) Code enforcement response – Code Compliance Officer Carpenter reviewed code enforcement
methods and the complaint response process, including the involvement of legal counsel, when
necessary. There was much discussion on the matter, including possible regional partners and
resources for resident assistance.
5) FY2024 budget directives and calendar – City Administrator Deets presented possible directives
and a proposed budget process calendar.
6) City partners funding limits – Finance Director Burkhart reviewed past years’ funding amounts,
noting an historical percentage of general fund revenues applied toward City partner funding. The
council voiced their support for a fixed percentage of the general fund instead of a specific
maximum dollar amount.
7) 2023 lobbying services and legislative priorities – City Administrator Deets noted last year’s
priorities and recommended retaining lobbying services for the upcoming legislative session.
8) Road and infrastructure project updates – Public Works Director/City Engineer Koester
provided an update on various projects under construction.
9) Rezoning application procedures – Community Development Director Kass reviewed the
rezoning application process, including hearing notifications. He also discussed the City code
requirement of consent from owners of at least 50% of the surrounding property within a 250-foot
radius of the area proposed to be rezoned. After some discussion, the council directed City staff to
remove the surrounding property owner consent requirement.
10) NE Brookridge Cir. discussion – City Administrator Deets reminded the council of a recent
homeowner’s association request to remove snow piles from a private street, noting that the
covenants for that development state that snow removal is the association’s responsibility. Public
Works Director/City Engineer Koester reviewed the number of private streets within the city, as
well as the man hours needed for snow removal. The council concluded that the snow removal
should remain the responsibility of the association.

F. Comments – Public Works Director/City Engineer Koester noted some traffic and safety concerns
brought forward by residents in certain areas, stating that City staff would begin traffic studies to better
respond to those concerns.
