AGENDA ITEM: Consideration of approval of a resolution approving a site plan for Unleashed
Pets (970 SE Brick Drive)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: Downing Construction, Inc requests approval of a site plan
to authorize the construction of a single-story, 5,970 square foot building for a doggie daycare,
boarding and grooming facility. The building is 24-feet in height. The main entrance to the building is
along the east side. An outdoor dog play area is shown to the west of the building and will be enclosed
with a privacy fence. There will also be open play time where people will be allowed to grab a
beverage and hang out with their dog in the designated play area. The times designated for play time
are after 5pm, when the boarding and grooming operations are not taking place. A trash enclosure is
proposed at the north side of the site.
One access will be provided into the site off of SE Brick Drive. A pedestrian connection will also be
provided into the site from the sidewalk along SE Brick Drive. A total of 19 parking spaces are
required and they are providing 19 parking spaces.
The site will be serviced with public utilities. Stormwater management is provided with a detention
basin located along the the west of the site. The landscape plan meets the requirements of the
Landscape and Open Space Ordinance.
The elevations of the building are proposed to be constructed mainly of brick, stone, metal panel, and
glazing.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed this project at the July 11, 2023, Commission Meeting and recommended approval
subject to remaining staff comments:
Approval of a Site Plan for Unleashed Pets (970 SE Brick Drive)
Planning Coordinator, Melissa DeBoer, introduced the request for a site plan for a commercial
building for an animal boarding/daycare facility, as submitted by Downing Construction, Inc. The
property is generally located north of SE University Avenue and east of SE Alice’s Road,
containing approximately 1.49 acres.
The project includes the construction of a single-story building that is 5,970 square feet in
area. The building is 24-feet in height. The building will be used for pet daycare, boarding and
grooming. There is also open play time where people can come grab a beverage and hang out with
their dog in the designated play area. The main entrance to the building is located along the east
side. Behind the building, or just west of the building, are the outdoor dog area. These areas will
be enclosed with a 6-ft tall, grey vinyl, privacy fence. The outdoor play area is approximately
3,500 square feet in area. A trash enclosure is proposed along the north side of the site.
One access will be provided into the site from SE Brick Drive. A total of 19 parking spaces
are required for the proposed site plan. The total amount of parking proposed is 19 spaces,

including one accessible space. Additionally, the applicant has shown potential for five future
parking spaces off of the private access drive to the west if necessary. A sidewalk will be provided
to these spaces if developed in the future.

and are located along minor or major arterials. The site plan is in general conformance with the
Site Plan Ordinance and Comprehensive Plan.
• Commissioner Streit asked what is located north of the property. Mrs. DeBoer
responded that location is Gerber Collision
• Commissioner Streit asked about other access points. Mrs. DeBoer responded the
only access point is SE Brick Drive, nothing on SE Alice’s Road. However, there is
potential for shared access with any future development in the area.
• Commissioner Bankole asked about parking space and parking overflow; she is
concerned there is enough space due to the play area feature and beverage station for
owners. Community Development Director, Andy Kass, responded to speak about the
19 spaces that are currently included in the site plan. Mr. Kass explained that city
ordinance allows shared parking based on times of use and hours of operation. Even
though there is no street parking on SE Brick Drive, there are no anticipated issues
with parking. There is also potential for five additional spaces on the west side if
needed.
Staff recommends approval of a site plan for Unleashed Pets, 970 SE Brick Drive, subject to
any remaining staff comments and review of the legal documents.
Commissioner Beenken motioned to approval the approval of a site plan for Unleashed Pets,
970 SE Brick Drive, subject to any remaining staff comments and review of the legal documents. The
motion was seconded by Commissioner Tessau. Ayes: Beenken, Streit, Tessau, Lohse, and Bankole.
Nays: None. Motion carried.
STAFF REVIEW AND COMMENT: Staff recommends approval of the site plan subject to
remaining staff comments.
RECOMMENDATION: Approve the resolution subject to remaining staff comments.

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Site Plan for Unleashed Pets, subject to remaining staff comments on July 11, 2023; AND,
WHEREAS, the Site Plan for Unleashed Pets is in general conformance with §160 – Site and
Building Development Standards Ordinance of the Waukee Municipal Code; AND,
WHEREAS, the Site Plan for Unleashed Pets is in general conformance with §161 –
Landscaping and Open Space Ordinance of the Waukee Municipal Code; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 24th day of July, 2023 that the Site Plan for Unleashed Pets is approved subject to remaining
staff comments.

13.THE CONTRACTOR IS RESPONSIBLE FOR CLEANING DIRT AND DEBRIS
FROM NEIGHBORING STREETS, DRIVEWAYS, AND SIDEWALKS CAUSED BY
CONSTRUCTION ACTIVITIES AT THE END OF EACH WORK DAY AND PRIOR

14.THE ADJUSTMENT OF ANY EXISTING UTILITY APPURTENANCES TO FINAL

15.THE CONTRACTOR SHALL BE RESPONSIBLE FOR INSTALLING EROSION
CONTROL MEASURES AS NECESSARY. CONTRACTOR SHALL ALSO BE

MEASURES ON SITE AT THE TIME OF CONSTRUCTION. GRADING AND SOIL

16.CONTRACTOR TO COORDINATE NATURAL GAS, ELECTRICAL, TELEPHONE
AND ANY OTHER FRANCHISE UTILITY SERVICES WITH UTILITY SERVICE
PROVIDER, CITY OF WAUKEE, AND THE OWNER PRIOR TO CONSTRUCTION.
17.CONTRACTOR TO VERIFY ALL UTILITY CROSSINGS AND MAINTAIN MINIMUM
18" VERTICAL AND HORIZONTAL CLEARANCE BETWEEN UTILITIES.
CONTRACTOR TO COORDINATE UTILITY ROUTING TO BUILDING AND
VERIFY CONNECTION LOCATIONS AND INVERTS PRIOR TO

18.APPROVED FIRE APPARATUS ACCESS ROADS SHALL BE PROVIDED AS

A.POLLUTION PREVENTION AND EROSION PROTECTION
1. CODE COMPLIANCE: THE CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH
ALL POTENTIAL POLLUTION AND SOIL EROSION CONTROL REQUIREMENTS OF THE
IOWA CODE, THE IOWA DEPARTMENT OF NATURAL RESOURCES (IDNR) NPDES
PERMIT, THE U.S. CLEAN WATER ACT AND ANY LOCAL ORDINANCES. THE
CONTRACTOR SHALL TAKE ALL NECESSARY STEPS TO PROTECT AGAINST EROSION
AND POLLUTION FROM THIS PROJECT SITE AND ALL OFF-SITE BORROW OR DEPOSIT
AREAS DURING PERFORMANCE OR AS A RESULT OF PERFORMANCE.
2.DAMAGE CLAIMS: THE CONTRACTOR WILL HOLD THE OWNER AND ARCHITECT /
ENGINEER HARMLESS FROM ANY AND ALL CLAIMS OF ANY TYPE WHATSOEVER
RESULTING FROM DAMAGES TO ADJOINING PUBLIC OR PRIVATE PROPERTY,

B.STORM WATER DISCHARGE PERMIT
1. THIS PROJECT REQUIRES COVERAGE UNDER THE NPDES GENERAL PERMIT NO. 2
FOR STORM WATER DISCHARGES ASSOCIATED WITH CONSTRUCTION ACTIVITIES
FROM THE IDNR, AS REQUIRED BY THE ENVIRONMENTAL PROTECTION AGENCY
(EPA). THE GENERAL CONTRACTOR AND ALL SUBCONTRACTORS ARE RESPONSIBLE
FOR COMPLIANCE WITH AND FULFILLMENT OF ALL REQUIREMENTS OF THE NPDES
GENERAL PERMIT NO. 2 AS SPECIFIED IN THE CONTRACT DOCUMENTS.
2.ALL DOCUMENTS RELATED TO THE STORM WATER DISCHARGE PERMIT, INCLUDING,
BUT NOT LIMITED TO, THE NOTICE OF INTENT, PROOF OF PUBLICATIONS,
DISCHARGE AUTHORIZATION LETTER, CURRENT SWPPP, SITE INSPECTION LOG, AND
OTHER ITEMS, SHALL BE KEPT ON SITE AT ALL TIMES AND MUST BE PRESENTED TO
ANY JURISDICTIONAL AGENCIES UPON REQUEST. FAILURE TO COMPLY WITH THE
NPDES PERMIT REQUIREMENTS IS A VIOLATION OF THE CLEAN WATER ACT AND THE
CODE OF IOWA.
3.A "NOTICE OF DISCONTINUATION" MUST BE FILED WITH THE IDNR UPON FINAL
STABILIZATION OF THE DISTURBED SITE AND REMOVAL OF ALL TEMPORARY
EROSION CONTROL MEASURES. ALL PLANS, INSPECTION REPORTS, AND OTHER
DOCUMENTS MUST BE RETAINED FOR A PERIOD OF THREE YEARS AFTER PROJECT
COMPLETION. THE CONTRACTOR SHALL RETAIN A RECORD COPY AND PROVIDE THE
ORIGINAL DOCUMENTS TO THE OWNER UPON PROJECT ACCEPTANCE AND/OR
SUBMITTAL OF THE NOTICE OF DISCONTINUATION.
C.POLLUTION PREVENTION PLAN
1. THE STORM WATER POLLUTION PREVENTION PLAN (SWPPP) IS A SEPARATE
DOCUMENT IN ADDITION TO THESE PLAN DRAWINGS. THE CONTRACTOR SHOULD
REFER TO THE SWPPP FOR ADDITIONAL REQUIREMENTS AND MODIFICATIONS TO
THE POLLUTION PREVENTION PLAN MADE DURING CONSTRUCTION.
2.THE SWPPP ILLUSTRATES GENERAL MEASURES AND BEST MANAGEMENT
PRACTICES (BMP) FOR COMPLIANCE WITH THE PROJECT'S NPDES PERMIT
COVERAGE. ALL BMP'S AND EROSION CONTROL MEASURES REQUIRED AS A
RESULT OF CONSTRUCTION ACTIVITIES ARE THE RESPONSIBILITY OF THE
CONTRACTOR TO IDENTIFY, NOTE AND IMPLEMENT. ADDITIONAL BMP'S FROM
THOSE SHOWN ON THE PLAN MAY BE REQUIRED.
3.THE SWPPP AND SITE MAP SHOULD BE EXPEDITIOUSLY REVISED TO REFLECT
CONSTRUCTION PROGRESS AND CHANGES AT THE PROJECT SITE.
4.THE CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH ALL REQUIREMENTS OF
THE GENERAL PERMIT AND SWPPP, INCLUDING, BUT NOT LIMITED TO, THE
FOLLOWING BMP'S UNLESS INFEASIBLE OR NOT APPLICABLE:
a.UTILIZE OUTLET STRUCTURES THAT WITHDRAW WATER FROM THE SURFACE
WHEN DISCHARGING FROM BASINS, PROVIDE AND MAINTAIN NATURAL BUFFERS
AROUND SURFACE WATERS, DIRECT STORM WATER TO VEGETATED AREAS TO
INCREASE SEDIMENT REMOVAL AND MAXIMIZE STORM WATER INFILTRATION,
AND MINIMIZE SOIL COMPACTION.
b.INSTALL PERIMETER AND FINAL SEDIMENT CONTROL MEASURES SUCH AS SILT
BARRIERS, DITCH CHECKS, DIVERSION BERMS, OR SEDIMENTATION BASINS
DOWNSTREAM OF SOIL DISTURBING ACTIVITIES PRIOR TO SITE CLEARING AND
GRADING OPERATIONS.
c.PRESERVE EXISTING VEGETATION IN AREAS NOT NEEDED FOR CONSTRUCTION
AND LIMIT TO A MINIMUM THE TOTAL AREA DISTURBED BY CONSTRUCTION
OPERATIONS AT ANY TIME.
d.MAINTAIN ALL TEMPORARY AND PERMANENT EROSION CONTROL MEASURES IN
WORKING ORDER, INCLUDING CLEANING, REPAIRING, REPLACEMENT, AND
SEDIMENT REMOVAL THROUGHOUT THE PERMIT PERIOD. CLEAN OR REPLACE
SILT CONTROL DEVICES WHEN THE MEASURES HAVE LOST 50% OF THEIR
ORIGINAL CAPACITY.
e.INSPECT THE PROJECT AREA AND CONTROL DEVICES (BY QUALIFIED
PERSONNEL ASSIGNED BY THE CONTRACTOR) EVERY SEVEN CALENDAR DAYS.
RECORD THE FINDINGS OF THESE INSPECTIONS AND ANY RESULTING ACTIONS IN
THE SWPPP WITH A COPY SUBMITTED WEEKLY TO THE OWNER OR ENGINEER
DURING CONSTRUCTION. REVISE THE SWPPP AND IMPLEMENT ANY
RECOMMENDED MEASURES WITHIN 7 DAYS.
f.PREVENT ACCUMULATION OF EARTH AND DEBRIS FROM CONSTRUCTION
ACTIVITIES ON ADJOINING PUBLIC OR PRIVATE PROPERTIES, INCLUDING
STREETS, DRIVEWAYS, SIDEWALKS, DRAINAGEWAYS, OR UNDERGROUND

·Prune and thin out plants when needed. Remove weeds throughout
the growing season, preferably by pulling or trimming. Replace
plants when needed.
·Remove trash and debris from pretreatment area and bioswale.
·Inspect inflow points for clogging (offline systems). Remove any
sediment.
·Inspect filter strip/grass channel for erosion or gullying. Re-seed or
sod as necessary.
·Plants should be inspected to evaluate their health and remove any
dead or severely diseased vegetation.
·Look for evidence of standing water in the riser pipe. This may be a
sign of hydraulic failure.
·Replace choker layer materials on rock checks when clogged.
·When ponding routinely exceeds the design drainage time then
investigate to determine the cause and take corrective measures.
