AGENDA ITEM: Consideration of approval of a resolution approving Warranty Deed [Lots D
and E of Ashley Acres Plat 2]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City Council recently approved a final plat for Ashley
Acres Plat 2 which included the dedication of street rights-of-way. After the
plat had been approved and filed, it was determined that a scriveners error had
been made on the plat that included street lot labels being duplicated. The
surveyor has corrected the error and the developer has provided a Warranty
Deed for the remaining street lots.

RESOLUTION 2023-
APPROVING WARRANTY DEED WITH ASHLEY ACRES, LLC [LOTS D & E OF
ASHLEY ACRES PLAT 2]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City approved a final plat for Ashley Acres Plat 2 which included the extension
of public streets; AND,
WHEREAS, a scriveners error on the approved plat created street lots with duplicate names;
AND,
WHEREAS, the land surveyor of record has filed an affidavit to correct the scriveners error on the
approved plat; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that
the warranty deed for Lots D & E of Ashley Acres Plat 2 over and across property owned by
Ashley Acres, LLC be approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 16th day of
January, 2023.
