Amendment No. 1 was approved on October 19, 2020 and Amendment No. 2 approved on October 18, 2021. Amendment No. 3 is due to the need to adjust the locations of several exhaust fans which resulted in the need to make a deeper shroud for two (2) of the exhaust fans. This resulted in an additional cost to the City as shown on Core Construction’s Change Order Request 14 in the amount of $2,609.25 to refabricate the two (2) new deeper shrouds. Farnsworth Group has proposed a decrease in the design fee of $2,610.00 to cover this additional cost incurred by the City. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Decrease in the design fee of $2,610.00 to cover additional cost incurred by the City. Engineering Services Amendment No. 3 PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK I1E3 THE CITY OF WAUKEE, IOWA RESOLUTION 2023- APPROVING AMENDMENT NO. 3 TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES WITH FARNSWORTH GROUP [WAUKEE PUBLIC WORKS SITE EXPANSION PHASE 1] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, on November 18, 2019 (Resolution #19-429), the Waukee City Council approved an agreement for professional consulting services with Farnsworth Group; and on October 19, 2020, Amendment No. 1 to that agreement was approved (Resolution #2020-403); and on October, 18, 2021 Amendment No. 2 to that agreement was approved (Resolution #2021-442), all related to the Waukee Public Works Site Expansion Phase 1 Project; AND, WHEREAS, the Farnsworth Group proposes a third amendment to the agreement with the City of Waukee for the Waukee Public Works Site Expansion -Phase 1 for adjusted locations of several exhaust fans which resulted in the need to make a deeper shroud for two (2) of the exhaust fans; AND, WHEREAS, this resulted in an additional cost to the City of Waukee per the Prime Contractor’s (Core Construction) Change Order Request 14 in the amount of $2,609.25 to refabricate the two (2) new deeper shrouds; AND, WHEREAS, Farnsworth Group proposes a decrease in the design fee of $2,610 to cover this additional cost incurred by the City of Waukee, NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 24th day of July, 2023, that it hereby approves the Third Amendment to Agreement for Professional Consulting Services with Farnsworth Group [Waukee Public Works Site Expansion Phase 1]. ____________________________ Attest:Courtney Clarke, Mayor ___________________________________ Rebecca D. Per our previous discussions we adjusted the locations of several exhaust fans which resulted in the need to make a deeper shroud for two (2) of the exhaust fans. This resulted in an additional cost to the City of Waukee, Core Construction’s COR-14 in the amount of $2,609.25 to re- fabricate the two (2) new deeper shrouds. Therefore, we propose a decrease in the design fee of $2,610 ($295,385 – $2,610 = $292,775) to cover this additional cost incurred by the City of Waukee. We request the following revisions to the original agreement, dated 18th day of November 2019, and the First Amendment, dated September 15, 2020, and the Second Amendment, dated October 4, 2021: 3. COMPENSATION: Revise paragraph to read as follows: A. In consideration of the professional services provided herein, the City agrees to pay the Consultant the following lump sum of $292,775, excluding any authorized reimbursable expenses, as set forth in Exhibit D. Total Reimbursable Expenses: $12,500 Total Fee including reimbursable expenses: $305,275 Delete the COMPENSATION article listed in the Second Amendment, dated October 4, 2021. If you agree with the revisions noted above, then please have the mayor or another authorized person sign on the line below. Inside the wall there is very little clearance between the wall and roof joists. The exhaust fans will have to be mounted further thru the wall to the outside. The weather hoods will not cover the fans. Deeper weather hoods can be built to cover these fans. The additional cost is $2450 Thanks, Gayle Young Mechanical & Plumbing Inc.
