HomeMy WebLinkAbout2023-07-24 I01H Authorizing Acquisition of Property_SE Archer Ave ImprovementsAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 24, 2023 AGENDA ITEM:Consideration of approval of a resolution approving and authorizing the acquisition of property and property interests for the SE Archer Avenue Improvement Project FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The project is to construction the extension of SE Archer Avenue from E Hickman Road to SE Laurel Street and associated infrastructure. Property acquired for the project will be used for roadway right-of-way. Under the provisions of Chapter 6B of the Iowa Code, a governmental body which proposes to acquire property or property interests under power of eminent domain for a public improvement project is required to give notice of its intent to commence the project to all owners of such property whose properties may be acquired in whole or in part for the project. A notice was mailed to one adjacent property owners, Hurd Waukee 2 LLC. City staff will continue to proceed with the necessary activities and negotiations to acquire by purchase or condemnation, subject to approval by this Council, the necessary property and/or property interests required for the construction of SE Archer Avenue. Resolution PREPARED BY:Beth Richardson REVIEWED BY: Rudy Koester RK I1H RESOLUTION 2023- RESOLUTION APPROVING AND AUTHORIZING THE ACQUISITION OF PROPERTY AND PROPERTY INTERESTS FOR THE SE ARCHER AVENUE IMPROVEMENT PROJECT IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee desires to install SE Archer Avenue between Laurel and Highway 6/Hickman Rd to establish another motor vehicle route in the area to further assist in alleviating traffic congestion, enhancing motor vehicle traffic flow and mitigating traffic burdens in an area that is becoming increasingly congested in accordance with the plans and at the location set forth in the plans on file in public works; and WHEREAS, the City determines there is a reasonable expectation that the project will achieve the public purpose, comply with applicable standards and obtain all necessary permits; and WHEREAS, rights-of-way and temporary construction easements will need to be acquired for the construction of the public improvement; and WHEREAS, the City staff or its designee has established fair market values by appraisal for the necessary right of way and easement(s); and WHEREAS, in accordance with Iowa law, a government body shall make a good faith effort to negotiate with the property owner to purchase the private property or property interest before filing an application for condemnation or otherwise proceeding with the condemnation process. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Waukee, Iowa, that the public improvement known as the SE Archer Avenue Improvements Project is in the best interest of the City and is approved in the location and in accordance with plans on file in public works; and BE IT FURTHER RESOLVED, that the City staff or its designee be and is hereby authorized to proceed with the necessary activities and negotiations to acquire by purchase, gift, or condemnation, subject to approval by this Council, the necessary property and/or property interests required for the construction of said public improvement.
