[Little Walnut Creek Headwaters Wetland] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The original agreement was approved by City Council on October 17, 2022 (RES# 2022-428) for work to be performed by the Consultant including detailed work, services, materials, equipment and supplies necessary to complete analysis and design for the project. The project consists of the construction of a stormwater wetland at the headwaters of Little Walnut Creek west of NW 10th Street that will provide stormwater detention and water quality treatment. Veenstra & Kimm, Inc. would like to amend the original agreement to include engineering services for the Little Walnut Creek Headwaters Wetland project. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: The original agreement indicated the compensation amounts for permitting and design were to be determined. This amendment presents scope of services, schedule, fees, and conditions for preliminary design, project planning, wetland investigation, and protected species review shown on Attachment 1. The original agreement included a fee of $2,500 for preparation of a grant application. This amendment proposes the following fees: Environmental Design and Project Planning $8,000.00 Wetland Investigation $5,500.00 Protected Species Review $2,500.00 Amended contract fee is $18,500.00 COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: RECOMMENDATION: Approve the Resolution. [LITTLE WALNUT CREEK HEADWATERS WETLAND] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, on October 17, 2022, the City retained the services of Veenstra & Kimm, Inc. to perform detailed work, services, materials, equipment and supplies necessary to complete analysis and design for the project (RES 2022-428); AND, WHEREAS, the scope of services is revised to include engineering services for the project amending the contract fee to $18,500.00; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Amendment to Agreement for Professional Consulting Services between Veenstra & Kimm, Inc. and the City of Waukee, IA [Little Walnut Creek Headwaters Wetland] is hereby approved. Veenstra & Kimm, Inc. 3000 Westown Parkway West Des Moines, Iowa 50266 Subject Proposal for Design Assistance, Wetland Investigation and Protected Species Review for: City of Waukee, Little Walnut Creek Wetland – Shoeman Property Waukee, Dallas County, Iowa Emmons and Olivier Resources, Inc. (EOR) appreciates the opportunity to provide wetland and protected- species review services associated with the above-referenced project. Scope of Services Design Assistance and Project Planning EOR will provide initial design and site concepting assistance through collaboration with design staff to explore wetland restoration and creation strategies to achieve project goals in consideration of existing site conditions and regulatory requirements. This task includes meeting and coordination time with the appropriate regulatory agencies as well as City staff. Wetland Investigation EOR will compile and assess existing site information using web-based Geographical Information Systems (GIS). Data to review includes project location maps, National Wetlands Inventory maps, Web Soil Survey, and aerial photographs. Based on the results, areas (potential wetlands and stream channels) requiring field investigations will be identified and delineated according to the 1987 Corps of Engineers Wetland Delineation Manual and the 2010 Midwest Regional Supplement. All potentially jurisdictional areas will be field reviewed for hydrophytic vegetation, hydric soils, and wetland hydrology. Field identified wetlands will be GPS recorded and flagged, if requested by the client. Delineation information will be recorded on Wetland Determination Data Forms: Midwest Region. A technical report will be prepared to summarize the quantity and extent of jurisdictional waters of the proposed project area. The reports will include delineated acreage, an assessment of adjacency, an assessment of the drainage resources, a location map of identified jurisdictional waters, data sheets documenting field findings, and a photographic record of site conditions. Spatial data of identified resources will be available upon request. Protected-Species Review EOR will complete a reconnaissance level assessments of project limits to determine the presence of listed threatened and endangered species and/or their favored habitats. This task does not include intensive species-specific surveys that may be required should state or federal regulatory agencies require detailed investigations. A summary of the evaluation results will be included in a Technical Memorandum prepared for each project. In addition, EOR will complete and provide an IDOT Determination of Effect Form. An electronic PDF copy of all documents and reports will be provided to the client for record and further dissemination. Hard copies are available upon request. EOR will provide follow-up coordination and correspondence with the U.S. Army Corps of Engineers, Iowa Department of Natural Resources, and other regulatory agencies, if needed. Schedule We would be able to initiate the above-described activities upon receipt of the signed services contract. We expect being able to complete the fieldwork and reporting components of these investigations as soon as site conditions are favorable in the spring of 2023. We will remain available for on-call technical assistance throughout the project planning studies, should it be necessary. Fees The estimated maximum total cost for performing the above scope of services is $16,000.00. Design Assistance and Project Planning: $8,000.00 (Hourly, Not-to-exceed) Wetland Investigation: $5,500.00 (Lump Sum) Protected-species Review: $2,500.00 (Lump Sum) Conditions Items to be provided by the client include right-of-entry to all project areas to conduct field investigations. The client should also notify us of any restrictions or special requirements regarding the property or other required activities prior to the commencement of field work. This proposal does not include the following services: National Environmental Policy Act documentation, Section 404 Permitting, Mitigation Planning, Design, or Monitoring, Floodplain Permitting, Phase I Environmental Site Assessment (contaminants), formal Section 10 consultation with the U.S. Fish and Wildlife Service, and intensive archaeological inventory, testing, or mitigation. Our invoices will be submitted monthly or upon substantial completion of project tasks. Our proposal is based on the information that you provided to us via email on September 22, 2022. Should conditions be encountered that necessitate major revisions and/or result in significantly higher costs, we will contact you before initiating this work or preparing a change order.
