UTE AVENUE RESURFACING, AND RATIFYING, CONFIRMING AND APPROVING DEADLINF FOR SUBMISSION OF BIDS AND FIXING A DATE' FOR HEARING THF,REON AND "TAKING OF BIDS THEREFOR WHEREAS, it is deemed advisable and necessary to construct certain public improvements described in general as the Ute Avenue Resurfacing; and WHEREAS, Dallas County will serve as the lead agency for the Pro'cct and will enter into the construction contract for the Project; and WHEREAS. Dallas County and the City of Waukee have agreed to divide the actual construction costs of the Project, with the City paying its share of the estimated cost upon request for reimbursement made by the County Ingineer at Project completion intervals deemed mutually appropriate: and WHEREAS, Dallas County has caused to be prepared plans, specifications and form of contract, together with estimate of cost, which are now on file in the office of the Waukee City Clerk for public inspection, for the construction of the public improvements; and WHEREAS, the plans. specifications and form of contract are deemed suitable for the making of the public improvements; and WHEREAS, final grades have been established by ordinance, consistent with the plans for all street improvements included in the proposed construction; and WHEREAS, on April 27, 2023, at 10:00 a.m., following advertisement for bids by the County, the County Engineer received, opened and tabulated bids for construction of the Project as provided in the public notice, and WHEREAS, before the plans, specifications, form of contract and estimate of cost may be adopted, and a contract for the construction of the public improvements is entered into, it is necessary for the City to hold a public hearing and to consider ratification of the bid letting. NOW, 'I'llEREFORE, BE IT RLSOLVI?D BY THE' CTTY COUNCIL OF THE CITY OF WAUKEE, STATE OF IOWA: Section I. That the actions of Dallas County in setting a date Tor the receipt of bids before 10:00 A.M. on April 27, 2023 are hereby ratified, confirmed, and approved. Section 3. That the actions of the County Auditor of Dallas County in advertising for bids arc hereby ratified, confirmed, and approved. Section 4. That the Dallas County Engineer is hereby ratif ied and adopted as the designated representative to perform the duty ofIreceiving. opening and tabulating bids for construction of the Project as provided in the public notice and his actions taken in doing so on April 27, 2023, are hereby ratified, confirmed and approved. The results ofthe bids shall be considered at the meeting of this Council on May 15, 2023 at 5:30 P.M. Section 5. That the City Clerk be and is hereby directed to publish notice of hearing once in a legal newspaper, printed wholly in the English language, published at least once weekly and having general circulation in this City. Publication shall be not less than four clear days nor more than twenty days prior to the date hereinafter fixed as the date for a public hearing on the plans, specifications, form of contract and estimate of costs for the project, the hearing to be at 5:30 P.M. on May 15, 2023.
