HomeMy WebLinkAbout2023-01-16 I01J Ashley Acres Plat 2_Warranty Deed AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: January 16, 2023 AGENDA ITEM: Consideration of approval of a resolution approving Warranty Deed [Lots D and E of Ashley Acres Plat 2] FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The City Council recently approved a final plat for Ashley Acres Plat 2 which included the dedication of street rights-of-way. After the plat had been approved and filed, it was determined that a scriveners error had been made on the plat that included street lot labels being duplicated. The surveyor has corrected the error and the developer has provided a Warranty Deed for the remaining street lots. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution RECOMMENDATION: Approve the resolution ATTACHMENTS: I. Proposed Resolution PREPARED BY: Andy Kass, Community Development Director REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: I1J THE CITY OF WAUKEE, IOWA RESOLUTION 2023- APPROVING WARRANTY DEED WITH ASHLEY ACRES, LLC [LOTS D & E OF ASHLEY ACRES PLAT 2] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City approved a final plat for Ashley Acres Plat 2 which included the extension of public streets; AND, WHEREAS, a scriveners error on the approved plat created street lots with duplicate names; AND, WHEREAS, the land surveyor of record has filed an affidavit to correct the scriveners error on the approved plat; AND, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the warranty deed for Lots D & E of Ashley Acres Plat 2 over and across property owned by Ashley Acres, LLC be approved.
