AGENDA ITEM: Consideration of approval of a motion setting April 3, 2023 as the date of
public hearing on an Ordinance to amend Chapter 169, Zoning Regulations,
District Regulations, Waukee, Iowa by adding consumer fireworks sales as a
permitted use to commercial zoning districts
FORMAT: Motion
SYNOPSIS INCLUDING PRO & CON: The purpose of this amendment is to bring Chapter 169 of
the Waukee Municipal Code into compliance with Chapter 414 of the Iowa
State Code. In 2022, the State passed a new law that prohibits cities from
restricting the sale of consumer fireworks in commercial and industrial zoning
districts. Currently, sales of consumer fireworks are already permitted in the
industrial districts within Waukee. The amendment would insert sales of
consumer fireworks as a permitted use into the commercial zoning districts.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: Staff would recommend approval of the motion to set the
public hearing for April 3, 2023 to further discuss the proposed ordinance.
RECOMMENDATION: Approve the motion.
