HomeMy WebLinkAbout2022-10-17 I16 Developer's Agreement_Metro Acquisitions II\AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 17, 2022 AGENDA ITEM:Consideration of approval of a resolution approving Developer’s Agreement between the City of Waukee and Metro Acquisitions II, LLC FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: Metro Acquisitions II, LLC is in the process of purchasing land west of NW 10th Street. The property contains some topography which is not well suited for development and identified as City Greenbelt on the Conceptual Plan shown as exhibit B in the attached Agreement. The City is interested in developing more parkland, recreational and stormwater management opportunities in and around the area. If the developer does not acquire the property then this agreement is no longer valid. The agreement covers responsibilities of the City and the Developer regarding culvert construction, street construction, stormwater management facilities and property interests to accommodate both parties responsibilities outlined in the agreement. The City will be purchasing 22.01 acres and the remaining 9 acres will be dedicated to the City in order for the developer to meet their parkland dedication requirements and for public street rights of ways as depicted on exhibit B of the attached agreement. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: City agrees to purchase 22.01 acres of the property from the Developer for the sum of $716,699.96, less abstracting costs, prorated taxes and assessments, and other customary costs of closing allocated to the seller. Developer’s Agreement PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK I16 THE CITY OF WAUKEE, IOWA RESOLUTION 2022- APPROVING DEVELOPER’S AGREEMENT BETWEEN THE CITY OF WAUKEE AND METRO ACQUISITIONS II, LLC IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, Metro Acquisitions II, LLC is in the process of purchasing land west of NW 10th Street that contains some topography which is not well suited for development identified as Greenbelt and the City is interested in developing more parkland, recreational, and stormwater management opportunities in and around that area; AND, WHEREAS, if the Developer acquires the property and the City acquires a portion from the Developer, the City intends to allow the developer to extend a north-south street across the Greenbelt, at the Developer’s cost: AND, WHEREAS, the City intends to construct a culvert to accommodate and enhance drainage of the existing drainage way within the Greenbelt in an area identified for the construction by the Developer of the north-south street and will cover said culvert with earth to improve and accommodate a drainage way within future street right of way, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Developer’s Agreement between the City of Waukee and Metro acquisitions II, LLC is hereby approved.
