AGENDA ITEM:Consideration of approval of a Motion to set a Public Hearing Date of
November 21, 2022, as the date of public hearing on an ordinance to
amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from R-2 (One & Two Family Residential
District) to C-1 (Community & Highway Service Commercial District) /
PD-1 (Planned Development Overlay District) and amending the existing
PD-1 (Planned Development Overlay District) [Waukee Towne Center]
FORMAT:Motion
SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of
approximately 48-acres of property from R-2 to C-1/PD-1 and to amend
the existing PD-1 overlay district. The property is generally located west
of SE Alice’s Road and south of Hickman Road. The applicant was
unsuccessful in obtaining the required 50% consent from property
owners within 250-feet. At this time, the applicant has only received
16% consent, however, the applicant has made an attempt to obtain
consent from adjoining owners.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff would recommend approval of the City Council
setting the public hearing date for November 21, 2022, to discuss this
matter further. Council action to set the public hearing date does not
indicate support for the project. Rather, it represents the Council’s
willingness to allow the public hearing process to continue.
RECOMMENDATION: Approve the motion.
