June 19, 2023
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Chris Crone, Larry R. Lyon, Anna Bergman Pierce (electronically), Ben Sinclair. Absent: Council
Member R. Charles Bottenberg.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Finance Director Linda Burkhart, Community Development Director Andy Kass, Public Works
Director/City Engineer Rudy Koester, Parks & Recreation Director Matt Jermier, Human
Resources Director Michelle Lindsay, Director of Economic Development Jennifer Brown,
Director of Marketing & Communications Heather Behrens (electronically), IT Director Son Le,
Police Chief Chad McCluskey (electronically), Police Officer Corby Robbins, City Clerk Rebecca
D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval – Council Member Sinclair moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None.
Absent: Bottenberg. Motion carried 4 – 0 – 1.

(G) Public Hearings:
1) On an ordinance to amend Chapter 165.19, Zoning Regulations, Definitions and
General Regulations, Solar Energy Systems Waukee, Iowa by adding provisions for
Ground Mounted Solar Energy Systems in Residential Districts – Mayor Clarke opened
the public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied that none had been received in the clerk’s office. Community Development
Director Kass briefly reviewed the proposed ordinance that would allow ground mounted
solar panels in A-1, AR and R-1 zoning districts. He reviewed proposed maximum heights,
minimum lot size and location restrictions. Council Member Sinclair asked if lots were
required to have a home on them and not just solar panels; Mr. Kass replied that the panels
would be an accessory us to a principal permitted use only. No comments were made by
the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of on an ordinance to amend Chapter 165.19,
Zoning Regulations, Definitions and General Regulations, Solar Energy Systems
Waukee, Iowa by adding provisions for Ground Mounted Solar Energy Systems in
Residential Districts [introduction; first reading] – Council Member Crone introduced the
ordinance and moved to approve the first reading in title only; seconded by Council Member
Lyon. Council Member Lyon asked if there had been any requests for ground mounted solar
panels for lots that meet the proposed requirements; Mr. Kass replied in the affirmative,
adding that a very small number of lots in Waukee would meet the requirements. He
clarified that roof mounted solar panels are still allowed in most residential zoning districts.
Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays: None. Absent: Bottenberg.
Motion carried 4 – 0 – 1.

by Council Member Sinclair. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays:

Engineer Koester reviewed the proposed ordinance, stating that quiet zones are generally

Director Kass reviewed the application for a fireworks sales tent in the Hy-Vee parking lot.
Sales will end on July 5 pursuant to State code. Mayor Clarke asked that City staff keep an

6) Resolution: Consideration of approval of a resolution approving site plan for Waukee
Towne Center Lake and Trail Improvements – Council Member Lyon moved to approve
the resolution; seconded by Council Member Sinclair. Community Development Director
Kass reviewed the plan, which includes a pond, trail, landscaping and grading for a future
amphitheater. The adjacent Heart of the Warrior Trail will also be realigned to connect with

8) Resolution: Consideration of approval of a resolution approving site plan for Chipotle
[425 E. Hickman Road] – Council Member Lyon moved to approve the resolution;
seconded by Council Member Sinclair. Community Development Director Kass reviewed
the site plan for a 2,300-square-foot building with patio, noting that the plans included a pick-
up window for online orders. He then discussed site ingress/egress and exterior building
elevations. Council Member Crone asked when construction would be complete; Mr. Kass
presumed it would be done in late 2023 or early 2024. Council Member Sinclair asked that
City staff monitor traffic in the area as sites are developed; Mr. Kass replied that the street in
question is a private road but that staff would reach out to the road owner if needed. Results

Industrial [800 Interstate Parkway] – Council Member Crone moved to approve the
resolution; seconded by Council Member Lyon. Community Development Director Kass
briefly reviewed the site plan for two indoor storage buildings; the individual units are
planned for sale. Outdoor storage spaces will be screened by fencing. He then presented
exterior building elevations. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays:
None. Absent: Bottenberg. Motion carried 4 – 0 – 1. (Resolution #2023-280)
10) Resolution: Consideration of approval of a resolution approving site plan for
Kettlestone Peak Townhomes [1355 SE Pleasant View Drive] – Council Member Sinclair
moved to approve the resolution; seconded by Council Member Lyon. Community
Development Director Kass reviewed the site plan for 11 townhome buildings with a total of
51 units for rent. The buildings include 2- and 3-story units platted on one overall lot. Each
unit includes an attached 2-car garage. Mr. Kass then reviewed exterior building elevations.
Council Member Lyon asked for clarification on the roofing material; Mr. Kass answered that
asphalt shingles were planned. Results of vote: Ayes: Crone, Lyon, Pierce, Sinclair. Nays:

11) Resolution: Consideration of approval of a resolution approving final plat for
Ashworth North Plat 3 – Council Member Crone moved to approve the resolution;
seconded by Council Member Sinclair. Community Development Director Kass reviewed
the final plat, noting that Lot 1 was planned to be sold to the adjacent Unity Point Clinic.

construction drawings, noting that the plat included 14 outlots for future commercial and
4 outlots for future multi-family residential development. The SE Glacier Trl.

WORK SESSION MEETING
June 26, 2023
The work session meeting of the Waukee City Council was called to order by Mayor Clarke at 5:01
p.m. at Waukee City Hall, 230 W. Hickman Rd.
The following members were present: Mayor Courtney Clarke; Council Members R. Charles
Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair. Absent: Council Member Anna Bergman
Pierce.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Parks &
Recreation Director Matt Jermier, Marketing & Communications Director Heather Behrens, Police
Chief Chad McCluskey, Lyle Sumek with Lyle Sumek Associates, Inc. (electronically).
A. Parks & Recreation Department update – Parks & Recreation Director Jermier provided an
update on Triumph Park ballfield conditions and planned repairs.
B. Work Session: Goal setting and strategic planning for FY2024, final session – Mr. Sumek
lead the council through the final selection of top and high priority goals for the upcoming fiscal
year.
