STAFF REVIEW AND COMMENT: Confluence and design team have reviewed the Triumph
Park Fishing Pier Project and find that the work performed is in substantial
accordance with the plans and specifications, and that the final amount of the
Contract is $610,000.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2023-
ACCEPTING PUBLIC IMPROVEMENTS [TRIUMPH PARK FISHING PIER PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on September 8, 2020, the Waukee City Council approved the construction contract and
bond for Triumph Park with Larson Construction Company, Inc., of Independence, IA (the “Contractor”)
(Resolution #2020-340); AND,
WHEREAS, on April 5, 2021, the Waukee City Council approved the Triumph Park Contribution
Agreement between the Waukee Betterment Foundation (the “Foundation”) and the City of Waukee
related the funding and construction of the Triumph Park Fishing Pier Project (Resolution #2021-138);
AND,
WHEREAS, on April 5, 2021, the Waukee City Council approved a construction contract with Larson
Construction Company, Inc., for the Triumph Park Fishing Pier Project (Resolution #2021-139); AND,
WHEREAS, the Contractor has fully completed the construction of the public improvements in
accordance with the terms and conditions of the contract and plans and specifications.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
public improvements are hereby approved and accepted as having been fully completed in accordance
with the plans, specifications and form of contract and the total final construction cost thereof is hereby
determined to be $610,000.00, as shown in the report of the Engineer, filed with the Clerk on March 3,
2023.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 21st day of
February, 2023.

Dear Mr. Jermier:
Confluence herby certifies that we and our consultants have completed on on-site review of the construction of
the Triumph Park Fishing Pier. This work was completed by Larson Construction. As the lead site designers of the
project, it is our collective opinion that the work was performed in substantial accordance with the plans and
specifications and that the final contract amount of the contract is six hundred and ten thousand dollars and zero
cents. ($610,000.)
