HomeMy WebLinkAbout2023-07-10 H03 Waukee Commons Stanzyk_Annexation_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 10, 2023 AGENDA ITEM: Public hearing on the annexation of consenting and non-consenting properties by the City of Waukee, Iowa [Waukee Commons, LC / Barbara Stanzyk] FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: Staff has received an application for annexation from Waukee Commons, LC to annex 79-acres of property located south of 300th Street and east of T Avenue. In addition to the property owned by Waukee Commons, LC, approximately 1-acre of property, owned by Barbara Stanzyk (non-consenting), is being included as part of the annexation. Chapter 368 of the Iowa Code permits a city to include no more than 20% of the total acreage of an annexation to be comprised of non-consenting ownership to avoid creating an island of unincorporated area or to create more uniform boundaries. If the property owned by Barbara Stanzyk were not to be included within this annexation, an island of unincorporated area would be created and not allowed by Iowa Code. The total acreage of the annexation area is approximately 80-acres. The property owned by Barbara Stanzyk is 1-acre in area or 1.25% of the total acreage. Over the past few months, staff have met with Barbara Stanzyk to discuss annexation into the City and presented the benefits of annexation and what to expect upon annexation. City staff continues to work with Mrs. Stanzyk on a pre-annexation agreement and submitting an annexation application. Staff is recommending proceeding forward with the annexation of the properties which includes a total of approximately 80-acres. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: The proposed annexation is consistent with future growth parameters identified within the Waukee Comprehensive Plan and agreements that are in place with adjoining municipalities.
