(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Bottenberg at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically
via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Council Members R. Charles Bottenberg,
Chris Crone, Larry R. Lyon (electronically), Anna Bergman Pierce (electronically), Ben Sinclair.
Absent: Mayor Courtney Clarke.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Planning Coordinator Melissa DeBoer, Finance Director Linda Burkhart, Director of Economic
Development Jennifer Brown, Human Resources Director Michelle Lindsay, Director of
Marketing & Communications Heather Behrens, IT Director Son Le, Public Works Director/City
Engineer Rudy Koester, Fire Chief Clint Robinson, Deputy Fire Chief Tomme Tysdal, Police
Chief Chad McCluskey, Police Officer Corby Robbins, City Clerk Rebecca D. Schuett, City
Attorney Steve Brick.
(D) Open Forum
(E) Agenda Approval – Council Member Sinclair moved to approve the agenda, removing items J3
and J4 due to the absence of Mayor Clarke; seconded by Council Member Crone. Results of
vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0.
(F) Monthly Mayor’s Report – No report made.
(G) Presentations: None
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Regulations, District Regulations,
Waukee, Iowa, by adding consumer fireworks sales as a permitted use to commercial
zoning districts – Mayor Pro Tem Bottenberg opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied that none had been
received in the clerk’s office. Planning Coordinator DeBoer noted that the current ordinance
only allows consumer fireworks sales in industrial zoning districts. State legislation enacted
in 2022 requires that the City amend the ordinance to allow such sales in commercial zoning
districts, as well. No comments were made by the public in attendance.
2) On certain amendments to agreements with Northpointe Development II Corporation
for an affordable housing project – Mayor Pro Tem Bottenberg opened the public hearing
and asked if any written correspondence had been received; City Clerk Schuett replied that
none had been received in the clerk’s office. Assistant City Administrator Osborne stated
that the proposed amendments are necessary due to the discovery of a significant funding
gap after the initial agreements were approved. The amended agreements reduce the
number of low income housing tax credit (LIHTC) units constructed by Northpointe and
include a partnership with Habitat for Humanity. Mr. Osborne also reviewed an updated
development concept plan. No comments were made by the public in attendance.
3) On the authorization of the issuance of Bonds or Capital Loan Notes to evidence the
obligation of the City thereunder [Not to Exceed $35,000,000 General Obligation Urban
Renewal Bonds or Capital Loan Notes (UR)] – Mayor Pro Tem Bottenberg opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk’s office. Finance Director Burkhart
reviewed the proposed bond issuance, noting that the three bond issues being considered
by council would all be used toward funding the Public Safety Facility. The bonds will be
sold over the next two fiscal years but approval of bond issuance is recommended at this
time. No comments were made by the public in attendance.

4) On hearing on the authorization of the issuance of Bonds or Capital Loan Notes to
evidence the obligation of the City thereunder [Not to Exceed $700,000 General
Obligation Bonds or Capital Loan Notes (GCP)] – Mayor Pro Tem Bottenberg opened the
public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk’s office. Finance Director Burkhart
reviewed the proposed bond issuance to fund the Public Safety Facility. No comments were
made by the public in attendance.
5) On the issuance of Not to Exceed $25,000,000 General Obligation Local Option Sales
Tax Bonds – Mayor Pro Tem Bottenberg opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied that none had been received
in the clerk’s office. Finance Director Burkhart reviewed the proposed bond issuance to fund
the Public Safety Facility, noting that language was included in the bond documents that
funds could be used toward construction of other parks and recreational trail projects if the
full amount is not needed for the Public Safety Facility. Cash from LOSST collections will
also be used toward this project. No comments were made by the public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Regulations, District Regulations, Waukee, Iowa, by adding consumer fireworks sales
as a permitted use to commercial zoning districts [introduction; first reading]–
Council Member Crone introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Sinclair. Council Member Sinclair asked for
clarification that the proposed ordinance amendments were necessary to comply with State
law; Planning Coordinator DeBoer replied in the affirmative. Results of vote: Ayes:
Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0.
2) Affordable Housing Project
A. Resolution: Consideration of approval of a resolution approving and executing an
Amendment to an Option to Purchase Agreement with Northpointe Development II
Corporation – Council Member Crone moved to approve the resolution; seconded by
Council Member Lyon. Assistant City Administrator Osborne noted that if any agreement
with Habitat for Humanity does not move forward, the City is not obligated to continue the
project. If Northpointe Development II Corporation qualifies for LIHTC funding, there will
be additional amendments to the agreements. Results of vote: Ayes: Bottenberg, Crone,
Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2023-119)
B. Resolution:Consideration of approval of a resolution approving and executing an
Amendment to a Development Agreement with Northpointe Development II
Corporation – Council Member Sinclair moved to approve the resolution; seconded by
Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce,
Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2023-120)
3) General Obligation Bonds or Capital Loan Notes
A. Resolution: Consideration of approval of a resolution instituting proceedings to
take additional action [Not to Exceed $35,000,000 General Obligation Urban
Renewal Bonds or Capital Loan Notes (UR)] – Council Member Lyon moved to
approve the resolution; seconded by Council Member Crone. Council Member
Bottenberg stated that he would abstain from voting due to a professional conflict of
interest. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None. Abstentions:
Bottenberg (professional conflict of interest). Motion carried 4 – 0 – 1. (Resolution
#2023-121)

7) Resolution: Consideration of approval of a resolution approving the purchase of a
2025 Emergency One (E-1) fire engine from Banner Fire Equipment, Inc., of Roxana,
IL, in the amount of $885,822.00 [Waukee Fire Department] – Deputy Fire Chief Tysdal
stated that the fire engine purchase was included in the FY2025 Capital Improvement
Program but City staff recommend approving the purchase at this time due to the extensive
lead time from order to delivery. Council Member Lyon asked what the engine would’ve cost
if it were purchase two years ago; Deputy Tysdal replied that it would likely have cost
approximately $600,000. Council Member Sinclair asked if the purchase was for a
replacement or additional engine; Deputy Tysdal responded that it was a replacement
vehicle. Council Member Crone moved to approve the resolution; seconded by Council
Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays:

outlots for both stormwater detention and parkland dedication. Council Member Sinclair
asked if the parkland was adjacent to existing parkland; Ms. DeBoer replied in the

affirmative. City Administrator Deets added that the dedicated parkland was planned to

Coordinator DeBoer reviewed the site plan, noting that existing mailboxes would be
relocated. She discussed site access off the private street and reviewed exterior building
elevations. Council Member Bottenberg asked if the building was planned to house
maintenance equipment; Ms. DeBoer replied in the affirmative. Results of vote: Ayes:

reviewed the site plan for a three-tenant building that will connect to the planned Target
building. She reviewed loading dock locations, a monument sign and fountain features,
parking, landscape buffering and exterior building elevations. Results of vote: Ayes:

A. Resolution: Consideration of approval of a resolution approving preliminary plat –

Lyon. Planning Coordinator DeBoer reviewed the preliminary plat, construction drawings
and final plat for approximately 21 acres. The plat includes 8 lots with one outlot that will
be dedicated to the City for parkland use. Council Member Bottenberg asked if Lot 8
would be further subdivided; City Administrator Deets replied that it was anticipated to be

4) Mayor’s Appointment and Resolution: Consideration of approval of a resolution approving
mayor’s appointment of a citizen member to the Board of Appeals for an unexpired term
ending January 31, 2028 – Council Member Crone moved to approve the resolution; seconded
by Council Member Sinclair. Mayor Clarke appointed Ben Guenther to fill the unexpired term.
Results of vote: Ayes: Crone, Lyon, Sinclair. Nays: None. Absent: Bottenberg, Pierce. Motion
carried 3 – 0 – 2. (Resolution #2023-149)
E. Work Session:
1) FY2022-2023 Strategic Plan: Small Business Attraction Action Plan review – Director of
Economic Development Brown reviewed small business statistics and shared action plan goals,
including defining small business, providing resources for small business development and growth,
incentives, supporting the local business community, fostering entrepreneurship and innovation,
and increasing access to capital. (Council Member Pierce began electronic participation at 5:51
p.m.)

2) FY2022-2023 Strategic Plan: Economic Development Partnership Enhancements report –
Director of Economic Development Brown provided an update on partnership activities and
investments with the Waukee Area Chamber of Commerce, Greater Dallas County Development
Alliance and Greater Des Moines Partnership.
3) FY2022-2023 Strategic Plan: City Social Media Presence and Data Gathering report –
Director of Marketing & Communications Behrens reviewed the City’s presence on various social
media outlets, provided follower demographics and page reach, and discussed opportunities to
optimize City social media for the most effective outreach.
4) 2023 Asphalt Overlay Improvements Project, Ashworth Drive from 4th Street to 10th Street,
update – Public Works Director/City Engineer Koester discussed the current condition of Ashworth
Dr. between 2nd St. and 4th St., noting that the segment was overlayed last year but that a subbase
product recommended by the project engineer had failed. He then reviewed plans to replace the
failed segment as part of the 4th St. to 10th St. overlay improvements, stating that the engineer for
the earlier project has volunteered to pay for the replacement costs.
5) Gas Utility Capital Improvement Plan – Public Works Director/City Engineer Koester stated that
Northern Natural Gas has made available an opportunity to submit a bid to purchase excess gas
capacity. If a bid were successful, Waukee TBS No. 2 improvements would need to be
constructed earlier than planned but would allow the City to push other gas utility improvements
further out, leading to an overall cost savings. Mr. Koester then reviewed an amended CIP and
next steps.
6) Special census discussion – Assistant City Administrator Osborne presented information on the
City’s estimated current population and projected costs to conduct a special full or partial census,
citing a significant projected increase in Road Use Tax funding with higher population numbers.
The council agreed that City staff should move forward with the next step in the process.
7) FY2024 budget discussion – City Administrator Deets recommended a $0.05 reduction to the
property tax levy, noting that such a reduction would not negatively impact city services.

G. Comments – Public Works Director/City Engineer Koester provided a scheduling update on Ute
Ave./Ashworth Rd. Intersection traffic signal repairs.
