AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 92, Water Rates,
by amending Section 92.02, Water Rates, as specified; by amending Section
92.04, Irrigation Water Rates, as specified; and by amending Section 92.07,
Service Discontinued, by amending Subsection 92.07(2), Notice to Landlords

SYNOPSIS INCLUDING PRO & CON: A water rate increase was included in the FY2024 budget
as proposed for consideration for approval by the City Council. These rates will go into effect July 1,
2023.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: An increase of 2.5% to the
existing water rates is recommended. This is an increase to the minimum monthly bill base charge of
$0.34 ($13.47 to $13.81) for the first 1,000 gallons of water usage, and an increase of $0.23 ($9.15 to
$9.38) for water usage in excess of the minimum (1,000 gallons). The irrigation charge is
recommended to be set at $3 higher ($12.38) than the rate for water usage in excess of 1,000 gallons.

ORDINANCE NO. 23-____
AN ORDINANCE TO AMEND CHAPTER 92, WATER RATES, CITY OF WAUKEE,
IOWA MUNICIPAL CODE, BY AMENDING SECTION 92.02, WATER RATES, AS
SPECIFIED BELOW; BY AMENDING SECTION 92.04, IRRIGATION WATER
RATES, AS SPECIFIED BELOW; AND BY AMENDING SECTION 92.07, SERVICE
DISCONTINUED, BY AMENDING SUBSECTION 92.07(2), NOTICE TO LANDLORDS:
WHEREAS, due to the increased costs of providing water the City of Waukee has
determined to change the rates for water usage, including irrigation water; AND,
WHEREAS, it is also recommended to amend Waukee Municipal Code Chapter 92,
Water Rates, Section 92.07, Service Discontinued, Subsection 92.07(2), Notice to Landlords, to
clarify procedures regarding notice of delinquency given to an owner or landlord if the water
service customer is a tenant.
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1: Chapter 92, Waukee Municipal Code, Section 92.02, Water Rates, is hereby
repealed and enacted in lieu thereof are as follows:
92.02 Water Rates. Water service shall be furnished at the following monthly
rates per meter within the City limits:
1.Beginning July 1, 2023, a minimum monthly bill of $13.81 shall be
charged for zero to 1,000 gallons of metered water usage per month.
2.Beginning July 1, 2023, water usage in excess of the minimum (1,000
gallons) will be charged at a rate of $9.38 per 1,000 gallons per month.
3.Water will not be furnished outside the limits of Waukee without consent
of Des Moines Water Works. Water furnished to users outside the city
limits of the City of Waukee shall be furnished at the same rate that is
charged for water furnished for users within the city limits of the City of
Waukee.
4.Minimum posting fees for non-paid utilities and minimum fees for
installation of water meters on new construction shall be set by resolution
of the Council.
5.Water Surcharges. A $100.00 surcharge shall be imposed for violations of
mandatory water usage policies or restrictions implemented under the
Water Conservation Plan. In addition, an additional $5.00 surcharge per
1,000 gallons used in excess of the respective allotments for residential
and commercial users pursuant of the water conservation plan. Said
surcharges shall be charged to the customer in the next billing cycle.

Section 2. Chapter 92, Waukee Municipal Code, Section 92.04, Irrigation Water Rates,
is hereby repealed and enacted in lieu thereof are as follows:
92.07 Irrigation Water Rates. Beginning July 1, 2023, irrigation water usage
will be charged at a rate of three dollars ($3.00) higher per 1,000 gallons per
month than the regular domestic meter rated listed in 92.02(2) above.
Section 3. Chapter 92, Waukee Municipal Code, Section 92.07, Service Discontinued,
Subsection 92.07(2), Notice to Landlords, is hereby amended to read as follows:
2. Notice to Landlords. If the customer is a tenant, the notice of delinquency
shall also be given to the owner or landlord. If the customer is a tenant and
requests a change of name for service under the account, such request shall be
sent by the City to the owner or landlord of the property if the owner or landlord
has made a written request for notice of any change of name for service under the
account to the rental property.
Section 4 Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 5. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect on July 1, 2023, after its
final passage, approval and publication as provided by law.
