HomeMy WebLinkAbout2022-10-17 I01E_01_c Waukee Crossing Plat 2_Satisfaction of Development AgrAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 17, 2022 AGENDA ITEM:Consideration of approval of a resolution approving Satisfaction of Developer’s Agreement [Waukee Crossing, LLC] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The City of Waukee and the Developer (Waukee Crossing, LLC) agree to amend paragraph 4 of the Agreement to determine the cap to the incentive payment for the NW 6th Street Improvements based on the cost categories of exhibit 2 of the amended agreement. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:The City incentive payment to the Developer will not exceed a total of $153,993.71. COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Resolution PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: I1E1c THE CITY OF WAUKEE, IOWA RESOLUTION 2022- APPROVING SATISFACTION OF DEVELOPER’S AGREEMENT [WAUKEE CROSSING, LLC] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, the City of Waukee and Waukee Crossing, LLC have agreed to certain improvements to NW 6th Street as outlined in the Developer’s Agreement: AND, WHEREAS, the City and Developer have agreed to cap the incentive payment for the NW 6th Street Improvements for an amount not-to-exceed $153,993.71, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 17th day of October 2022, that it hereby accepts the public improvements associated with Waukee Crossing Plat 2 and the Developer has Satisfied the requirements of the Developer’s Agreement. ____________________________ Courtney Clarke, Mayor Attest: ___________________________________ Rebecca D.
