Management Facility Maintenance Covenant & Permanent Easement
Agreement (Ashley Acres, LLC)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: Ashley Acres, LLC, desires to amend and restate an
existing Storm Water Management Facility Maintenance Covenant and
Permanent Easement Agreement for Ashley Acres Plat 1. The purpose of the
amendment is to update the existing agreement to reference subsequent plats
of the same development that were recently platted.

RESOLUTION 2023-
APPROVING STORM WATER MANAGEMENT FACILITY MAINTENANCE
COVENANT & PERMANENT EASEMENT AGREEMENT (ASHLEY ACRES, LLC)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee is a duly organized municipality within Dallas County; AND,
WHEREAS, it has been determined that certain easements from Ashley Acres, LLC, are
necessary for the purpose of storm water detention.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa,
that the amended and restated Storm Water Management Maintenance Covenant & Permanent
Easement Agreement is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 15th day of May
2023.
